     A regular meeting of the Civil Service Commission was held on Wednesday, March 7, 2012, in Trenton, New Jersey.

 

            PRESENT: Robert M. Czech, Chairperson, Members Robert E. Brenner, Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

     Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 28, 2011, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

A-2      MICHELE M. COLES

    

Michele M. Coles, Clerk Typist, Borough of Fair Lawn, Department of Tax Assessor, appeals the good faith of her layoff effective September 1, 2010, for reasons of economy and efficiency.

 

Recommendation of the Administrative Law Judge - Uphold the layoff.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-3      JAMES GILLESPIE

 

James Gillespie, Road Repairer, Cape May County, Roads Department, 120  day suspension on charges of conduct unbecoming a public employee and failure to follow the County Drug and Alcohol policy.

 

Recommendation of the Administrative Law Judge - Modify the 120 day suspension to a one day suspension.

 

ACTION:       The Civil Service Commission remanded this matter to the Office of Administrative Law.

 

A-4      STEPHANIE MYRICKS, ET AL.

 

Stephanie Myricks, a Senior Account Clerk, Waddell Jefferson, a Code Enforcement Officer and Adrienne Anderson, a Recreation Leader, Willingboro Township, appeal the good faith of their layoffs effective August 9, 2010, for reasons of economy and efficiency.

 

Recommendation of the Administrative Law Judge - Uphold the layoffs.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5      ALNEESA R. RUDOLPH

 

Alneesa R. Rudolph, County Correction Officer, Burlington County, County Jail, six working day suspension on charges of other sufficient cause and violation of County time and attendance policy.

 

Recommendation of the Administrative Law Judge - Uphold the six working day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6      JOSEPH ALLEN

    

Joseph Allen, Cottage Training Technician, North Jersey Developmental Center, Department of Human Services, removal effective February 10, 2011, on charges of neglect of duty, physical or mental abuse of a patient, client, resident or employee, inappropriate physical contact or mistreatment of a client, patient, resident or employee, falsification, conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Modify the removal to a 120 day suspension.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

A-7      RICHARD LASCO

 

Richard Lasco, Police Officer, City of Atlantic City, Department of Public Safety, removal effective September 30, 2011, on charges of violation of Department rules and regulations regarding standard of conduct and truthfulness and conduct unbecoming a public employee.

 

Recommendation of the Administrative Law Judge - Reverse the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-8      TANYA ONLY

    

Tanya Only, Human Services Assistant, Ancora Psychiatric Hospital, Department of Human Services, removal, effective October 27, 2010, on charges of conduct unbecoming a public employee, other sufficient cause and violation of a rule, regulation, policy, procedure, order or administrative decision.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-9      BERNARD SMALL

 

Bernard Small, Senior Building Maintenance Worker, New Jersey City University, Department of Higher Education, removal effective March 16, 2011, on charges of conduct unbecoming a public employee, theft from the job site and sale of stolen property.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

 

SECTION B - MISCELLANEOUS MATTERS

 

B-1      The Division of State and Local Operations requests the reactivation and title name change of the title Chief, Capital Post Office to Manager, Capital Post Office and the inactivation of the title Assistant Chief, Capital Post Office. 

 

 

 

ACTION:         The Civil Service Commission directed that this request be granted.

 

B-2      CARLEEN EVANS

 

Carleen Evans, a Family Service Specialist 2 with the Department of Children and Families, appeals the denial of sick leave injury (SLI) benefits.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-3      WILLIAM KINZIE

 

William Kinzie, a Senior Correction Officer with East Jersey State Prison, Department of Corrections, represented by Daniel Geddes, Esq., appeals the denial of sick leave injury (SLI) benefits.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-4      VIRGINIA BEST

 

Virginia Best, a former Complaint Investigator with the City of East Orange, represented by Charles P. Cohen, Esq., petitions the Civil Service Commission for interim relief of her layoff, effective February 1, 2011.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-5      J. J.

 

J.J., a former Police Officer with East Orange, represented by Anthony J. Fusco, Jr., Esq., petitions the Civil Service Commission for a stay of his removal, effective December 20, 2005.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-6      HELEN C. BONGON

 

Helen C. Bongon, a Program Assistant (Administrative Services) with the New Jersey City University, petitions the Civil Service Commission for enforcement of the decision of the Assistant Director of the Division of State and Local Operations, which found that her position was properly classified as a Professional Services Specialist 3, Facilities.

 

ACTION:       The Civil Service Commission ordered the appointing authority to pay the petitioner $16,548.50 in differential back pay but denied the rest of the petitioner's request for enforcement.

