A regular meeting of the Civil Service Commission was held on Wednesday, July 22, 2009, in Trenton, New Jersey.

      PRESENT: Hope L. Cooper, Chairperson, Members Flavella Branham, John Currie and Margaret E. L. Howard; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Merit System Practices and Labor Relations.

      In accordance with L.1975, c.231, Hope L. Cooper, Chairperson, opened the meeting with the following statement:

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES - SETTLEMENT

          ACTION:     The Civil Service Commission acknowledged the settlements.

A-2    JEANETTE CRUZ

Jeanette Cruz, Human Services Technician, Ancora Psychiatric Hospital, Department of Human Services, 90-working day suspension on charges of neglect of duty, falsification and violation of a policy.

Recommendation of the Administrative Law Judge - Reverse the 90-working day suspension.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-3    CHARLES TRIPP
         
Charles Tripp, Senior Correction Officer, South Woods State Prison, Department of Corrections, 10-working day suspension on charges of violation of rules regarding a serious mistake due to carelessness which may result in damage and/or injury to persons or property.

Recommendation of the Administrative Law Judge - Modify the 10-working day suspension to a five-day suspension.

ACTION:      The Civil Service Commission modified the recommendation of the Administrative Law Judge to uphold the 10-working day suspension.


A-4      STEVEN J. WINTERS

Steven J. Winters, Fire Officer 1, North Hudson Regional Fire and Rescue, 60-day suspension and demotion to the position of Fire Fighter effective December 5, 2005, on charges of incompetency, inefficiency or failure to perform duties, insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the 60-day suspension and demotion to the position of Fire Fighter.

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-5    TIMOTHY CASSIDY

Timothy Cassidy, Security Officer, Kean University, removal effective February 27, 2008, on charges of neglect of duty, misuse of public property including motor vehicles, other sufficient cause and violation of University rules regarding duty conduct and use of department vehicles.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-6    REGINALD BLEDSOE

Reginald Bledsoe, Senior Building Maintenance Worker, Montclair State University, removal effective July 17, 2008, on charges of conduct unbecoming a public employee and neglect of duty.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.


A-7    CHRISTOPHER BOWLES

Christopher Bowles, Police Officer, City of Newark, Police Department, removal effective May 1, 2009, on charges of mental and physical capability, inability to perform duties and other sufficient cause.

Recommendation of the Administrative Law Judge - Dismiss the appeal as moot since the appellant was approved for an accidental disability retirement.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge and denied counsel fees.

A-8    GREGORY CORKER

Gregory Corker, Senior Medical Security Officer, Ann Klein Forensic Psychiatric Hospital, Department of Human Services, removal effective September 11, 2008, on charges of conduct unbecoming a public employee, physical or mental abuse of a patient, mistreatment of a patient and other sufficient cause.    

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-9    AISHAH DUKES

Aishah Dukes, Human Services Technician, Trenton Psychiatric Hospital, Department of Human Services, removal effective February 1, 2008, on charges of physical or mental abuse of a patient, neglect of duty or willful failure to devote attention to tasks which could result in danger to persons or property, insubordination, and conduct unbecoming a public employee.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.


A-10   JOSEPH FLEMING

Joseph Fleming, Housing Inspector, City of Wildwood, Department of Public Safety and Public Affairs, removal effective June 20, 2008, on the charge of inability to perform job duties.

Recommendation of the Administrative Law Judge - Reverse the removal.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-11   FRED GARZARELLI

Fred Garzarelli, Laborer, City of Margate, Department of Public Works, removal effective August 8, 2008, on charges of failure to perform duties, neglect of duty, misuse of public property, including motor vehicles, failure to report absence, sleeping on the job, unscheduled absence, unauthorized absence from work area, violation of City rules and policies, misuse of public property, and other sufficient cause.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-12   JAMIE C. MCCARRON

Jamie C. McCarron, Police Officer, Middletown Township, Department of Public Safety, removal effective May 5, 2005, on charges of incompetency, inefficiency, failure to perform duties, insubordination, inability to perform duties, neglect of duty and violation of Township rules regarding performance of duty and obedience to laws.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.


