FRIGEN: Item 6. 20 Item No. 6 1 MR. NANCE: What did I say? 2 Excuse me, correction, Item 6. 3 MS. FRIGEN: Madam Chair, Commissioners, 4 the Commission has already entered preliminary 5 orders with regard to Mr. Luu suspending his 6 casino employee license, preliminarily placing 7 his name on the exclusion list, and preliminarily 8 prohibiting he and his company, Oriental Delight, 9 from transacting business. 10 Mr. Luu through his attorney, William 11 Hughes, has subsequently signed a waiver form 12 essentially waiving his right to a hearing with 13 respect to final action in all those four cases 14 and not contesting the revocation of his license, 15 the denial of his license renewal, a final 16 prohibitory order or final exclusion. 17 So the matter is presented for your 18 consideration today. 19 CHAIR KASSEKERT: Thank you. 20 Miss Stancil? 21 MS. STANCIL: I have nothing further. 22 CHAIR KASSEKERT: Any questions? 23 COMMISSIONER SOMMELING: No questions, 24 Madam Chair. 25 COMMISSIONER EPPS: Madam Chair, I move 21 Item No. 7 1 we issue a final order and A) revoke Mr. Luu's 2 casino employee license; B) deny his casino 3 employee license renewal application; C) grant 4 the Division's petition for his final exclusion; 5 and D) grant the relief in a Division complaint 6 seeking a final prohibition from Mr. Luu and his 7 company, Oriental Delight Restaurant, and 8 prohibit them from transacting any direct or 9 indirect business with any casino licensees in 10 Atlantic City until further order. 11 COMMISSIONER SOMMELING: Second. 12 CHAIR KASSEKERT: The motion has been 13 made and seconded. All in favor? 14 (Aye.) 15 CHAIR KASSEKERT: Opposed? 16 (No response.) 17 CHAIR KASSEKERT: The motion carries. 18 (The Commission members vote unanimously 19 in favor of the motion.) 20 MR. NANCE: Item No. 7, petition of 21 Anthony Stephens for early reapplication. 22 Miss Frigen? 23 MS. FRIGEN: Let me ask whether 24 Mr. Stephens is present? 25 (No response.) 22 Item No. 7 1 MS. FRIGEN: He is not. 2 The Commission may recall this matter 3 was adjourned two weeks ago. The staff had 4 recommended that if this petition was granted, it 5 was done on the condition he sign two wage 6 executions. 7 I subsequently the next day spoke with 8 Mr. Stephens, explained that he was agreeable to 9 the waive executions, and indicated he would be 10 here today at 10. 11 I got a call about 20 of 10 this 12 morning. He was in Pleasantville saying -- 13 seeking an adjournment again -- saying he had 14 just gotten in, and he couldn't come. I told him 15 to come to the meeting, I said, because we could 16 effectuate the wage executions subsequent to the 17 Commission's consideration. He indicated he 18 would be here, and it's about an hour later, and 19 he's not here. 20 So I leave this matter to your 21 discretion on how you'd like to handle it from 22 this point. 23 CHAIR KASSEKERT: Why don't we carry it 24 to the end of the meeting, and then we'll make a 25 determination. So we'll move on to Item 8. 23 Item No. 8 1 MR. NANCE: Item No. 8, application for 2 suspension in State versus Frank DiTommaso, Peter 3 DiTommaso, Interstate Industrial Corporation and 4 Interstate Drywall Corporation. 5 Miss Frigen? 6 MS. FRIGEN: Madam Chair, Commissioners, 7 the Commission received a letter from Thomas 8 Durkin on July 31st suggesting that respondents 9 would not be contesting the suspension action, 10 but let me confirm for the record that there is 11 no one here on behalf of the companies or the 12 DiTommasos. 13 (No response.) 14 MS. FRIGEN: Apparently not. 15 I would refer this matter to the 16 Division. 17 MR. SCHWEFEL: Good morning, Chair; good 18 morning, Commissioners. I'm pleased to be here 19 before you to present this. 20 In light of my adversary's absence, or 21 confirmal of non-contesting in this issue, I 22 really would rely upon the papers that you have. 23 If you have any questions, I'd be more than happy 24 to answer them. 25 CHAIR KASSEKERT: Any questions for 24 Item No. 9 1 Mr. Schwefel? 