If your company sells products or offers services that are not related to casino or gaming activity, then your company probably does not require a Casino Service Industry license before it may begin conducting business with a casino licensee or license applicant (casino) in Atlantic City.*
Your enterprise may contact any casino and offer it your non-gaming related product or service. If you conduct $10,000 or more worth of business with a casino in any calendar year, or if the type of business you conduct is described in the commission's regulations [N.J.A.C. 19:43-10.4(b)1], the casino is required to file a Vendor Registration Form on your behalf. This form, which is not a license application, simply provides the commission with basic information about your company, its owners, and its principal employees.Once this action takes place you will be notified, and other casinos may transact non-gaming business with you.
The Commission staff will monitor all disbursements between your enterprise and the casino industry. Your enterprise will be requested to file an application for a non-gaming Casino Service Industry license if within any twelve (12) month period, your business transactions equal or exceed $300,000 with one casino or $650,000 with more than one casino. Additionally, an enterprise which has not reached one of these thresholds may still be requested to file a license application based upon other standards described in the regulations [N.J.A.C. 19:51-1.2A].
Should your enterprise be requested to file a non-gaming related Casino Service Industry license application, you will be given sixty (60) days to file. Because the application must include a non-refundable filing fee of $3,000, staff suggests that you not file an application with the commission unless you are requested to do so.
It should be noted, in the event that you do not file a Vendor Registration Form or Casino Service Industry license application when requested, all existing agreements between the Casino and your enterprise may be terminated, and the casino industry may be prohibited from transacting any further business with your company.