A-13   JENNIFER OCASIO

Jennifer Ocasio, Sheriff's Officer, Hudson County, Sheriff's Department, removal effective August 13, 2007, on charges of conduct unbecoming a public employee, and failure to comply with regulations, orders, or directives, and knowingly entering false or misleading information in a Departmental report.

Recommendation of the Administrative Law Judge - Uphold the removal.

ACTION:      The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

A-14   LISA WHITAKER

Lisa Whitaker, Senior Correction Officer, New Jersey State Prison, Department of Corrections, removal on charges of conduct unbecoming a public employee, and violation of rules regarding falsification and improper or unauthorized contact with an inmate, undue familiarity with inmates, parolees, their families or friends. 

Recommendation of the Administrative Law Judge - Grant motion to dismiss the appeal as moot based on forfeiture of public employment as a condition of pre-trial intervention.

ACTION:     The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

SECTION B - MISCELLANEOUS MATTERS

B-1    JOHN DEL VICARIO

John Del Vicario, represented by Jeffrey R. Caccese, Esq., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION:      The Civil Service Commission directed that this appeal be denied.


B-2    CHRYSTAL STOKES

Chrystal Stokes appeals her rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove her name from the eligible list for Correction Officer Recruit (S9999H) on the basis of psychological unfitness to perform effectively the duties of the position.

ACTION:      The Civil Service Commission referred the matter for an independent psychological evaluation.

B-3    CHARLES BILLINGTON

Charles Billington, a former Correction Sergeant at South Woods State Prison, Department of Corrections, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-4    RACHEL DIXON

Rachel Dixon, a Human Services Assistant with Vineland Developmental Center, Department of Human Services, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-5    DEAN GERNAY

Dean Gernay, a Senior Youth Worker with the Juvenile Justice Commission, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be granted.


B-6    MARIE GUZMAN

Marie Guzman, a Senior Correction Officer at the Juvenile Justice Commission appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-7    MARK HILLIARD

Mark Hilliard, a Senior Correction Officer at Southern State Correctional Facility, Department of Corrections, represented by Daniel Geddes, Esq., appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-8    THELMA SEABROOKS

Thelma Seabrooks, a Clinical Dietitian with South Woods State Prison, Department of Corrections, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-9    DORIS TUCKER

Doris Tucker, an Education Program Assistant 1 with the Juvenile Justice Commission, represented by Donald L. Klein, Executive Vice President, CWA Local 1040, appeals the denial of sick leave injury (SLI) benefits.

ACTION:      The Civil Service Commission directed that this appeal be denied.


B-10   ANTHONY CANNON

Anthony Cannon appeals the decision of the former Division of Local Human Resource Management, which found that the appointing authority had presented a sufficient basis to remove the appellant's name from the Senior Youth Worker (PC1469G), Mercer County, eligible list on the basis of an unsatisfactory employment record.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-11   MARTIN CARLUCCIO

Martin Carluccio appeals the determination of the Division of State Human Resource Management, upholding his non-appointment from the eligible list for Safety Specialist Trainee, DMV (S6778F), Motor Vehicle Commission.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-12   MARTIN CARLUCCIO

The Division of State Human Resource Management requests that the Motor Vehicle Commission be ordered to return the November 15, 2007 certifications (OS070968, OS070969 and OS070970) of the eligible list for Safety Specialist Trainee, DMV (S0599J) for proper disposition.  As a result of the request for enforcement, Martin Carluccio appeals the Motor Vehicle Commission's request to remove his name from the eligible list for Safety Specialist Trainee, DMV (S0599J), on the basis of an unsatisfactory background.

ACTION:      The Civil Service Commission denied the request for enforcement and directed that the appellant's name be removed from the eligible list.


B-13   CLARA VINSON

Clara Vinson appeals the removal of her name from the eligible list for Correction Officer Recruit (S9999H), Department of Corrections, on the basis of an unsatisfactory criminal record.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-14   SENIOR CASHIER, TYPING (C0039K), ESSEX COUNTY

Essex County requests permission not to make an appointment from the August 19, 2008 certification for Senior Cashier, Typing (C0039K).

