A regular meeting of the Merit System Board was held on Tuesday, October 11, 2000, in Trenton, New Jersey.
PRESENT: Chairwoman Janice Mitchell Mintz, Merit System Board Members, Margaret E. L. Howard and Leo Vartan; Elizabeth Laufer, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.
In accordance with L.1975, c.231, Acting Chairman Lewis A. Scheindlin, opened the meeting with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 8, 1999 and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.

ACTION: The Merit System Board acknowledged the settlements with the exception of Sobha Benjamin, which was held over.
A-2 GORDON ADAMS
Gordon Adams, Recovery Assistant Detoxification Unit, City of Atlantic City, Department of Health and Human Services, layoff effective April 15, 2000, for reasons of economy and efficiency.
Recommendation of the Administrative Law Judge - Dismiss the appeal.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge to dismiss the appeal and referred to the Commissioner of Personnel the determination of appellant's layoff rights appeal.
A-3 MELVIN BESSANT
Melvin Bessant, Senior Stock Clerk, Division of Taxation, Department of Treasury, removal effective July 21, 1998, on charges of insubordination, conduct unbecoming a public employee and violation of the Department of Treasury Workplace Violence Policy.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-4 JAMES BEST
James Best, Correction Officer Recruit, Bayside State Prison, Department of Corrections, removal effective September 9, 1999, on charges of neglect of duty, performance, insubordination and violation of safety and security precautions.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-5 CAROL CHANDLER
Appeal of Carol Chandler, School Bus Driver, Brick Township School District, concerning her bypass for appointment from the eligible list for School Bus Driver (M5772T), Brick Township School District.
Recommendation of the Administrative Law Judge - Uphold the bypass for appointment from the eligible list.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-6 JOSE GONZALEZ
Jose Gonzalez, Police Officer, City of Passaic, Police Department, suspension for 30 days, on charges of chronic or excessive absenteeism.
Recommendation of the Administrative Law Judge - Uphold the 30-day suspension.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-7 CAROL KIDD-WHITE
Carol Kidd-White, County Correction Officer, County of Mercer, Department of Public Care and Safety, removal effective July 1, 1999, on charges of official misconduct, conduct unbecoming an officer, forgery, and theft by deception.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-8 PETER MATHUS
Peter Mathus, Range Instructor, City of Jersey City, Police Department, removal effective July 20, 1999, on charges of insubordination and neglect of duty.
Recommendation of the Administrative Law Judge - Uphold the removal.
ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a six-month suspension.
A motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Merit System Board entered into Executive Session for the purpose of legal advice on the matters of A-9 James Pizzullo and A-13 Michael Smith. The Board subsequently reconvened the public meeting.
A-9 JAMES PIZZULLO (REMAND)
James Pizzullo, Police Sergeant, Township of Hamilton, Department of Public Safety, suspension for 30 days and demotion to the position of Police Officer, on charges of neglect, performance of duty, obedience of laws and regulations, and truthfulness.
Recommendation of the Administrative Law Judge - Uphold the 30-day suspension and the demotion to the position of Police Officer.
ACTION: The Merit System Board directed that this matter be held over.
A-10 SANDRA ROBINSON
Sandra Robinson, Principal Clerk Typist, City of Atlantic City, resignation not in good standing effective November 13, 1996, on charges of being absent from employment without appropriate authorization.
Recommendation of the Administrative Law Judge - Uphold the resignation not in good standing.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-11 JOSEPH SALAY
Joseph Salay, County Correction Lieutenant, County of Union, Department of Public Safety, removal effective March 18, 1998, on charges of official misconduct.
Recommendation of the Administrative Law Judge - Deny appellant's claim for back pay.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-12 LLOYD SMITH
Lloyd Smith, Human Services Assistant, Trenton Psychiatric Hospital, removal effective December 17, 1999, on charges of sleeping while on duty and neglect of duty.
Recommendation of the Administrative Law Judge - Dismiss the appeal.
ACTION: The Merit System Board remanded the matter to the Office of Administrative Law.
A-13 MICHAEL SMITH
Michael Smith, Stock Clerk, City of Vineland, Administration Department, removal effective September 11, 1998, on charges of abandonment of his position.
Recommendation of the Administrative Law Judge - Modify the removal to a resignation in good standing.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.
A-14 KEITH TYLER
Keith Tyler, Police Officer, City of Atlantic City, petitions the Merit System Board to set aside his resignation in good standing on the basis that it was submitted under duress.
Recommendation of the Administrative Law Judge - Uphold the resignation in good standing.
ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

Felix Andrades appeals his rejection as a County Correction Officer by the County of Hudson and its request to remove his name from the eligible list for County Correction Officer on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Merit System Board directed that this appeal be denied.
