A regular meeting of the Merit System Board was held on Tuesday, March 27, 2001, in Trenton, New Jersey.

PRESENT: Chairwoman Janice Mitchell Mintz, Merit System Board Members, Alan Dexter Bowman, Margaret E.L. Howard, Judith L. Shaw, and Leo Vartan; Elizabeth Laufer, Deputy Attorney General; and Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

In accordance with L.1975, c.231, Chairwoman Janice Mitchell Mintz opened the meeting with the following statement:

ACTION: The Merit System Board acknowledged the settlements.

A-2 DONNELL AMAKER
Donnell Amaker appeals the request of the County of Union to remove his name from the eligible list for Correction Officer based on a claimed unsatisfactory background report.

Recommendation of the Administrative Law Judge - Uphold the removal of the appellant's name from the eligible list for County Correction Officer.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-3 SAMUEL HARGROVE
Samuel Hargrove, County Correction Officer, County of Burlington, County Jail, two suspensions: a 10-day suspension, on charges of insubordination and conduct unbecoming a public employee; and a 45-day suspension, on charges of incompetency, inefficiency and failure to perform duties, insubordination, conduct unbecoming a public employee and neglect of duty.

Recommendation of the Administrative Law Judge - Reverse the 10-day and 45-day suspensions.

Robert Leaks, Jr., Police Officer, City of Newark, Police Department, suspension for 92 days, on charges of disobedience of orders and neglect of duty.

Recommendation of the Administrative Law Judge - Reverse the 92-day suspension.

Kathleen Wilson, Sheriff's Officer, County of Camden, Sheriff's Office, suspension for 20 days, on charges of conduct unbecoming a public employee, neglect of duty and insubordination.

Recommendation of the Administrative Law Judge - Modify the 20-day suspension to a 12-day suspension.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-6 TIMOTHY IVY
Timothy Ivy, Senior Food Service Handler, Ancora Psychiatric Hospital, Department of Human Services, removal effective April 14, 2000, on charges of absence from work as scheduled without permission and without giving proper notice of intended absence.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-8 DAVID PRICE
David Price, Human Services Technician, Ancora Psychiatric Hospital, Department of Human Services, removal effective May 4, 1998, on charges of neglect of duty which could result in causing danger to persons, sleeping while on duty, and violation of a policy.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a 90-day suspension.

A-9 MARY B. SHANNON
Mary B. Shannon, Bus Driver, New Lisbon Developmental Center, Department of Human Services, removal effective September 3, 1999, on charges of endangering the welfare of clients, incompetency and inefficiency, and negligence in performing duty resulting in damage to property.

Recommendation of the Administrative Law Judge - Modify the removal to a written warning and a $150 fine.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a 15-day suspension.

A-10 LOUIS WEBSTER
Louis Webster, Human Services Assistant, Trenton Psychiatric Hospital, Department of Human Services, removal effective January 3, 2000, on the charge of physical abuse of a patient.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board directed that this matter be held over.

A-11 JOSEPHINE WATKINS
Josephine Watkins, Program Development Aide Community Service, County of Mercer, Department of Human Services, removal effective December 10, 1999 on charges of failure to perform duties, excessive absenteeism, improper call off, and other related charges.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to a resignation in good standing.

A-12 WILLIAM OLIVER

William Oliver, Safety Specialist 2 Division of Motor Vehicles, Department of Transportation, removal effective May 23, 1997, on charges of falsification and conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board affirmed the recommendation of the Administrative Law Judge.

A-13 DONALD NUGENT
Donald Nugent, Supervising Paramedic, Township of Hamilton, Department of Public Safety, suspension for 60 days and removal effective January 5, 1998, on charges of conduct unbecoming a public employee and sexual harassment.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION: The Merit System Board modified the recommendation of the Administrative Law Judge to uphold the 60-day suspension and removal.

SECTION B - MISCELLANEOUS MATTERS
B-1 GERARD GOOD
Gerard Good, represented by Thomas J. Cammarata, Esq., appeals his rejection as a County Correction Officer candidate by the County of Hudson and its request to remove his name from the eligible list for County Correction Officer on the basis of psychological unfitness to perform effectively the duties of the position. This matter was held over from the March 13, 2001 Board meeting.

