A regular meeting of the Merit System Board was held on
Wednesday, January 17, 2001, in Trenton, New Jersey.

PRESENT: Chairwoman Janice Mitchell Mintz, Merit System Board
Members, Alan Dexter Bowman, Margaret E.L. Howard, Judith L.
Shaw, and Leo Vartan; Elizabeth Laufer, Deputy Attorney General;
and Henry Maurer, Director, Division of Merit System Practices
and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Janice Mitchell
Mintz opened the meeting with the following statement:

Notice of this meeting was filed with the Secretary of State
and sent to the Trentonian, Trenton Times, Courier-Post and Star
Ledger on November 30, 2000, and posted at the Department of
Personnel, 3 Station Plaza, Trenton, New Jersey.

It is noted that the agenda items were decided out of order.

Section A - Hearing Matters, items *A-10, *A-13 and *A-14
were heard after A-15. A motion was made and seconded that the
open session be recessed after A-15, and that, pursuant to
Section 12(b) of the Open Public Meetings Act, the Merit System
Board entered into Executive Session for the purpose of legal
advice on the matters of A-10 Joseph Hornick, A-13 Karen
Brevogel, and A-14 Harry J. Murray. The Board subsequently
reconvened the public meeting, at which time the Board decided
the matters of A-10 and A-13.

Once again, a motion was made and seconded that the open
session be recessed and the Board entered into another Executive
Session to further discuss A-14 Harry J. Murray. The Board
subsequently reconvened the public meeting.

Additionally, Section B - Miscellaneous Matters, items B-55
through B-112 were heard first. After item B-112, Commissioner
Mintz, indicated that she would not be able to attend the entire
meeting and designated Margaret Howard Acting Chairperson to
preside over the remainder of the meeting, items B-1 through B-
54.

All actions were by unanimous vote unless otherwise
specified.

The Merit System Board recorded the recommended changes in the
State Classification Plan, copies of which are attached hereto
and made a part hereof.

SUBJECT: Change in the Classification Plan - Addition of Workweeks

GENERAL

The Department of Transportation has requested the creation of
two additional workweeks for their information technology staff.
The Department's network operations and help desk staff were
previously converted to 40-hour workweeks to provide coverage
corresponding to that of their user population. Existing titles
are currently assigned a 35-hour workweek. The Department
requests these additional workweeks to accommodate their need to
bring the Technical Support Specialist staff in line with other
information technology staff of the department.

SUBJECT: Change in the Classification Plan

LOCAL GOVERNMENT

The Middlesex County Department of Health requests the use of a
Public Health Epidemiologist title to properly classify a
position. Increased activities mandated by Chapter 2 of the
State Sanitary Code, Reportable Diseases (NJAC 8:57-1.1 to 1.12)
necessitates that the Department create a position to perform
these functions.

Initially, the Department requested a state title be made common
to classify the position. Research revealed this to be
impractical; the New Jersey Department of Health and Senior
Services plans to revise local public health practice regulations
in December, 2001. These revisions will increase the education
requirements for this function at the local government level.
Due to these anticipated differences in requirements, the use of
a common title is not appropriate.

Since no other active title exists for this function, we request
reactivation of the local government title, Epidemiologist. We
concurrently request a change in service designation from
unclassified to career, and a title verbiage change. A Medical
Doctor's license was required at the time this title was in use,
thus placing its assignment to the unclassified service in
accordance with N.J.S.A. 11A:3-5(e). This license is not a
present or anticipated requirement, negating the need for this
title to be assigned to the unclassified service.

A-3 ROBERT JOHNSON

Robert Johnson, Senior Correction Officer, Adult Diagnostic
Treatment Center, Department of Corrections, suspension for
15 days, on charges of insubordination and personal conduct.

Recommendation of the Administrative Law Judge - Modify the
15-day suspension to a 10-day suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-4 EUGENE MONTAGUE

Eugene Montague, Correction Sergeant, Corrections -
Operations, Central Transportation, Department of
Corrections, suspension for 10 days, on charges of
discrimination that affects equal employment opportunity,
sexual harassment, and other related charges.

Recommendation of the Administrative Law Judge - Modify the
10-day suspension to a five-day suspension and appellant is
ordered to attend a discrimination/harassment workshop.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

A-5 JANE RICHARDS-MERCADO

Jane Richards-Mercado, Purchasing Agent, City of Hoboken,
Administration Department, represented by Gerald D. Miller,
Esq., seeks enforcement of that part of the Merit System
Board decision rendered on October 8, 1996, granting her
back pay and benefits. Appellant also seeks counsel fees
for her attorney's representation in this matter.

Recommendations of the Administrative Law Judge - Grant back
pay and deny counsel fees.

ACTION: The Merit System Board remanded the matter to the
Office of Administrative Law.

A-6 LISA SANSBURY

Lisa Sansbury, Human Services Technician, Ancora Psychiatric
Hospital, Department of Human Services, suspension for 10
days, on charges of insubordination.

Recommendation of the Administrative Law Judge - Uphold the
10-day suspension.

ACTION: The Merit System Board modified the recommendation
of the Administrative Law Judge to a five-day
suspension.