B-2 FRANK A. BORCHERS
Frank A. Borchers appeals his rejection as a Correction Officer Recruit by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit on the basis of psychological unfitness to perform effectively the duties of the position.
ACTION: The Merit System Board directed that this appeal be denied.

B-6 RALPH TULLO
Ralph Tullo appeals his rejection as a Sheriff's Officer candidate by Hudson County and its request to remove his name from the eligible list for Sheriff's Officer on the basis of medical unfitness to perform effectively the duties of the position. This matter was held over from the August 29, 2000 Board meeting for further clarification on the report of the Medical Examiners Panel.
ACTION: The Merit System Board directed that this appeal be granted.
B-7 DWAYNE WARFIELD
Dwayne Warfield appeals his rejection as a Police Officer candidate by the City of Camden and its request to remove his name from the eligible list for Police Officer on the basis of medical unfitness to perform effectively the duties of the position.

Lorraine T. Foscolo-Frasca, an Examination Technician, Division of Motor Vehicles, Department of Transportation, appeals the denial of sick leave injury (SLI) benefits.

B-16 JAMES W. COMBS, JR.
James W. Combs, Jr., represented by Lawrence E. Popp, Esq., appeals his termination from the provisional position of Human Services Technician and the removal of his name from the special reemployment list for Human Services Assistant at Trenton Psychiatric Hospital, with the Department of Human Services.
ACTION: The Merit System Board denied the appeal of removal from the provisional position, but granted a hearing on removal of his name from the special reemployment list.
B-17 SHEREE K. CULVERT
Sheree K. Culvert, a Correction Sergeant at Riverfront State Prison, Department of Corrections, represented by Kendall J. Collins, Esq., appeals her bypass on the certification for Correction Lieutenant (PS6320I).
ACTION: The Merit System Board directed that this appeal be denied.
B-18 HARRY DAHLMAN, ET AL.
The New Jersey Law Enforcement Supervisors Association, represented by Robert B. Reed, Esq., on behalf of Correction Sergeants Harry Dahlman, Robert Zimmer and James Wengert with the Department of Corrections, appeals the removal of their names from the list for Correction Lieutenant (PS6320I) based on their unsatisfactory employment records. It is noted that this matter was held over from the Board's September 12, 2000 meeting.
ACTION: The Merit System Board directed that this matter be held over.
B-19 LUTHER G. DAUGHERTY
Luther G. Daugherty, a Correction Sergeant Bayside State Prison, Department of Corrections, represented by Mario A. Iavicoli, Esq., appeals the decision of Selection Services which found that he was properly bypassed on the certification for Correction Lieutenant (PS6320I) based on an unsatisfactory employment record. It is noted that this matter was held over from the Board's September 12, 2000 meeting.
ACTION: The Merit System Board directed that this appeal be denied.
B-20 FRANK R. JACKSON
Frank R. Jackson, a Correction Sergeant at New Jersey State Prison, Department of Corrections (DOC), represented by John H. Rittley, Esq., appeals the decision of Selection Services which found that he was properly removed from the list for Correction Lieutenant (PS6320I) based on an unsatisfactory employment record.
ACTION: The Merit System Board directed that this appeal be denied.
B-21 GARY R. KERN, ET AL.
The New Jersey Law Enforcement Supervisors Association (NJLESA), represented by Robert B. Reed, Esq., on behalf of Correction Sergeants Gary R. Kern, Antonio C. Campos, Larry W. Cole and Robert M. Rupp with the Department of Corrections appeals the bypasses of the above Sergeants' names from the certification for Correction Lieutenant (PS6320I).
ACTION: The Merit System Board directed that these appeals be denied.
B-22 ALISA A. LOVE
Alisa A. Love, represented by Alan D. Krauss, Esq., appeals the decision of Human Resource Information Systems which found that the Department of Human Services had presented a sufficient basis to remove appellant's name from the Family Service Specialist Trainee (S6024O) eligible list as a result of making a false statement on her employment application and having a criminal record adversely relating to the employment sought.
ACTION: The Merit System Board directed that this appeal be denied.
B-23 ACCOUNTANT (M6387O), CITY OF IRVINGTON
The appointing authority's failure to properly dispose of the certification for Accountant while a provisional appointee is serving in the title has been referred to the Merit System Board for enforcement.
ACTION: The Merit System Board ordered the appointing authority to remove the provisional appointee, make an appointment from the certification and pay compliance costs.
B-24 ASSISTANT DIRECTOR, PUBLIC WORKS (M0799W), JERSEY CITY
The appointing authority requests permission not to make an appointment from the certification for Assistant Director, Public Works (M0799W), Jersey City.
ACTION: The Merit System Board granted the request for a waiver, but assessed partial costs.