2 COMMISSIONER FEDORKO: Motion to grant 3 the Division's application to suspend the casino 4 service industry licenses held by Interstate 5 Industrial Corporation and Interstate Drywall 6 Corporation, and prohibit both companies and 7 Frank and Peter DiTommaso from transacting any 8 direct or indirect business with any casino 9 licensees in Atlantic City until further order. 10 VICE CHAIR FRULIO: Second. 11 CHAIR KASSEKERT: The motion has been 12 made and seconded. All in favor? 13 (Aye.) 14 CHAIR KASSEKERT: Opposed? 15 (No response.) 16 CHAIR KASSEKERT: The motion carries. 17 (The Commission members vote unanimously 18 in favor of the motion.) 19 MR. SCHWEFEL: Thank you. 20 MR. NANCE: Item No. 9, proposed adoption 21 of amendments to N.J.A.C. 19:45-1.21. 22 Mr. Briliant? 23 MR. BRILIANT: Good morning, Madam Chair 24 and Commissioners. The attached proposal now 25 before you would create a dollar threshold for 25 Item No. 9 1 the filing of a written variance report when the 2 table is opened for gaming and a discrepancy is 3 found between the amount of actual chips counted 4 and the amount of chips reported on the opener. 5 The proposal would continue to require 6 verbal notification to the parties of any 7 discrepancy regardless of the amount, but would 8 establish a minimum threshold of greater than 9 five dollars for a written report. 10 Notice of proposal was published in the 11 New Jersey Register on May 15, 2006. We did 12 receive three comments, and you have the staff's 13 discussion of those comments, and the 14 recommendations' now before you. Thank you. 15 CHAIR KASSEKERT: Any questions for 16 Mr. Briliant? 17 COMMISSIONER SOMMELING: Motion to adopt 18 as published without change. 19 COMMISSIONER FEDORKO: Second. 20 CHAIR KASSEKERT: The motion has been 21 made and seconded. All in favor? 22 (Aye.) 23 CHAIR KASSEKERT: Opposed? 24 (No response.) 25 CHAIR KASSEKERT: The motion carries. 26 Item No. 10 1 (The Commission members vote unanimously 2 in favor of the motion.) 3 MR. NANCE: Item No. 10, proposed 4 adoption of amendments to N.J.A.C. 19:45-1.35. 5 Mr. Briliant? 6 MR. BRILIANT: This proposal would permit 7 slot supervisors to carry an imprest inventory 8 for the purpose of exchanging currency and 9 coupons presented by the patron or imprest 10 inventory of currency not exceeding $5,000 to be 11 used for pouch payouts and the exchange of 12 currency and coupons presented by a patron. 13 This notice of reproposal was published 14 in the New Jersey Register on May 15, 2006. We 15 did receive one comment from the Division of 16 Gaming Enforcement which did not object to the 17 proposal. The matter is now before you for final 18 adoption. 19 CHAIR KASSEKERT: Thank you. 20 Any questions? 21 COMMISSIONER SOMMELING: No questions, 22 Madam Chair. 23 COMMISSIONER FEDORKO: Adopt as published 24 without change. 25 VICE CHAIR FRULIO: Second. 27 Item No. 11 1 CHAIR KASSEKERT: The motion has been 2 made and seconded. All in favor? 3 (Aye.) 4 CHAIR KASSEKERT: Opposed? 5 (No response.) 6 CHAIR KASSEKERT: The motion carries. 7 (The Commission members vote unanimously 8 in favor of the motion.) 9 MR. NANCE: Item No. 11, proposed 10 adoption of amendments to N.J.A.C. 19:45-1.24a. 11 MR. BRILIANT: This reproposal would 12 provide casino licensees with additional 13 flexibility in accepting and documenting wire 14 transfers. A casino licensee receiving a wire 15 transfer would be required to obtain the sending 16 bank's name as well as its address or its 17 American Banking Association routing number, and 18 either the account number or the name of the 19 account from which the funds were transferred or 20 the federal reference number for the wire 21 transfer. 22 The notice of reproposal was published 23 in the New Jersey Register on May 15, 2006. 24 We've received one comment from the Division of 25 Gaming Enforcement which supports the proposal, 28 Item No. 11 1 and the matter is now before you for final 2 adoption. 3 CHAIR KASSEKERT: Thank you. 4 Any questions? 5 COMMISSIONER SOMMELING: No questions, 6 Madam Chair. 7 COMMISSIONER FEDORKO: Adopt as published 8 without change. 