A-7 GLEN SELLERS

Glen Sellers, Police Officer, Township of West Orange,
Police Department, suspension for 10 days, on charges of an
employee in the public services shall not engage in conduct
constituting neglect of duty.

Harry J. Murray, a Principal Research Analyst with the
Department of Transportation (DOT) was removed from his
position, effective July 16, 1999, on charges of conduct
unbecoming a public employee, violation of the DOT's Code of
Ethics, along with the State Conflict of Interest law and
failure to cooperate with an official investigation.

Recommendation of the Administrative Law Judge - Modify the
removal to a four-month suspension and $500 fine.

ACTION: The Merit System Board directed that this matter
be held over.

Edward Szubski, Correction Lieutenant, Bayside State Prison,
Department of Corrections, suspension for 30 days on various
charges including conduct unbecoming a public employee,
personal conduct, performance, neglect of duty and safety
and security precautions.

Recommendation of the Administrative Law Judge - Reverse the
30-day suspension.

ACTION: The Merit System Board affirmed the recommendation
of the Administrative Law Judge.

B-1 JUAN C. BETANCOURTH

Juan C. Betancourth, represented by Peter J. Cresci, Esq.,
appeals his rejection as a Sheriff's Officer candidate by
the County of Hudson and its request to remove his name from
the subject eligible list on the basis of psychological
unfitness to perform effectively the duties of the position.
This matter was held over from the December 19, 2000 Merit
System Board meeting.

ACTION: The Merit System Board directed that this matter
be referred for independent evaluation.

B-2 VICKIE BURNETT-WILLIAMS

Vickie Burnett-Williams appeals her rejection as a Police
Officer candidate by the City of Camden and its request to

the position.

Maurice Winfield, a Senior Correction Officer at the Garden
State Reception and Youth Correctional Facility, Department

B-22 STACEY GOODALL

Stacey Goodall, a Senior Correction Officer at Northern
State Prison, Department of Corrections (DOC), appeals the
determination of the Director, Equal Employment Division,
with the DOC, stating that the appellant failed to present
sufficient evidence to support a finding of probable cause
that she had been discriminated against based on her sex,
race, color or creed, or had been sexually harassed or
retaliated against.

ACTION: The Merit System Board directed that this appeal
be denied.

B-23 DENNIS ALBA

Dennis Alba appeals his removal from the Probation Officer
(S1620T) eligible list which was certified to the Burlington
County Vicinage, the Judiciary (Burlington County Vicinage),
due to his failure to respond to the certification notice.
Appellant also appeals the decision of Human Resource
Information Systems which upheld the removal of his name
from the Investigator Probation (S1618T) eligible list,
Camden County Vicinage, the Judiciary (Camden County
Vicinage), on the basis of a prior employment history which
related adversely to the title. Further, appellant appeals
his removal from the Probation Officer (S1620T) list which
was also certified to the Camden County Vicinage.

ACTION: The Merit System Board directed that the appeal be
denied for the Probation Officer (S1620T) list
that was certified to Burlington County Vicinage
and Camden County Vicinage. The Merit System
Board directed that the appeal be granted for the
Investigator Probation (S1618T) list which was
certified to the Camden County Vicinage.

B-24 ALFRED L. BALL, III

Alfred L. Ball, III, appeals the decision of Selection
Services which found that the appointing authority had
presented a sufficient basis to remove his name from the
eligible list for Correction Officer Recruit (S9999V),
Department of Corrections, on the basis of an unsatisfactory
driving record and criminal history.

ACTION: The Merit System Board directed that this appeal
be denied.

B-25 TERENCE BELLINGER

Terence Bellinger, a Senior Correction Officer with the
Department of Corrections, appeals the decision of Selection
Services which upheld the removal of his name from the list
for Correction Sergeant (PS7099I) based on his
unsatisfactory employment record.

ACTION: The Merit System Board directed that this appeal
be denied.

B-26 STEVEN R. BRZDEK

Steven R. Brzdek, a Senior Correction Officer with the
Department of Corrections, appeals the decision of Selection
Services which upheld the removal of his name from the list
for Correction Sergeant (PS7099I) based on his
unsatisfactory employment record.

ACTION: The Merit System Board directed that this appeal
be denied.

B-27 RAMASES P. CARTER

Ramases P. Carter, represented by William D. Sayers, Esq.,
appeals the decision of Selection Services which found that
the appointing authority had presented a sufficient basis to
remove his name from the eligible list for Correction
Officer Recruit (S9999W), Department of Corrections, on the
basis of an unsatisfactory driving record.

ACTION: The Merit System Board directed that this appeal
be denied.

B-28 JORGE L. DOMINGUEZ

Jorge L. Dominguez, a Senior Correction Officer with the
Department of Corrections, appeals the decision of Selection
Services which upheld the removal of his name from the list
for Correction Sergeant (PS7099I) based on his
unsatisfactory employment record.

ACTION: The Merit System Board directed that this appeal
be denied.

B-29 CARL L. GREEN, SR.

Carl L. Green, Sr., appeals the decision of Selection
Services which upheld the Department of Corrections' request
for the removal of the appellant's name from the Parole
Officer Recruit (S1405S) eligible list due to an
unsatisfactory criminal and driving record.

ACTION: The Merit System Board directed that this appeal
be denied.

B-30 DARREN GROSSMAN