B-25 COOK (C0760W), PASSAIC COUNTY
The appointing authority's failure to properly dispose of the certification for Cook while provisional appointees are serving in the title is referred to the Merit System Board for enforcement.
ACTION: The Merit System Board ordered the appointing authority to remove the provisional appointee, make an appointment from the certification and pay compliance costs.
B-26 MAINTENANCE REPAIRER (M6612A), VINELAND CITY SCHOOL DISTRICT
The appointing authority requests permission not to make an appointment from the certification for Maintenance Repairer (M6612A), Vineland City School District.
ACTION: The Merit System Board granted the request for a waiver, but assessed costs.
B-27 PROGRAM MONITOR (M6278O), JERSEY CITY
The appointing authority requests permission not to make an appointment from the certification for Program Monitor (M6278O), Jersey City.
ACTION: The Merit System Board granted the request for a waiver but assessed partial costs.
B-28 PROBRAM SUPPORT SPECIALIST 3, ASSISTANCE PROGRAMS (S6138W), DEPARTMENT OF THE TREASURY
The State Department of the Treasury requests permission not to make an appointment from the certification for Program Support Specialist 3, Assistance Programs (S6138W). This matter was held over from the September 26, 2000 Board meeting for further review.
ACTION: The Merit System Board granted the request for a waiver but assessed no costs.
B-29 SECURITY GUARD (M1907A), VINELAND BOARD OF EDUCATION
The appointing authority's failure to properly dispose of the certification for Security Guard while provisional appointees are serving in the title is referred to the Merit System Board for enforcement.
ACTION: The Merit System Board directed that this matter be held over.
B-30 JANET C. DUNN
Janet C. Dunn, a Senior Food Service Handler at Vineland Developmental Center, Department of Human Services (DHS), appeals the decision of the DHS' Assistant Commissioner for Human Resources denying her request for a reasonable accommodation.
ACTION: The Merit System Board directed that this appeal be denied.
B-31 ALFRED MICCIO
Alfred Micco and the Department of Corrections, represented by John P. Nuttall, DAG, seek acknowledgement of a settlement agreement which resolves the outstanding issues related to appellant's request for enforcement of a previous settlement agreement.
ACTION: The Merit System Board acknowledged the settlement.
B-32 BARBARA ARCHIE
The appeal of Barbara Archie, a Cottage Training Technician at Woodbine Developmental Center, Department of Human Services, of her removals effective February 18 and March 10, 1999 on charges, was heard by Administrative Law Judge Joseph F. Martone (ALJ), who rendered his initial decision on July 28, 2000. At its meeting on September 12, 2000, the Board adopted the ALJ's recommendation upholding the removals. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-33 WILLIAM BATE
The appeal of William Bate, a Probation Officer with the Judiciary, Essex Vicinage, of his 20-day suspension beginning July 14, 1997, and his removal effective May 5, 1998 on charges, was heard by Administrative Law Judge Maria Mancini LaFiandra, who rendered her initial decision on August 1, 2000, upholding the 20-day suspension and the removal. At its meeting on September 12, 2000, the Board adopted the recommendation to uphold the 20-day suspension, but modified the removal to a resignation in good standing. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-34 CORY EMELE
The appeal of Cory Emele, a Senior Correction Officer with Mountainview Youth Correctional Facility, Department of Corrections, of his removal effective December 10, 1998 on charges, was heard by Administrative Law Judge Steven C. Reback (ALJ), who rendered his initial decision on July 11, 2000. At its meeting on September 12, 2000, the Merit System Board did not adopt the ALJ's recommendation to uphold the removal. Rather, the Board ordered that the matter be remanded to the Office of Administrative Law. The proposed decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-35 JUAN DIEGO FEEHAN
The appeal of Juan Diego Feehan, an Income Maintenance Technician, Bilingual in Spanish and English, with the Middlesex County Board of Social Services, of his 25-day suspension beginning October 7, 1999 on charges, was heard by Administrative Law Judge Anthony T. Bruno (ALJ), who rendered his initial decision on August 2, 2000. At its meeting on September 12, 2000, the Merit System Board adopted the recommendation of the ALJ to uphold the suspension The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-36 ABDUL-GHAFUR FAIZ
The appeal of Abdul-Ghafur Faiz, a Senior Correction Officer with New Jersey State Prison, Department of Corrections, concerning his 30-day suspension beginning September 26, 1998 on charges, was heard by Administrative Law Judge Kathryn A. Clark (ALJ), who rendered her initial decision on August 3, 2000. At its meeting on September 12, 2000, the Merit System Board (Board) did not adopt the ALJ's recommendation to modify the penalty to a 10-day suspension. Rather, the Board ordered that the matter be remanded to the Office of Administrative Law. The proposed decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-37 JUAN GONZALEZ