 

B-7      ANITA MCCLAIN

 

Anita McClain, a former Police Aide with the City of Newark, Police Department, represented by Clayton Giles, Esq., petitions the Civil Service Commission for enforcement of a settlement agreement acknowledged by the Commission at its meeting on April 6, 2011.

 

ACTION:       The Civil Service Commission referred this matter to the Office of Administrative Law for a hearing.

 

B-8      EDWARD G. BORGER, ET AL.

 

Edward G. Borger, Lillian Carpenter, John Melillo, Jr., George Ramos, Scott Sayre, and Joseph Senica, represented by Gary D. Tomasella, Esq., petition the Civil Service Commission for revival of the Police Lieutenant (PM2622G), Newark, eligible list, in order to effectuate the terms of the settlement agreement between them and Newark.

 

ACTION:       The Civil Service Commission directed that this request be granted.

B-9      MICHAEL RIVERA AND MADELINE VALENCIA

 

Atlantic City, represented by Patrick J. Wolfe, Jr., Esq., petitions the Civil Service Commission for revival of the Police Sergeant (Bilingual in Spanish and English) (PM2625J), Atlantic City eligible list, in order to effectuate the terms of a proposed settlement agreement between it and Michael Rivera and Madeline Valencia.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-10    JOSEPH SALANITRO

 

Joseph Salanitro requests that the eligible list for Correction Sergeant (PS5613I), Department of Corrections, be revived so that his name may be certified to the appointing authority.  He also requests that he be provided with a retest for Correction Sergeant (PS5613I and PS1818I).

 

ACTION:       The Civil Service Commission directed that this request be granted in part.

 

B-11    DEBRA JONES-FREEMAN

 

Debra Jones-Freeman appeals the removal of her name from the Program Support Specialist 1, Assistance Programs (PS5192K), Department of Human Services, employment list due to her failure to respond to a Certification Notice.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-12    NIRMALA KALITA

 

Nirmala Kalita appeals the decision of the Division of State and Local Operations which upheld the removal of the appellant's name from the Unemployment Insurance Clerk, Re-employment Call Center, Bilingual in Spanish and English (PS9078N), Department of Labor and Workforce Development, eligible list due to her refusal to accept appointment.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-13    LAVERNE MITCHELL

 

LaVerne Mitchell appeals the decision of the Division of State and Local Operations which upheld the removal of her name from the Assistant Family Service Worker 2 (S0645J), Department of Children and Families, eligible list due to her failure to maintain an interest in appointment.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-14    CHRIS AGOMOH

 

Chris Agomoh, an Executive Assistant with the City of Newark, requests that he be permitted to return to his former title of Chief Accountant.

 

ACTION:       The Civil Service Commission directed that this request be granted and Chris Agomoh's appointment as an Executive Assistant be deleted from his record and his record be revised to reflect continuous permanent service as a Chief Accountant.

 

B-15    RUSSELL SURDI

 

Russell Surdi appeals the determination of the Division of Selection Services that his status for the Entry Level Law Enforcement Examination (S9999M) is non-veteran.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-16    JOHN JANECZEK

 

John Janeczek, a Correction Major at Garden State Youth Correctional Facility, Department of Corrections, represented by Reinaldo Moll, Executive Vice President, New Jersey Law Enforcement Commanding Officers Association, appeals the determination to place him on step eight of salary range 4-27, upon his voluntary demotion to the title of Correction Captain.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-17    SHAUN WILKING

 

Shaun Wilking, represented by Jessica S. Swenson, Esq., appeals the bypass of his name on a certification of the Fire Fighter (M2390H), Ridgewood, eligible list.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-18    PAUL DECARLO

 

The Department of Human Services requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow Paul DeCarlo to be provisionally appointed, pending promotional examination procedures, to the competitive title of Auditor Accountant Trainee.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-19    JAMES MASICK

 

The Department of Environmental Protection requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow James Masick to be provisionally appointed, pending promotional examination procedures, to the competitive title of Supply Support Technician 3.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-20    NUBIA BRAVO

 

Nubia Bravo requests a make-up examination for the Entry Level Law Enforcement Examination (S9999M).

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-21    PREETHA KORAMBETH

 

Preetha Korambeth appeals the determination of the Division of Selection Services denying her request for a make-up examination for Data Processing Analyst 2 (S0138M), Statewide.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-22    SHELLY MANNERS

 

Shelly Manners requests a make-up examination for the promotional examination for Legal Secretary 1 (PS4825P), Department of Law and Public Safety.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-23    ARLENE PEREZ-CRUZ

 

The Motor Vehicle Commission requests that Arlene Perez-Cruz's out-of-title experience be accepted to qualify her for a prospective promotional examination for the title of Training Technician.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-24    LISA PICON

 

Christine T.J. Tucker, Business Administrator and Appointing Authority of the City of Camden, on behalf of Lisa Picon, appeals the decision of the Division of State and Local Operations which found that her position with Camden City is properly classified as Clerk 4.  The appellant seeks a Personnel Officer classification.