9 VICE CHAIR FRULIO: Second. 10 CHAIR KASSEKERT: The motion has been 11 made and seconded. All in favor? 12 (Aye.) 13 CHAIR KASSEKERT: Opposed? 14 (No response.) 15 CHAIR KASSEKERT: The motion carries. 16 (The Commission members vote unanimously 17 in favor of the motion.) 18 MR. BRILIANT: I also just wanted to take 19 a second and note on the record the assistance 20 that we received from Wendy Way and her Division 21 agents. After talking with them, I learned more 22 about wire transfers and banking procedures than 23 I ever really wanted to know about, it was 24 extremely helpful. 25 CHAIR KASSEKERT: Very good. 29 Item No. 12 1 MR. BRILIANT: Thank you. 2 CHAIR KASSEKERT: Thank you, 3 Mr. Briliant. Thank you, Wendy. 4 Also, I would note most of these items 5 came through the Wish List process. So we 6 continue to move forward with those items. Thank 7 you. 8 MR. NANCE: Item No. 12, proposed 9 adoption of amendments to N.J.A.C. 19:47-3.12, 10 4.12 and 7.11. 11 Mr. Mamolen? 12 MR. MAMOLEN: Madam Chair, Commissioners, 13 this matter is before you for final adoption and 14 deals with the disposition of an irregularity 15 where card, a card is disclosed in error in the 16 game of two baccarats that are authorized as well 17 as the minibaccarat. 18 During the public comment period, we 19 received two comments. Borgata did not -- 20 endorses the proposal, whereas the Division did 21 not object to it. 22 Again, it's before you for final 23 adoption. 24 CHAIR KASSEKERT: Thank you. 25 Any questions? 30 Item No. 13 1 COMMISSIONER FEDORKO: Motion to adopt as 2 published. 3 VICE CHAIR FRULIO: Second. 4 CHAIR KASSEKERT: The motion has been 5 made and seconded. NANCE: Item No. 13, proposed 13 publication and temporary adoption of amendment 14 to N.J.A.C. 19:47-2.7. 15 Mr. Mamolen? 16 MR. MAMOLEN: This is before you for both 17 publication and temporary adoption, and it deals 18 with a simple transaction where when a blackjack 19 player posts an insurance wager. Instead of 20 actually pushing the chips forward to the area, 21 you can just make a hand motion or gesture to the 22 dealer if the casino elects to offer this option 23 so they can get paid one to one on the blackjack. 24 It in essence consolidates it without actually 25 moving the chips forward. 31 Item No. 7 1 CHAIR KASSEKERT: Thank you. 2 Any questions? 3 COMMISSIONER SOMMELING: No questions, 4 Madam Chair. 5 COMMISSIONER FEDORKO: Approve for 6 publication and temporary adoption. 7 VICE CHAIR FRULIO: Second. 8 CHAIR KASSEKERT: The motion has been 9 made and seconded. All in favor? 10 (Aye.) 11 CHAIR KASSEKERT: Opposed? 12 (No response.) 13 CHAIR KASSEKERT: The motion carries. 14 (The Commission members vote unanimously 15 in favor of the motion.) 16 CHAIR KASSEKERT: We'll now return to 17 Item 7? 18 MR. NANCE: Item 7. 19 MS. FRIGEN: I just checked to see 20 whether Mr. Stephens had signed in. I also 21 checked the cage area to see if he had 22 incorrectly went to the other area, and he's not 23 here today. 24 I would note that the original meeting 25 notice did tell him that his attendance was 32 Item No. 7 1 required at the first meeting two weeks ago. He 2 clearly got notice that the case was rescheduled. 3 He clearly knew about the meeting today because 4 he called us. 5 The staff is inclined under all the 6 circumstances in its failure to advance his 7 petition here and given the other concerns, that 8 the Commission consider denying his petition, but 9 we leave that for your discretion. 10 CHAIR KASSEKERT: Thank you. 11 Division have any opinion? 12 MS. STANCIL: The Division concurs with 13 the Division staff's recommendation. 14 CHAIR KASSEKERT: Thank you. 15 Any questions? 16 COMMISSIONER FEDORKO: Make a motion to 17 deny his request. 18 COMMISSIONER SOMMELING: Second. 19 CHAIR KASSEKERT: The motion has been 20 made and seconded. All in favor? 21 (Aye.) 22 CHAIR KASSEKERT: Opposed? 23 (No response.) 24 CHAIR KASSEKERT: The motion carries. 25 (The Commission members vote unanimously 33 Public Participation 1 in favor of the motion.) 2 MR.