The appeal of Juan Gonzalez, a Police Officer with the City of Newark, of his release at the end of his working test period, effective July 23, 1999, was before Administrative Law Judge Edith Klinger (ALJ), who rendered her initial decision on July 18, 2000, reversing the release at the end of the working test period. At its meeting on September 12, 2000, the Board ordered that the matter be remanded to the Office of Administrative Law. The proposed decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-38 JOANNE JOBECK
The appeal of Joanne Jobeck, a Principal Data Control Clerk with Union County, of her resignation not in good standing effective March 2, 1998, was heard by Administrative Law Judge Diana C. Sukovich (ALJ), who rendered her initial decision on June 26, 2000. At its meeting on September 12, 2000, the Merit System Board adopted the ALJ's recommendation to uphold the resignation not in good standing. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-39 GEORGE JOHNSON
The appeal of George Johnson, a Police Officer with the Deptford Township Police Department, of his bypass on the Police Sergeant (PM4746P), Deptford Township eligible list, was heard by Administrative Law Judge Joseph Lavery (ALJ), who rendered his initial decision on May 4, 2000. At its meeting on September 12, 2000, the Board adopted the ALJ's recommendation to dismiss the appeal. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-40 MARK ODOM
The appeal of Mark Odom, a Police Officer with the City of Newark, of his 10-day suspension on charges, was heard before Administrative Law Judge Maria Mancini LaFiandra (ALJ), who rendered her initial decision on August 7, 2000. In that decision, the ALJ noted that the appellant withdrew his appeal of the 10-day suspension and awarded him back pay from January 23, 1997 to September 22, 1997, the period of his indefinite suspension, and also awarded counsel fees. At its meeting on September 12, 2000, the Board adopted the ALJ's recommendation that the appellant be awarded back pay but did not adopt the recommendation that the appellant be awarded counsel fees. The Board also acknowledged the withdrawal of the appellant's appeal of his 10-day suspension. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-41 ROBERT J. SCHNUR
The appeal of Robert J. Schnur, a Senior Correction Officer at South Woods State Prison, Department of Corrections, of his removal effective April 28, 1999 on charges, was heard by Administrative Law Judge Steven C. Reback (ALJ), who rendered his initial decision on July 20, 2000, upholding the removal. At its meeting on September 12, 2000, the Merit System Board (Board) adopted the ALJ's recommendation. However, the Board found it necessary to clarify a portion of the ALJ's decision. The proposed final decision is now submitted for the Board's review.
ACTION: The Merit System Board directed that this matter be held over.
B-42 JOSEPH F. GILSENAN
Joseph F. Gilsenan appeals the determination of the Division of Selection Services which found that he was ineligible for the promotional examination for Safety Inspector (PM0100A), Brick Township.
ACTION: The Merit System Board directed that this appeal be granted.
B-43 JANICE GINSBURG
Janice Ginsburg appeals the determination of the Division of Selection Services which found that she did not meet the education and experience requirements for the promotional examination for Accounting Assistant (PS0339N), Department of Labor.
ACTION: The Merit System Board directed that this appeal be granted.
B-44 ANNA M. KNAPP AND ANDRE C. WILLIAMS
Anna M. Knapp and Andre C. Williams appeal the determination of the Division of Selection Services, which found that they did not meet the experience requirement, per the substitution clause for education, for the promotional examination for Technician, Management Information Systems (MIS) (PS9334N), Department of Labor.
ACTION: The Merit System Board directed that these appeals be granted.
B-45 CARL F. KRUG
Carl F. Krug appeals the determination of the Division of Selection Services, which found that he did not meet the education requirements for the open competitive examination for Assistant Engineer (M1200B), Burlington Township.
ACTION: The Merit System Board directed that this appeal be denied.
B-46 JOHN J. MOORE
John J. Moore appeals the determination of the Division of Selection Services, which found that he did not meet the experience requirements for the promotional examination for Administrative Analyst 2 (Fiscal Management), (PS8030K), Department of Human Services.
ACTION: The Merit System Board directed that this appeal be denied.
B-47 MICHAEL A. NOVEMBRE
The Department of the Treasury appeals the determination of the Division of Selection Services which found that Michael A. Novembre was ineligible for the promotional examination for Supervisor of Operations, Treasury (PS9369U), Department of the Treasury.
ACTION: The Merit System Board directed that this appeal be granted.
B-48 MONICA M. REDONDO
Monica M. Redondo appeals the determination of the Division of Selection Services which found that she did not meet the experience requirements for the open competitive examination for Family Service Specialist 3 (Bilingual in Spanish and English) (S0109O).
ACTION: The Merit System Board directed that this appeal be denied.