ACTION:     The Civil Service Commission granted the request for an appointment waiver but assessed selection costs in the amount of $2,048.

B-15   JOSEPH JACKSON

Joseph Jackson, a Supervisor of Postal Services with the Department of the Treasury (Treasury), represented by Walter R. Bliss, Jr., Esq., appeals the determination of Treasury's Equal Employment Opportunity and Affirmative Action Officer, stating that there was probable cause to substantiate a finding that he violated the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:      The Civil Service Commissions dismissed the appeal for lack of jurisdiction.

B-16   SUSAN BUTLER

Susan Butler appeals the decision of the Division of Local Human Resource Management that her position is properly classified as Senior Clerk Typist.  The appellant seeks a Senior Account Clerk, Typing classification in this proceeding.

ACTION:     The Civil Service Commission directed that this appeal be denied.


B-17   GINGER FITZGERALD

Seaside Park Borough appeals the decision of the Division of Local Human Resource Management which found that Ginger Fitzgerald's position is properly classified as Public Safety Telecommunicator.  It seeks a Senior Public Safety Telecommunicator job classification in this proceeding.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-18   JOHN MCGUIRE AND RAYMOND SZPOND

John McGuire and Raymond Szpond appeal the decisions of the Division of State Human Resource Management that the proper classification of their positions is Weights and Measures Inspector 1.  Mr. McGuire seeks a Supervisor of Enforcement, Weights and Measures classification.  Mr. Szpond seeks a Supervisor of Licensing, Weights and Measures classification.

ACTION:      The Civil Service Commission directed that these appeals be granted in part.

B-19   JOHN TEDSESCO

Steven Post, a Sheriff's Officer Sergeant, appeals the decision of the Division of Local Human Resource Management which found that John Tedesco's position is properly classified as Sheriff's Officer Sergeant.  Sergeant Post seeks a Sheriff's Officer Lieutenant job classification in  this proceeding.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-20   WILLIAM EMMELL, ET AL.

William Emmell, Michael Famularo, and Mark Jacoby, Fire Fighters with Atlantic City, represented by Jeffrey R. Caccese, Esq., request retroactive dates of permanent appointment.

ACTION:      The Civil Service Commission denied the requests.


B-21   RAHMAN IDLETT

Rahman Idlett, Communications Operator, appeals a five-day suspension issued by the Department of Corrections.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-22   BETTY LACEY

Betty Lacey, Senior Correction Officer, appeals an official written reprimand issued by the Department of Corrections.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-23   EBONY MARTIN

Ebony Martin, Senior Correction Officer, represented by Michael K. Sharp, Institutional Vice President, PBA Local 105, appeals a three-day suspension issued by the Department of Corrections.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-24   YVES AUBOURG

Hillside Township, on behalf of Yves Aubourg, represented by Richard H. Bauch, Esq., requests reconsideration of the decision rendered on January 16, 2008, which found that he did not meet the experience requirement for the open competitive examination for Director, Economic Development Program (M6045J), Hillside Township.

ACTION:      The Civil Service Commission granted the request for reconsideration.


B-25   JOANNE NEWKIRK

Morris County requests reconsideration of that portion of the decision rendered on February 11, 2009, which found that Joanne Newkirk's permanent appointment should be changed to provisional pending promotional examination procedures and that the promotional examination for Senior Systems Analyst (PC0467J), Morris County be processed by formal examination procedures.

ACTION:      The Civil Service Commission denied the request for reconsideration.

B-26   AUDRA PAGANO

Audra Pagano petitions the Civil Service Commission (Commission) for reconsideration of its decision rendered on June 10, 2009, in which the Commission determined that Ms. Pagano was ineligible for the Assistant Training Supervisor, County Welfare Agency (PC1029K), Essex County, promotional examination.

ACTION:      The Civil Service Commission denied the request for reconsideration.

B-27   MARIA PINHO

Maria Pinho requests reconsideration of the decision rendered on March 11, 2009, which upheld the validity of the Management Test Battery and denied her request to review her examination materials.

