A regular meeting of the Merit System Board was held on
Tuesday, August 29, 2000, in Trenton, New Jersey.

PRESENT: Acting Chairman Lewis A. Scheindlin, Merit System
Board Members, Alan Dexter Bowman, and Leo R. Vartan; Elizabeth
Laufer, Deputy Attorney General; Henry Maurer, Director, Division

In accordance with L.1975, c.231, Acting Chairman Lewis A.
Scheindlin, opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State
and sent to the Trentonian, Trenton Times, Courier-Post and Star
Ledger on August 15, 2000 and posted at the Department of
Personnel, 3 Station Plaza, Trenton, New Jersey.

All other actions were by unanimous vote unless otherwise
specified.

collection.

Position #044135- This position serves as the Assistant Director,
Technology and Agency Interface, manages the Technology and
Agency Interface Branch which includes Technology Development,
Technology Systems and Transaction Audit. It provides
Technology and Agency Interfacesupport for the Division
of Revenue, the Office of Information Technology (OIT),
Federal agencies, and State clients.

Position #068891- This position serves as the Assistant Director,
Revenue Management Policy. It manages the collection activities
for the Division of Revenue and the development and
implementation of statewide policy for the management of debt.

A review of the proposed job functions has been conducted. The
duties and responsibilities of each position are constant with
the standards established for inclusion in the Senior Executive
Service. Based on this review, I am recommending that this
nomination be endorsed.

DEPARTMENT OF LABOR

The Department of Labor is requesting that the following
positions be reallocated to the Senior Executive Service.

Your approval of the reallocation of these positions to the
Senior Executive Service is recommended. Each position is
vacant.

A review of the assigned job functions has been conducted. The
function meets the standards established for inclusion in the
Senior Executive Service.

The Department of Labor has entered into a competitive process
with public and private sector entities for contracts to oversee
One-Stop Centers. The administrators of each One-Stop Center
will be selected by the local Workforce Investment Board and the
county government executive. The Department of labor anticipates
the award of several contracts and intends for the four positions
as One-Stop Administrators.

The One-Stop Administrators will be appointed from the Career
Service and will report directly to the Assistant Director,
Workforce New Jersey, Department of Labor. Under the auspices of
the Workforce Investment Board, each position will design,
implement and manage a One-Stop Career System in a local
workforce investment area. Each will function in accordance with
the terms and conditions of a contract or memorandum of
understanding with the local Workforce Investment Board and in
accordance with the local Workforce Investment Board plan.

A-3 BERGEN COUNTY UTILITIES AUTHORITY LAYOFFS

The appeals of approximately 52 Bergen County Utilities
Authority employees, Union Local 534 represented by Dennis
J. Alessi, Esq., and Stephen Plancher, represented by
Michael Gogal, Esq., on the grounds of the good faith of
their layoff effective October 6, 1995, for reason of
economy and efficiency.

Recommendation of the Administrative Law Judge - Uphold the
layoffs. The following petitioners are entitled to back
pay. Petitioners Pagan, Dreitland, Clauburg, Callahan,
Venieri, Klasfski, Vitale, and Warok are entitled to 45
days' back pay. Petitioner Crawley is entitled to 40 days'
back pay. Petitioner Webber is entitled to 15 days' back
pay and petitioner Plancher is entitled to 31 days' back
pay. Petitioners Lizell and Cicalese are not entitled to
back pay awards.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

Lisa Brown, Senior Data Entry Machine Operator,

not in good standing and removal effective December 17,
1996, on charges of unauthorized absences.

A-8 EXAMINATION FOR POLICE SERGEANT (PM3776V), CITY OF PATERSON

Troy Oswald, et al., petitions the Merit System Board for
the removal of the names of Marco Catania and James Durkin,
from the eligible list for Police Sergeant (PM3776V), City
of Paterson, Police Department based on the claim that
Durkin and Catania had knowledge of test content prior to
taking a make-up examination.

Recommendation of the Administrative Law Judge - Grant
motion for summary decision, dismissing the petition.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

perform duties and neglect of duty.

Recommendation of the Administrative Law Judge - Modify the
removal to a six-month suspension.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge to a three-month
suspension.

Diego Vargas, Juvenile Detention Officer, County of Union,

A-17 JASON SIMONET - SETTLEMENT

Jason Simonet, County Correction Officer, removal effective

Merit System Board at its meeting of August 8, 2000,

Recommendation of the Administrative Law Judge - Acknowledge

A-18 WILLIAM SHIRDEN - SETTLEMENT

William Shirden, Police Officer, Police Department, City of
East Orange, suspension for 45 days, on charges of neglect
of duty, failure to perform duties. Settled to a reduction
of the 45-day suspension to a 30-day suspension and
reimbursement of 15 days pack pay. The Merit System Board
at its meeting of August 8, 2000 directed that this matter
be held over.

ACTION: The Merit System Board acknowledged the settlement
as clarified.

A-19 ROBERT RUSSO - SETTLEMENT

Robert Russo, Police Lieutenant, Police Department, City of
Newark, suspension for six months, on charges of criminal
law, misconduct generally. Settled to appellant agrees to
accept the six-month suspension without pay. The Merit
System Board at its meeting of August 8, 2000 directed that
this matter be held over.