ACTION: The Merit System Board directed that this appeal be denied.

B-2 WARREN M. REVAS-GUEVARA
Warren M. Revas-Guevara, represented by Fayth A. Ruffin, Esq., appeals his rejection as a Police Officer candidate by the City of Newark and its request to remove his name from the eligible list for Police Officer on the basis of psychological unfitness to perform effectively the duties of the position. This matter was held over from the February 14, and March 13, 2001 Board meetings.

Salvatore Cerrato, formerly a County Correction Sergeant with Essex County, petitions the Merit System Board (Board) for reconsideration of the final administrative decision, rendered on May 18, 1999, in which the Board denied the appeal of his bypass on the certification for County Correction Lieutenant (PC1825V).

ACTION: The Merit System Board denied the request for reconsideration.

B-27 ANTHONY CLARK
Anthony Clark, represented by William D. Manns, Jr., Esq., appeals the decision of Selection Services, which removed the appellant's name from the Police Officer (S9999V), City of Newark eligible list, due to the appellant's failure to respond to the certification notice.

B-32 JAMES L. MONROE, SR.

The Department of Corrections (DOC) appeals the attached decision of Selection Services, which found that it did not present a sufficient basis to remove James L. Monroe, Sr.'s name from the Correction Officer Recruit (S9999W) eligible list on the basis of an unsatisfactory employment history and criminal record. Additionally, James L. Monroe, Sr. appeals the decision of Selection Services, which found that the County of Burlington had presented a sufficient basis to remove his name from the Juvenile Detention Officer (S9999W) eligible list.

ACTION: The Merit System Board directed that this matter be held over.

B-33 FRANCISCO NORAT
Francisco Norat, represented by Charles M. Grossman, Esq., appeals the decision of Selection Services, which found that the appointing authority had presented a sufficient basis to remove his name from the eligible list for Police Officer (S9999V), City of Newark, on the basis of an unsatisfactory driving record and a sexual harassment complaint.

ACTION: The Merit System Board directed that this appeal be granted and the appellant's name be reflected on the June 12, 1998 certification for Police Officer (S9999V) as bypassed.

B-34 CESARE ORLANDO, JR.
Cesare Orlando, Jr., represented by William E. Reynolds, Esq., appeals the decision of Human Resource Information Services which found that the appointing authority had presented a sufficient basis to remove his name from the eligible list for Senior Cook (C0829A), County of Gloucester, on the basis of an unsatisfactory employment record.

Bharat Shah appeals the decision of Human Resources Information Services, which found that the Morris County Board of Social Services had presented a sufficient basis to remove the appellant's name from the Income Maintenance Technician (C6413T) eligible list as a result of falsification of his preemployment application.

Patricia Tambarello appeals the decision of Human Resource Information Services, which upheld the removal of her name from the Habilitation Plan Coordinator (S0378A) eligible list due to her failure to respond to the Notice of Certification.

Wayne Varga appeals the determination of Human Resource Information Services, which found that the Office of the Public Defender had presented a sufficient basis to remove the appellant's name from the Investigator, Public Defender (S6164W), Office of the Public Defender, eligible list on the basis that he lacked the required education and experience.

ACTION: The Merit System Board directed that this appeal be denied.

B-39 CLAYTON YOUNG
Clayton Young appeals the determination of Human Resource Information Services, which found that the Office of the Public Defender had presented a sufficient basis to remove the appellant's name from the Investigator, Public Defender (S6164W), Office of the Public Defender, eligible list on the basis that he lacked the required experience.

ACTION: The Merit System Board directed that this appeal be denied.

B-40 EMERGENCY MEDICAL TECHNICIAN (M9474B), OCEAN CITY
The appointing authority requests permission not to make an appointment from the certification for Emergency Medical Technician (M9474B), Ocean City.

ACTION: The Merit System Board granted the request for an appointment waiver, but assessed costs for the selection process in the amount of $2,048.

B-41 TELECOMMUNICATIONS SYSTEMS ANALYST 3 (S6170W)
The Assistant Commissioner, State and Local Operations, Department of Personnel requests reconsideration of that portion of the final decision of the Merit System Board, rendered December 5, 2000, which assessed costs of the selection process, in the amount of $8,285, to the Department of Human Services (DHS) for Telecommunications Systems Analyst 3 (S6170W).