 

ACTION:       The Civil Service Commission directed that this appeal be granted in part and the classification of this position be designated Senior Personnel Assistant.

 

B-25    NILZA CAMPOVERDE, ET AL.

 

The Middlesex County Sheriff's Office, on behalf of Nilza Campoverde, Tiffany Green, Pedro Rosario, and Bernadette Yates, requests that they be permitted to participate in the intergovernmental transfer program and to complete the remainder of their working test periods as Sheriff's Officers with the Sheriff's Office.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-26    DERRICK CZUPAK AND ROBERTO DELGADO

 

The Township of Millburn, on behalf of Derrick Czupak and Roberto Delgado, requests that they be permitted to participate in the intergovernmental transfer program and to complete the remainder of their working test periods as Police Officers with Millburn.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-27    ADVOCATE VICTIM WITNESS PROGRAM (C0173K), HUDSON COUNTY

 

The Division of State and Local Operations petitions the Civil Service Commission for enforcement of the decision rendered on September 2, 2009, wherein the Commission ordered that Hudson County properly dispose of the June 30, 2008 certification (OL081133) of the eligible list for Advocate Victim Witness Program (C0173K).

 

ACTION:       The Civil Service Commission granted an appointment waiver and assessed $2,048 in selection costs.

 

B-28    JUVENILE DETENTION OFFICER (C2166K), HUDSON COUNTY

 

The Division of State and Local Operations seeks enforcement of the Civil Service Commission decision rendered on May 4, 2011, which ordered Hudson County to return the April 13, 2010 certification of the eligible list for Juvenile Detention Officer (C2166K) for proper disposition within 20 days of the issuance of the decision.

 

ACTION:       The Civil Service Commission granted this request and assessed a fine in the amount of $10,000.

 

B-29    PLANNING AIDE (C0312K), HUDSON COUNTY

 

The Division of State and Local Operations seeks enforcement of the Civil Service Commission decision rendered on May 4, 2011, which ordered Hudson County to return the November 4, 2009 certification of the eligible list for Planning Aide (C0312K) for proper disposition within 20 days of the issuance of the decision.

 

ACTION:       The Civil Service Commission granted this request and assessed a fine in the amount of $10,000.

 

B-30    RECEPTIONIST BILINGUAL IN SPANISH AND ENGLISH (M1113L), PATERSON

 

The appointing authority's failure to dispose of the certification for Receptionist Bilingual in Spanish and English (M1113L), Paterson, while a provisional is serving in the title, has been referred to the Civil Service Commission for enforcement.

 

ACTION:       The Civil Service Commission ordered the appointing authority to remove the provisional appointee, properly dispose of the certification and pay compliance costs.

 

B-31    ALFRED SMALLS

 

Alfred Smalls, a Senior Correction Officer at the Edna Mahan Correctional Facility, Department of Corrections, petitions the Civil Service Commission for reconsideration of the final decision, rendered on October 5, 2011, which upheld his removal.

 

ACTION:       The Civil Service Commission directed that the request for reconsideration be denied.

 

B-32    RAYMOND SMITH

 

The appeal of Raymond Smith, a Senior Carpenter with Monmouth County, of his removal, effective April 23, 2010, on charges, was heard by Administrative Law Judge Ronald W. Reba (ALJ), who rendered his initial decision on January 17, 2012.  At its meeting on February 22, 2012, the Civil Service Commission (Commission) did not adopt the ALJ's recommendation to modify the appellant's removal to a six-month suspension.  Rather, the Commission upheld the removal.  The proposed final decision is now submitted for the Commission's review.

 

ACTION:       The Civil Service Commission adopted the final decision.

B-33    VINCENZO BILLERO

 

Vincenzo Billero, a Senior Correction Officer with the Adult Diagnostic and Treatment Center, Department of Corrections (DOC), appeals the determinations of the Director and the Assistant Director of the Division of Equal Employment Division, DOC, stating that the appellant failed to present sufficient evidence to support a finding that he had been subjected to a violations of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission remanded this appeal to the appointing authority.

