A regular meeting of the Merit System Board was held on Tuesday, August 29, 2000, in Trenton, New Jersey.
PRESENT: Acting Chairman Lewis A. Scheindlin, Merit System Board Members, Alan Dexter Bowman, and Leo R. Vartan; Elizabeth Laufer, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.
In accordance with L.1975, c.231, Acting Chairman Lewis A. Scheindlin, opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on August 15, 2000 and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All other actions were by unanimous vote unless otherwise specified.

Position #007164- This position serves as the Assistant Director, Processing Operations, managing the State's centralized tax reporting and remittance processing center. Also, it is responsible for the processing of all State tax returns, forms, and for debt collection.
Position #044135- This position serves as the Assistant Director, Technology and Agency Interface, manages the Technology and Agency Interface Branch which includes Technology Development, Technology Systems and Transaction Audit. It provides Technology and Agency Interfacesupport for the Division of Revenue, the Office of Information Technology (OIT), Federal agencies, and State clients.
Position #068891- This position serves as the Assistant Director, Revenue Management Policy. It manages the collection activities for the Division of Revenue and the development and implementation of statewide policy for the management of debt.
A review of the proposed job functions has been conducted. The duties and responsibilities of each position are constant with the standards established for inclusion in the Senior Executive Service. Based on this review, I am recommending that this nomination be endorsed.

DEPARTMENT OF LABOR
The Department of Labor is requesting that the following positions be reallocated to the Senior Executive Service.
Your approval of the reallocation of these positions to the Senior Executive Service is recommended. Each position is vacant.
A review of the assigned job functions has been conducted. The function meets the standards established for inclusion in the Senior Executive Service.
The Department of Labor has entered into a competitive process with public and private sector entities for contracts to oversee One-Stop Centers. The administrators of each One-Stop Center will be selected by the local Workforce Investment Board and the county government executive. The Department of labor anticipates the award of several contracts and intends for the four positions as One-Stop Administrators.
The One-Stop Administrators will be appointed from the Career Service and will report directly to the Assistant Director, Workforce New Jersey, Department of Labor. Under the auspices of the Workforce Investment Board, each position will design, implement and manage a One-Stop Career System in a local workforce investment area. Each will function in accordance with the terms and conditions of a contract or memorandum of understanding with the local Workforce Investment Board and in accordance with the local Workforce Investment Board plan.

The appeals of approximately 52 Bergen County Utilities Authority employees, Union Local 534 represented by Dennis J. Alessi, Esq., and Stephen Plancher, represented by Michael Gogal, Esq., on the grounds of the good faith of their layoff effective October 6, 1995, for reason of economy and efficiency.
Recommendation of the Administrative Law Judge - Uphold the layoffs. The following petitioners are entitled to back pay. Petitioners Pagan, Dreitland, Clauburg, Callahan, Venieri, Klasfski, Vitale, and Warok are entitled to 45 days' back pay. Petitioner Crawley is entitled to 40 days' back pay. Petitioner Webber is entitled to 15 days' back pay and petitioner Plancher is entitled to 31 days' back pay. Petitioners Lizell and Cicalese are not entitled to back pay awards.

Settled to a reduction of the 45-day suspension to a 30-day suspension and reimbursement of 15 days pack pay. The Merit System Board at its meeting of August 8, 2000 directed that this matter be held over.

Donna Lee requests reconsideration of the prior decision of the Merit System Board, In the Matter of Donna Lee, Senior Data Entry Machine Operator (PS6401I), Department of Corrections (decided May 18, 1999), which affirmed the denial of her eligibility for admittance to the aforesaid promotional examination.
ACTION: The Merit System Board denied the request.

The Town of Harrison, represented by Lawrence M. Fox, Esq., appeals the denial of transfer, under the Intergovernmental Transfer Pilot Program, of Corey Karas and Joseph Nigro from Sheriff's Officer, Hudson County Sheriff's Department to Police Officer, Town of Harrison Police Department.
ACTION: The Merit System Board directed that these appeals be granted.

B-126 PROPOSED AMENDMENT TO N.J.A.C. 4A:6-1.22 - DONATED LEAVE/ DEFINITION OF CATASTROPHIC HEALTH CONDITION OR INJURY
It is recommended that the proposed amendment to N.J.A.C. 4A:6-1.22, concerning donated leave and the definition of "catastrophic health condition or injury" be approved for publication in the New Jersey Register.
ACTION: The Merit System Board approved the proposed amendment for publication in the New Jersey Register.

B-128 PETER BIERNAT, ET AL.
Peter Biernat, Eric Carpenter, Concetta Dorner, Richard Dutko, Susan Margolin, Maria Ortiz, John Powell III, Jane Ronneburger, Raymond Schumacher, Susan Simon, Barbara Steele- Channing, Laura Valentine, and Bernice Williams appeal their scores on the Supervising Medical Review Analyst (SMRA) (PS2935K) promotional examination.
ACTION: The Merit System Board granted the appeals in part and denied the appeals in part.
B-129 TONYA L. BROWN
The appeal of Tonya L. Brown, a Correction Officer Recruit with South Woods State Prison, Department of Corrections, concerning her release at the end of her working test period effective January 7, 1999, was heard by Administrative Law Judge John R. Futey (ALJ), who rendered his initial decision on March 14, 2000, reversing the release. At its meeting of May 9, 2000, the Board adopted the ALJ's recommendation that the appellant's release at the end of her working test period be reversed. Additionally, the Board found that the appellant served an appropriate working test period for the first six months of the requisite 12-month working test period, and, therefore, should be provided with an additional six-month working test period. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board adopted the final decision.