ACTION:      The Civil Service Commission denied the request for reconsideration.

B-28   KRISTIN RYDAROWSKI

Kristin Rydarowski, represented by Gaye Palmer, Staff Representative with CWA Local 1033, petitions the Civil Service Commission for reconsideration of its decision rendered on May 13, 2009 in which her request for admittance to the examination for Clerk Typist 1 Evidence Handling (PS1228P), Department of Law and Public Safety, was denied.

ACTION:      The Civil Service Commission granted the request for reconsideration.
B-29   FELECIA WRIGHT

Felecia Wright, an Education Program Development Specialist 2 with the Department of Education, requests reconsideration of the decision rendered on August 27, 2008, which did not find that she had been subjected to a violation of the New Jersey State Policy Prohibiting Discrimination in the Workplace.

ACTION:      The Civil Service Commission denied the request for reconsideration.

B-30   EUGENE COLLINS

The appeals of Eugene Collins, a Police Officer with the City of Newark, regarding his two removals, effective February 8, 2008, on charges, were heard by Administrative Law Judge JoAnn LaSala Candido (ALJ), who rendered her initial decision on May 15, 2009.  At its meeting on July 8, 2009, the Civil Service Commission (Commission), adopted the ALJ's recommendation to reverse the second removal.  However, the Commission did not adopt the ALJ's recommendation to modify the first removal to a six-month suspension.  Rather, the Commission upheld the first removal.  The proposed final decision is now submitted for the Commission review.

ACTION:      The Civil Service Commission adopted the final decision.

B-31   NATHANIEL PARKER

The appeal of Nathaniel Parker, a Correction Lieutenant, Juvenile Justice with the Juvenile Justice Commission, Department of Law and Public Safety, of his 108-day suspension on charges, was heard by Administrative Law Judge Jeff S. Masin (ALJ), who rendered his initial decision on April 28, 2009.  At its meeting on July 8, 2009, the Civil Service Commission (Commission) adopted the ALJ's recommendation to dismiss the charges and reverse the suspension.  The proposed decision is now submitted for the Commission's review.

ACTION:      The Civil Service Commission adopted the decision.

B-32   ALEXANDER ROSARIO

The appeal of Alexander Rosario, a County Correction Officer with Hudson County, of his 10-day suspension beginning February 10, 2008, on charges, was heard by Administrative Law Judge Jesse H. Strauss (ALJ), who rendered his initial decision on May 26, 2009.  At its meeting on July 8, 2009, the Civil Service Commission (Commission) did not adopt the ALJ's recommendation to reverse the suspension.  Rather, the Commission modified the penalty to a five-day suspension.  The proposed final decision is now submitted for the Commission's review.

ACTION:      The Civil Service Commission adopted the final decision.

B-33   DONALD BENDER

Donald Bender appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Training Technician Computer Technology (PC2063K), Morris County.

ACTION:     The Civil Service Commission directed that this appeal be granted.

B-34   BETH CLINK-CAHILL, ET AL.

Beth Clink-Cahill, Mark Gechtberg and Reginald Inwirika appeal the determinations of the Division of Selection Services which found that they did not meet the experience requirements for the promotional examination for Program Development Specialist 1 Mental Health Services (PS1193K), Greystone Park Psychiatric Hospital.

ACTION:      The Civil Service Commission directed that these appeals be denied.


B-35   DAWN DAPONTE

Dawn DaPonte appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for Deputy Municipal Court Administrator (PM1477K), South Plainfield.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-36   DAVID DECOONS

David DeCoons appeals the determination of the Division of Selection Services which found that, per the substitution clause for education, he was below the minimum requirements in experience for the promotional examination for Senior Systems Analyst (PC1784K), Morris County.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-37   SUSAN FARRELL

Susan Farrell appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for Assistant Municipal Clerk (PM1459K), Little Egg Harbor Township.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-38   ANTHONY FIRETTO

Anthony Firetto appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Senior Housing Assistance Technician (PM1760K), Elizabeth Housing Authority.

ACTION:      The Civil Service Commission directed that this appeal be granted.