 

B-34    KAREN CAMPBELL

 

Karen Campbell, a former Deputy Attorney General 4 with the Department of Law and Public Safety, appeals the determination of the Chief of Staff, Office of the Attorney General, which found that the appellant failed to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-35    GLENN FOSTER

 

Glenn Foster, a Senior Correction Officer with the Department of Corrections, appeals the determination of the Assistant Director, Equal Employment Division, which found that the appellant did not present sufficient evidence to support a finding that he had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-36    ROSE LIVINGSTON-JONES

 

Rose Livingston-Jones, a Secretarial Assistant 3 (Non-Stenographic) with the Higher Education Student Assistance Authority (HESAA), appeals the determination of the Executive Director, HESAA, which found that the appellant did not present sufficient evidence to support a finding that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-37    LAURA CINTRON

 

Laura Cintron appeals the determination of the Division of Selection Services which found that she was not eligible for the promotional examination for Personnel Assistant 3 (PS3642K), Ancora Psychiatric Hospital, Department of Human Services, because she was not serving in a title to which the examination was open.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-38    CURTIS HARKER

 

Curtis Harker appeals the decision of the Division of Selection Services which found that he did not meet the experience requirements for the promotional examination for Administrative Analyst 2 Data Processing (PC0911M), Salem County.

 

ACTION:       The Civil Service Commission directed that this appeal be denied and the Division of State and Local Operations perform a classification review of the position.

 

B-39    MICHAEL HEHIR

 

Michael Hehir appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Deputy Director of Welfare (PC0687N), Middlesex County Board of Social Services.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-40    CONNIE JEREMIAS

 

Connie Jeremias appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for Quality Assurance Specialist, Health Services (PS4786K), Department of Human Services.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-41    PATRICK KEATING

 

Patrick Keating appeals the determination of the Division of Selection Services which found that, per the substitution clause for education, he was below the minimum requirements in experience for the open competitive examination for Investigator, Public Defender (S0209N), Office of the Public Defender.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Michael Marsango appeals the determination of the Division of Selection Services that he did not meet the experience requirement for the promotional examination for Principal Account Clerk (PC0807N), Monmouth County.

CWA Local 1039, represented by Molly Richardson, Esq., on behalf of Adriane Neis, requests reconsideration of the final administrative determination In the Matter of Adriane Neis (CSC, decided November 22, 2011) which found that Neis' position with the Department of Children and Families is correctly classified as Communications Systems Technician 2, effective August 13, 2011.  It also requests a waiver of repayment of a salary overpayment pursuant to N.J.S.A. 11A:3-7.

 

ACTION:       The Civil Service Commission directed that these requests be denied.

Lillian Guia, a Forensic Scientist 2 with the Division of State Police, Department of Law and Public Safety, appeals the denial of sick leave injury (SLI) benefits.

Marianne Cesare appeals the decision of the Division of State and Local Operations, which removed the appellant's name from the Deputy Municipal Court Administrator (M0381L), Long Branch, employment list due to the appellant's failure to respond to the Certification Notice.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-52    DAVID HUDAK

 

The Borough of North Arlington, on behalf of David Hudak, requests that he be permitted to participate in the intergovernmental transfer program and to complete the remainder of his working test period as a Police Officer with North Arlington.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-53    ELIZABETH HULSE

 

The Office of the Public Defender requests that Elizabeth Hulse's out-of-title experience be accepted to qualify her for a prospective promotional examination for the title of Dispute Resolution Specialist 1.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-54    PAUL MESSINA

 

Paul Messina, a Police Lieutenant with the City of Trenton, represented by Anthony J. Fusco, Jr., appeals the decision by the City of Trenton to not appoint him from the special reemployment list for Police Captain.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-55    MICHELLE TAYLOR

 

The appeal of Michelle Taylor, a Human Services Technician with the New Jersey Veterans' Memorial Home, Vineland, Department of Military and Veterans' Affairs, of her removal effective March 7, 2011, on charges, was heard by Administrative Law Judge W. Todd Miller (ALJ), who rendered his initial decision on January 4, 2012.  At its meeting on February 22, 2012, the Civil Service Commission (Commission) adopted the ALJ's recommendation to reverse the removal.  However, the Commission found it necessary to address the exceptions and cross exceptions filed by the parties.  The proposed decision is now submitted for the Commission's review.

 

ACTION:       The Civil Service Commission adopted the decision.

 

B-56    VERNON ARRINGTON

 

Vernon Arrington appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Equipment Operator (PS2603J), Rowan University.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

 

There being no further business before the Civil Service Commission, the meeting was adjourned to convene on Wednesday, March 21, 2012, at 10:00 a.m., at 3 Station Plaza, Trenton, New Jersey.