ACTION: The Merit System Board granted the request for reconsideration and rescinded the assessment of costs of the selection process in the amount of $8,285.

B-42 JOHN ANSTISS
The City of Newark, represented by Lenora E. Marshall, Assistant Corporation Counsel, petitions the Merit System Board (Board) for a stay of its decision in In the Matter of John Anstiss (MSB, decided December 19, 2000), which restored Anstiss' name to the Construction Official (M6287O) eligible list, pending its appeal to the Appellate Division of Superior Court. Additionally, Mr. Anstiss, represented by Thomas M. McCormack, Esq., seeks enforcement of the Board's December 19, 2000 decision. Anstiss also requests back pay and counsel fees for his enforcement of the Board's decision.

ACTION: The Merit System Board granted the request for enforcement, denied the request for a stay and denied the request for back pay and counsel fees.

B-43 DAVID BOWENS
David Bowens, a County Correction Officer with the County of Mercer, represented by Robert B. Rottkamp, Jr., Esq., appeals his resignation in good standing effective May 28, 1999.

B-44 JOSEPH SHINN
Joseph Shinn, a former Truck Driver, Single Axle at Ancora Psychiatric Hospital, Department of Human Services, appeals his resignation in goods standing.

ACTION: The Merit System Board directed that this appeal be denied.

B-45 LEON LEVINE
Leon Levine, an Unemployment Insurance Technician 2 with the Department of Labor, represented by Jon Wineland, Staff Representative, Local 1034, Communications Workers of America, was granted a hearing by the Merit System Board (Board concerning his grievance of a Significantly Below Standard Performance Assessment Review (PAR) rating for the period of October 1, 1997 through September 30, 1998. The matter of Mr. Levine's grievance was heard by Administrative Law Judge Steven C. Reback (ALJ), who rendered his Initial Decision on December 19, 2000, acknowledging the settlement of the parties.

ACTION: The Merit System Board directed that this matter be remanded to the Office of Administrative Law.

B-46 MARY ANN DOMENICO
Mary Ann Domenico, a Teacher 1 at Vineland Developmental Center, Department of Human Services (DHS), appeals the DHS' granting of her request for reasonable accommodation.

ACTION: The Merit System Board directed that this appeal be denied.

B-47 BONNIE SUE KROHN (ORDER OF CONSOLIDATION AND PREDOMINANT INTEREST)
Administrative Law Judge Anthony T. Bruno (ALJ) issued an order which consolidated the matter and found that neither the Public Employment Relations Commission (PERC) nor the Merit System Board (Board) had the predominant interest, and that the matter should be presented first to the Board after the appellant's hearing. Based on this determination, the Board and PERC developed a joint order adopting the ALJ's order regarding the consolidation and finding of predominant interest, but modifying the order to allow the matter to be presented first to PERC after the appellant's hearing. This joint order is now submitted to the Board for consideration and approval.

ACTION: The Merit System Board adopted the joint order of consolidation and predominant interest.

B-48 EDWARD O'LONE
The Department of Human Services' request for a determination regarding the amount of back pay due to Edward O'Lone, based on the Board's April 29, 1997 decision granting back pay, was heard by Administrative Law Judge Bruce R. Campbell (ALJ), who rendered his initial decision on January 2, 2001, denying back pay. At its meeting on February 14, 2001, the Board modified the ALJ's recommendation to deny back pay and instead, denied back pay through April 29, 1997, but granted back pay from April 30, 1997 through October 19, 1997. Additionally, the Board granted O'Lone reimbursement of any health insurance premiums paid to continue such coverage from December 8, 1994 through October 19, 1997. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.

B-49 BENJAMIN WHITLEY
The appeal of Benjamin Whitley, a Police Sergeant with the Jersey City Police Department, of his 58-day suspension beginning December 4, 1997 and removal, effective January 30m, 1998, on charges, was heard by Administrative Law Judge Ken R. Springer (ALJ), who rendered his initial decision on January 4, 2001. At its meeting on February 14, 2001, the Merit System Board (Board), adopted the ALJ's recommendation to uphold the removal. The proposed final decision is now submitted for the Board's review.

ACTION: The Merit System Board adopted the final decision.
