      A regular meeting of the Civil Service Commission was held on Wednesday, July 13, 2011, in Trenton, New Jersey.

Recommendation of the Administrative Law Judge - Uphold the layoff.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

Recommendation of the Administrative Law Judge - Reverse the release at the end of the working test period and order a new working test period.

Recommendation of the Administrative Law Judge - Modify the removal to a 90-day suspension.

 

ACTION:  The Civil Service Commission directed that this matter be held over.

 

A-7     LUTHER GREGG

 

Luther Gregg, Senior Correction Officer, Adult Diagnostic and Treatment Center, Department of Corrections, removal effective May 3, 2010, on charges of conduct unbecoming a public employee, other sufficient cause and violation of the Department policy prohibiting discrimination, harassment or hostile environment in the workplace.

 

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:  The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-8     DAN JUNIOR HINES

 

Dan Junior Hines, Supervisor Sewers/Supervisor Streets, City of Hackensack, Department of Public Works, removal effective October 12, 2010, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, misuse of public property, including motor vehicles and other sufficient cause.

 

Recommendation of the Administrative Law Judge - Modify the removal to a 180-day suspension.

 

ACTION:    The Civil Service Commission modified the recommendation of the Administrative Law Judge to a six-month suspension and ordered that the appellant be demoted to a non-supervisory position.

 

A-9     LEN MCKIVER

 

Len McKiver, Custodial Worker, City of Jersey City School District, removal effective March 11, 2011, on charges of chronic and excessive absenteeism.

 

Recommendation of the Administrative Law Judge - Dismiss the appeal for lack of prosecution and failure to appear.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

James Shevchenko, Jr., Animal Control Officer, City of Perth Amboy, Police Department, removal effective September 17, 2010, on charges of resignation not in good standing, excessive absenteeism and inability to perform duties.

Tina Sugar, Municipal Court Administrator, Township of Andover, Judicial Department, 1) 10-working day suspension on charges of incompetency, inefficiency, failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause, 2) removal effective July 12, 2010, on charges of incompetency, inefficiency, failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause; and 3) removal effective July 12, 2010, on charges of insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge - 1) Reverse the 10- working day suspension, 2) Modify the removal to a six-month suspension and 3) uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-12   KAREEM WATSON

 

Kareem Watson, Senior Building Maintenance Worker, Atlantic City Housing Authority, removal and a resignation not in good standing effective April 1, 2010, on charges of chronic or excessive absenteeism and being absent from duty for five or more consecutive business days without approval.

 

Recommendation of the Administrative Law Judge - Uphold the removal and the resignation not in good standing.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-13   MICHAEL T. WILKINS

 

Michael T. Wilkins, Fire Fighter, Township of Teaneck, Fire Department, removal effective April 30, 2007, on charges of conduct unbecoming a public employee, other sufficient cause and violation of a rule, regulation.

                                                                                                           

Recommendation of the Administrative Law Judge - Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-14   TAM DANG (SETTLEMENT)

 

Tam Dang, Senior Maintenance Repairer, Summit Housing Authority, removal effective March 3, 2010 on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty, misuse of public property, including motor vehicles, inappropriate and harassing act, and other sufficient cause.  Settled to a resignation in good standing effective March 3, 2010 and a lump sum payment of $48,000 for damages and attorneys' fees.  This matter was held over from the June 1, 2011 Civil Service Commission meeting.

 

Recommendation of the Administrative Law Judge - Acknowledge the settlement.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-15   MONMOUTH COUNTY LAYOFFS

 

The appeals of various employees of Monmouth County, of the good faith of their layoffs, as well as unfair labor practice claims, filed by the PBA Locals 314 and 240 regarding the layoff

 

Recommendation of the Administrative Law Judge - Dismiss the unfair labor practice charges and uphold the layoff.

 

ACTION:    The Civil Service Commission remanded this matter to the Office of Administrative Law.

A-16   JOSE SANTANA

 

Jose Santana, Painter, Stockton State College, 10-day suspension on charges of conduct unbecoming a public employee and insubordination.

 

Recommendation of the Administrative Law Judge - Reverse the 10-day suspension.

 

 

ACTION:  The Civil Service Commission rejected the recommendation of the Administrative Law Judge and upheld the 10-day suspension.

 

Agenda Item A-16 was held to be considered at the conclusion of the regular agenda.  At that time, a motion was made and seconded that the open session be recessed and that, pursuant to Section 12(b) of the Open Public Meetings Act, the Civil Service Commission entered into Executive Session for the purpose of legal advice.  The Commission subsequently reconvened the public meeting.

 

SECTION B - MISCELLANEOUS MATTERS

 

B-1    CHANGE IN CLASSIFICATION PLAN - OFFICE OF LEGISLATIVE SERVICES - LEAD PROCESSOR 1 AND LEAD PROCESSOR 3  

 

The Office of Legislative Services requests the establishment of new unclassified titles.  In accordance with N.J.S.A. 11A:3-4c, State Unclassified Service, employees in the Legislative Branch of State Government shall be in the unclassified service.

 

 

ACTION:    The Civil Service Commission directed that this request be granted.

 

 

 

 

 

B-2    CHANGE IN CLASSIFICATION PLAN - STATE GOVERNMENT- PLANNING ASSOCIATE TITLE SERIES - TITLE CONSOLIDATION INITIATIVE  

 

The Division of State and Local Operations requests consolidation of eight Planning Associate variant titles into one new variant title series which will be called Planning Associate - School/Education Programs effective the first pay period following the Civil Service Commission's action regarding this request.