Recommendation of the Administrative Law Judge - Acknowledge
the settlement.

ACTION: The Merit System Board acknowledged the settlement

Chris F. Cherubino appeals his rejection as a County

John Bowman, a Gaming Regulator 2 with the Casino Control
Commission, petitions the Merit System Board to relax the
provisions of N.J.A.C. 4A:6-1.6(b)3 to allow him to receive
SLI benefits after the one-year period provided therein.

ACTION: The Merit System Board granted the request for
rule relaxation.

Edeline Burnett, a Human Services Technician at Trenton
Psychiatric Hospital, Department of Human Services, appeals

The Director, Division of Selection Services, requests that
the out-of-title work performed by Cynthia Holland and
Evelyn Maccarone, while serving in the title of Senior Clerk
Typist, be accepted as satisfying the requirements for a
qualifying examination for Senior Library Assistant.

ACTION: The Merit System Board granted the requests.

B-120 KAREN MABRY-LUCAS

The Director, Division of Selection Services, on behalf of
the Department of Education, requests that Karen Mabry-
Lucas' out-of-title work experience be accepted to qualify
her for a prospective promotional examination for
Administrative Analyst 3, Procurement.

ACTION: The Merit System Board granted the request.

B-121 RAYMOND TAYLOR

Raymond Taylor, a Planning Associate 3 with the Department
of Education appeals the promotion of Francis Auleta from
Planning Associate 3 to Planning Associate 1 Budget/Finance.

ACTION: The Merit System Board directed that this appeal
be denied.

B-122 RUTH DAVIS

Ruth Davis appeals the decision of the Division of Human
Resource Management, which found that she did not file a
timely application for the promotional examination for
Technical Assistant (PS9714L), Department of Banking and
Insurance.

ACTION: The Merit System Board directed that this appeal
be denied.

B-123 DONNA LEE

Donna Lee requests reconsideration of the prior decision of
the Merit System Board, In the Matter of Donna Lee, Senior
Data Entry Machine Operator (PS6401I), Department of
Corrections (decided May 18, 1999), which affirmed the
denial of her eligibility for admittance to the aforesaid
promotional examination.

ACTION: The Merit System Board denied the request.

B-124 COREY KARAS AND JOSEPH NIGRO

The Town of Harrison, represented by Lawrence M. Fox, Esq.,
appeals the denial of transfer, under the Intergovernmental
Transfer Pilot Program, of Corey Karas and Joseph Nigro
from Sheriff's Officer, Hudson County Sheriff's Department
to Police Officer, Town of Harrison Police Department.

ACTION: The Merit System Board directed that these appeals
be granted.

B-125 DIANE IAPICCO

The Director, Division of Human Resource Management,
requests that the provisions of N.J.A.C. 4A:4-1.5 be relaxed
in order to allow Diane Iapicco, Marina Superintendent 2
(class code 18), to be appointed provisionally, pending
promotional examination, to the title of Superintendent,
Parks and Forestry 4 (class code 20), Department of
Environmental protection (DEP)

ACTION: The Merit System Board granted the request.

B-126 PROPOSED AMENDMENT TO N.J.A.C. 4A:6-1.22 - DONATED
LEAVE/ DEFINITION OF CATASTROPHIC HEALTH CONDITION
OR INJURY


It is recommended that the proposed amendment to N.J.A.C.
4A:6-1.22, concerning donated leave and the definition of
"catastrophic health condition or injury" be approved for
publication in the New Jersey Register.

ACTION: The Merit System Board approved the proposed
amendment for publication in the New Jersey
Register.

B-127 MERIT SYSTEM BOARD MINUTES

The Merit System Board Minutes for the meeting of August 8,
2000 are submitted for adoption.

ACTION: The Merit System Board directed that this matter
be held over.

B-128 PETER BIERNAT, ET AL.

Peter Biernat, Eric Carpenter, Concetta Dorner, Richard
Dutko, Susan Margolin, Maria Ortiz, John Powell III, Jane
Ronneburger, Raymond Schumacher, Susan Simon, Barbara Steele-
Channing, Laura Valentine, and Bernice Williams appeal their
scores on the Supervising Medical Review Analyst (SMRA)
(PS2935K) promotional examination.

ACTION: The Merit System Board granted the appeals in part
and denied the appeals in part.

B-129 TONYA L. BROWN

The appeal of Tonya L. Brown, a Correction Officer Recruit
with South Woods State Prison, Department of Corrections,
concerning her release at the end of her working test period
effective January 7, 1999, was heard by Administrative Law
Judge John R. Futey (ALJ), who rendered his initial decision
on March 14, 2000, reversing the release. At its meeting of
May 9, 2000, the Board adopted the ALJ's recommendation that
the appellant's release at the end of her working test
period be reversed. Additionally, the Board found that the
appellant served an appropriate working test period for the
first six months of the requisite 12-month working test
period, and, therefore, should be provided with an
additional six-month working test period. The proposed
final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.
