A regular meeting of the Merit System Board was held on Tuesday, August 21,
2003, in Trenton, New Jersey.
PRESENT: Chairwoman Ida L. Castro, Merit System Board Members, Josephine
DiRienzo, and Robert J. Long; Barbara Bereski, Deputy Attorney General; and
Henry Maurer, Director, Division of Merit System Practices and Labor Relations.
In accordance with L.1975, c.231, Chairwoman Ida L. Castro opened the meeting
with the following statement:
Notice of this meeting was filed with the Secretary of State and sent to the
Trentonian, Trenton Times, Courier-Post and Star Ledger on August 7, 2003,
and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey.
All actions were by unanimous vote unless otherwise specified.
STATE
The Merit System Board recorded the recommended changes in the State Classification
Plan, copies of which are attached hereto and made a part hereof.

STATE PAROLE BOARD
The State Parole Board requests the addition of a Trainee title for the Parole
Counselor series.
The current series consists of an entry, senior and principal level. The State
Parole Board has difficulty recruiting staff with the type of experience needed
to qualify for this function. Addition of a Trainee level will enable the State
Parole Board to recruit college graduates and provide them with the training
necessary to prepare parole cases.
The appropriate negotiations representatives have been notified, and are in
agreement with this request.

DEPARTMENT OF ENVIRONMENTAL PROTECTION
The Department of Environmental Protection requests an upward salary re-evaluation
for the Administrator of Marine Fisheries.
The Administrator is responsible for supervision of marine fisheries programs
and staff in the Division of Fish and Wildlife. The Administrator supervises
two (2) Manager 4 positions, recently created at a range M32, which has resulted
in salary compression. The Department requests a concurrent change in the education
requirement to broaden the candidate pool and, an increase in the amount of
experience.

BANKING AND INSURANCE
The Department of Banking and Insurance requests a three-range upward salary
re-evaluation for one of their department-specific titles. The Department cites
a significant increase in the duties and responsibilities in support of this
request. The Department plans to return to the Board in the near future to
petition for an upward salary re-evaluation for the lower levels in this series.

ACTION: The Merit System Board modified the recommendation of the Administrative
Law Judge to withdrawal of the appeal.

good faith of her layoff effective September 5, 2000, for reasons of economy

rules regarding absence without leave, reporting sick or injured, accessibility

residence restriction, unauthorized absence and illegal use of drugs.
Recommendation of the Administrative Law Judge - Impose a six-month
suspension and uphold the removal.
ACTION: The Merit System Board modified the recommendation of the Administrative
Law Judge to uphold the removal.

Joseph Treiber, Maintenance Worker 1, Department of Transportation, removal
effective June 14, 2002 on the charge of assault and battery.
Recommendation of the Administrative Law Judge - Modify the removal
to a six-month suspension.
ACTION: The Merit System Board modified the recommendation of the Administrative
Law Judge to uphold the removal.

The Department of Corrections (DOC) appeals the decision of Human Resource
Information Services (HRIS) which found that that the DOC had not presented
a sufficient basis to remove the name of George Loomis, Jr., from the Correction
Officer Recruit (S9999D), Department of Corrections, eligible list due to an
unsatisfactory criminal record.
ACTION: The Merit System Board directed that this appeal be granted and George
Loomis, Jr.’s name be removed from the Correction Officer Recruit (S9999D),
Department of Corrections eligible list.
B-29 GEORGE LOOMIS, JR.
George Loomis, Jr., appeals the decision of Human Resource Information Services,
which found that the appointing authority had presented a sufficient basis
to remove his name from the eligible list for County Correction Officer (S9999D),
Cumberland County, due to an unsatisfactory driving record.
ACTION: The Merit System Board directed that this appeal be denied.

Dirk A. Plummer appeals the removal of his name from the eligible list for
Program Development Specialist 1 (S0600B), Department of Health and Senior
Services by the appointing authority, on the basis that he lacked the required
experience.
ACTION: The Merit System Board directed that this appeal be denied.

David M. Raffo appeals the determination of Human Resource Information Services,
which found that the appointing authority had presented a sufficient basis
to remove his name from the eligible list for Occupational Safety Consultant

Irma Sanchez appeals the request by the New Jersey Department of Corrections
to remove her name from the Correction Officer Recruit (S9999D) eligible list.