ACTION:    The Civil Service Commission directed that this appeal be denied.

 

B-16   BARTLOMIEJ TROCHA

 

Bartlomiej Trocha, represented by Ian A. Weinberger, Esq., appeals his rejection as a County Police Officer candidate by Union County and its request to remove his name from the eligible list for County Police Officer (S9999K) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:    The Civil Service Commission directed that this appeal be referred for an independent evaluation.

 

 

 

B-17   JULIO K. TERJANIAN

 

Julio K. Terjanian appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its requests to remove his name from the eligible list for Correction Officer Recruit (S9999K) on the basis of medical unfitness to perform effectively the duties of the position.

 

ACTION:    The Civil Service Commission directed that this appeal be denied.

 

B-18   AVERIL CHRIST

 

Averil Christ, a Residential Services Specialist 3 with the Woodbridge Child Diagnostic and Treatment Center, Department of Children and Families, appeals the determination of her layoff rights by the Division of State and Local Operations.

 

ACTION:    The Civil Service Commission directed that this appeal be denied.

 

B-19   JOANN DOMENICO AND MICHELLE VAYO

 

Joann Domenico, a Keyboarding Clerk 2, and Michelle Vayo, a Keyboarding Clerk 1 with the Town of Hammonton, represented by the Government Workers Union, petition the Civil Service Commission for interim relief of their layoffs, effective April 25, 2011, pending the outcome of their good faith layoff appeals at the Office of Administrative Law.

 

ACTION:    The Civil Service Commission directed that these requests be denied.

 

B-20   MATTHEW KLOO

 

The Township of West Milford requests relief on behalf of Matthew Kloo.

 

ACTION:    The Civil Service Commission directed that this request be granted.

The Essex County Sheriff's Office, on behalf of Richard Calo, Jose Padilla, and Jimmy Rodriguez, requests that they be permitted to participate in the intergovernmental transfer program and to complete the remainder of their working test periods as Sheriff's Officers with the Sheriff's Office.

 

ACTION:    The Civil Service Commission directed that this request be granted.

 

B-22   KENNETH GAULETTE AND SERGIO HENRIQUES

 

The Township of Clark, on behalf of Kenneth Gaulette and Sergio Henriques, requests that they be permitted to participate in the intergovernmental transfer program and to complete the remainder of their working test periods as Police Officers with Clark.

 

ACTION:    The Civil Service Commission directed that this request be granted.

 

B-23   MICHAEL MEZEY

 

The City of Rahway, on behalf of Michael Mezey, requests that he be permitted to participate in the intergovernmental transfer program and to complete the remainder of his working test period as a Police Officer with Rahway.

 

ACTION:    The Civil Service Commission directed that this request be granted.

 

B-24   ZACHARY VON LANGEN

 

The Union County Sheriff's Office, on behalf of Zachary Von Langen, requests that he be permitted to participate in the intergovernmental transfer program and to complete the remainder of his working test period as a Sheriff's Officer with the Sheriff's Office.

 

ACTION:    The Civil Service Commission directed that this request be granted.

 

 

 

 

 

B-25   ROBERT CONGLETON AND RICHARD FIORILLA

 

Robert Congleton and Richard Fiorilla petition the Civil Service Commission for retroactive dates of permanent appointment of May 18, 2008 to the titles of Police Sergeant and Police Lieutenant, respectively.

 

ACTION:    The Civil Service Commission directed that this request be granted in part and Robert Congleton and Richard Fiorilla be granted retroactive dates of permanent appointment of July 1, 2010.

Delanoy, Jr., who rendered his initial decision on March 25, 2011.  At its meeting on June 15, 2011, the Civil Service Commission did not adopt the ALJ's recommendation to modify the 30 working day suspension to a 15 working day suspension.  Rather, the Commission upheld the appellant's 30 working day suspension.  The proposed final decision is now submitted for the Commission's review.

Submitted for the Commission's approval is a Notice of Adoption of a proposed amendment to N.J.A.C. 4A:3-4.9, Advancement pay adjustments: State service.  The amendment would obviate the need for the Civil Service Commission to approve rule relaxations in those instances where the State and a union agree to a promotional pay calculation that does not follow the rule but would not result in an amount greater than that allowed by the rule. B-95   PROPOSED AMENDMENTS: N.J.A.C. 4A:6-1.6 AND 1.7, SICK LEAVE INJURY

 

Submitted for the Commission's approval is a Notice of Proposal to amend N.J.A.C. 4A:6-1.6 and 1.7, Sick leave injury program.  The proposed amendments would codify the sunset provisions regarding the SLI program that were enacted in P.L. 2010, c.3, and effective on May 21, 2010.  It is recommended that this proposal be approved for publication in the New Jersey Register for public notice and comment.

 

ACTION:    The Civil Service Commission approved the proposal for publication.

The Department of Agriculture requests that the provisions of N.J.A.C. 4A:4-1.1(c)2 be relaxed in order to allow Amar Patil to be provisionally appointed, pending promotional examination procedures, to the title of Assistant Director, Division of Animal Health Laboratory.

 

ACTION:    The Civil Service Commission directed that this request be granted.

 

 

 

There being no further business before the Civil Service Commission, the meeting was adjourned to convene on Wednesday, July 27, 2011, at 10:00 a.m., at 3 Station Plaza, Trenton, New Jersey.