B-39   PATRICIA FOY

Patricia Foy appeals the decision of the Division of Selection Services which found that, per the substitution clause for education, she did not meet the experience requirements for the promotional examination for the "dual" title Management Specialist/Supervising Library Assistant (PC1929K), Mercer County.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-40   JAMES FRANK

James Frank appeals the determination of the Division of Selection Services which found that he was below the minimum requirements in experience for the promotional examination for Assistant Food Service Supervisor 3 (PS1382K), Hagedorn Center for Geriatrics.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-41   LORI GARRISON

Lori Garrison appeals the determination of the Division of Selection Services which found that she did not meet the education and experience requirements for the open competitive examination for Health Data Specialist 2 (S0037L), Statewide.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-42   GARY GOVIER

Gary Govier appeals the determination of the Division of Selection Services which found that he did not meet the experience requirements for the promotional examination for Supervisor Public Works (PM0263L), Ringwood.

ACTION:      The Civil Service Commission directed that this appeal be denied.


B-43   DANIELLE GRAVES

Danielle Graves appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in experience for the promotional examination for Supervising Engineer 2, Surface Design (PS1544T), Department of Transportation.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-44   CHERYL HARRIS

Cheryl Harris appeals the determination of the Division of Selection Services which found that, per the substitution clause for education, she did not meet the experience requirements for the promotional examination for Administrative Analyst 4, Fiscal Management (PS1519P), Department of Law and Public Safety.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-45   MARIA JACOBI

Maria Jacobi appeals the determination of the Division of Selection Services which found that she did not meet the experience requirements for the promotional examination for Supervisor Records Management (PS7752T), Department of Transportation.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-46   MAUREEN MAJETTE-ARCHIE

Maureen Majette-Archie appeals the determination of the Division of Selection Services which found that she was below the minimum requirements in education for the promotional examination for Accounting Assistant (PM1623K), Orange Housing Authority.

ACTION:      The Civil Service Commission directed that this appeal be granted.

Sherry Mako appeals the determination of the Division of Selection Services, which found that she did not meet the experience requirements for the promotional examination for Assistant Buyer (PS5938P), Department of Law and Public Safety.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-48   NADER MORTAJA

Nader Mortaja requests reconsideration of that portion of the decision rendered on April 15, 2009, which found that he was below the minimum requirements in experience for the promotional examination for Project Engineer, Surface Design (PS0538T), Department of Transportation.

ACTION:      The Civil Service Commission denied the request for reconsideration.

B-49   BETH A. O'BRIEN

Beth A. O'Brien appeals the determination of the Division of Selection Services which found that, per the substitution clause for education, she did not meet the requirements for the promotional examination for Administrative Analyst 2 (PS8031K), Department of Children and Families.

ACTION:      The Civil Service Commission directed that this appeal be denied.

B-50   ERICA PINTO

Erica Pinto appeals the determination of the Division of Selection Services which found that she did not meet the minimum experience requirements for the promotional examination for Technical Assistant 1 Higher Education (PS1833J), The Richard Stockton College of New Jersey.

ACTION:      The Civil Service Commission directed that this appeal be granted.

B-64   SALARY REGULATION, SUPPLEMENT 2, FY 2009

The Salary Regulation, Supplement 2, Fiscal Year 2009, is submitted to the Commission for review.  This salary regulation, which includes Section 3 - Special Incentive Programs, pertains to salaries upon appointment, salary range adjustments, educational incentive programs and payments, and additional compensation for employees in specified titles.  It is effective through fiscal year 2009 only and has been approved by Hope L. Cooper, Chair/CEO, Civil Service Commission, and Charlene M. Holzbaur, Director, Division of Budget and Accounting.  It is recommended that the Commission record this Salary Regulation.

ACTION:      The Civil Service Commission recorded the Salary Regulation.

Justin Q. Ngo and Jeffrey V. Pham appeal their scores on the qualifying examination for Human Services Specialist 1 (Bilingual in Vietnamese and English) (C1623H), Camden County Board of Social Services.

ACTION:     The Civil Service Commission directed that these appeals be granted.