Heather Griffith, a Social Work Supervisor 2, Secured Facilities, at Bayside
State Prison, Department of Corrections (DOC), appeals the determination of
the Director of Equal Employment Division (EED) with the DOC, on the basis
that the determination did not address the issue of third party sexual harassment
as a violation of the New Jersey State Policy Prohibiting Discrimination, Harassment
or Hostile Environments in the Workplace.
ACTION: The Merit System Board directed that this matter be held over.
B-34 SYBIL FINNEY
Sybil Finney, a Judiciary Clerk 2 with the Judiciary, Vicinage 8, Middlesex
County, appeals the decision of the ADA Coordinator denying her request for
a reasonable accommodation.
ACTION: The Merit System Board directed that this matter be held over.
B-35 ELLEN BUTLER
Ellen Butler, a former Senior Correction Officer at Northern State Prison,
Department of Corrections (DOC), represented by Darryl M. Saunders, Esq.,
requests a hearing on the appeal of her removal, effective June 4, 2001,
on disciplinary charges.
ACTION: The Merit System Board directed that this appeal be denied.
B-36 JAY ROSEN
Jay Rosen, a former Senior Food Service Handler at the Edna Mahan Correctional
Facility for Women, Department of Corrections, requests that the Merit System
Board reinstate the appeal of his release at the end of the working test period,
effective February 6, 2002, and his two removals, effective February 26, 2002,
which were dismissed on the basis of the appellant’s failure to appear
at his July 17, 2002 conference hearing.
ACTION: The Merit System Board directed that this appeal be denied.
B-37 JOHN KOWALUK
John Kowaluk petitions the Merit System Board (Board for enforcement of its
decision rendered February 26, 2003, wherein the Board granted Kowaluk a retroactive
date of appointment to the position of Sanitary Inspector, effective November
1, 1996, and determined that pursuant to N.J.S.A. 26:3-25.1, he was entitled
to the maximum salary within his range, as of November 1, 2000. Additionally,
the Township of Middletown, represented by Bernard M. Reilly, Esq., petitions
the Board for a stay of that decision pending Middletown’s appeal to
the Superior Court, Appellate Division.
ACTION: The Merit System Board denied the request for a stay but granted the
request for enforcement.
B-38 TRACEY ANDINO
Tracey Andino, a County Correction Sergeant with the Hudson County Department
of Corrections, represented by Jon A. Craner, Esq., seeks enforcement of the
Merit System Board decision, rendered on December 18, 2002, which awarded her
back pay, benefits and counsel fees.
ACTION: The Merit System Board granted the appellant $70,059.60 in gross back
pay and $21,802.78 in counsel fees.
B-39 MONICA MALONE
Monica Malone, a Staff Clinical Psychologist 3, Woodbine Developmental Center,
Department of Human Services, represented by Steven Wallach, Esq., seeks enforcement
of that part of the Merit System Board decision rendered on January 15, 2003,
which awarded her counsel fees.
ACTION: The Merit System Board granted the appellant $45,607.50 in counsel
fees.
B-40 EDWARD AYMAR
Edward Aymar, represented by Sanford R. Oxfeld, Esq., petitions the Merit
System Board for reconsideration of its decision rendered on February 26, 2003,
upholding the removal of his name from the eligible list for Maintenance Repairer
(C6259C), Hudson County, and forever disqualifying the petitioner from public
employment, pursuant to N.J.S.A. 2C:51-2(d).
ACTION: The Merit System Board denied the request.
B-41 GLENN DOUGLASS
The Department of Corrections petitions the Merit System Board for reconsideration
of the final administrative decision, rendered on March 13, 2003, in which
the Board granted Glenn Douglass’ appeal for SLI benefits.
ACTION: The Merit System Board denied the request.
B-42 EDWARD ROGERS
Edward Rogers requests reconsideration of the final administrative decision,
rendered on February 26, 2003, upholding the removal of his name from the special
reemployment list for Safety Specialist 2, DMV, Department of Transportation
on the basis of his failure to respond to a notice of certification.
ACTION: The Merit System Board denied the request.
B-43 JUNIOR WATTS
The County of Monmouth, represented by Robert J. Hrebek, Esq., petitions the
Merit System Board reconsideration of the final administrative decision, rendered
on April 23, 2003, which awarded Junior Watts counsel fees.
ACTION: The Merit System Board denied the request and granted $1,336.50 in
additional counsel fees.
B-44 RICHARD RIZZOLO
The Superior Court of New Jersey, Appellate Division, has remanded the matter
of the removal of Richard A. Rizzolo’s name from the eligible list for
Fire Fighter (M9059S), City of Newark, to the Merit System Board for reevaluation.
ACTION: The Merit System Board reversed its prior decision and granted the
appellant’s appeal.
B-45 DAVID POEDUBICKY
David Poedubicky, Appeals Examiner 1, Division of Unemployment Insurance,
Department of Labor, represented by Virginia Wolf, CWA Local 1034, appeals
minor discipline of a five day suspension.
ACTION: The Merit System Board appeal be granted.
B-46 LISA ASARE
Lisa Asare appeals the determination of the Division of Selection Services,
which found that she did not meet the experience requirement for the promotional
examination for Health Data Specialist 1 (PS327H), Department of Health and
Senior Services.
ACTION: The Merit System Board directed that this appeal be granted.
B-47 SABINE AUGUSTIN AND TAMMY GREEN
Sabine Augustin and Tammy Green appeal the determination of the Division of
Selection Services, which found that they did not meet the experience requirements
for the statewide open competitive examination for Behavior Modification Program
Technician (S0106D), Department of Human Services.
ACTION: The Merit System Board directed that these appeals be denied.

Rita Austin and Eleana Lihan appeal the determination of the Division of Selection
Services, which found that they were below the minimum requirements in experience
for the promotional examination for Administrative Analyst 2 (PS2863R), Board
of Public Utilities.
ACTION: The Merit System Board directed that these appeals be granted.
