    A regular meeting of the Civil Service Commission was held on Thursday, November 10, 2016, in Trenton, New Jersey.

 

          PRESENT: Robert M. Czech, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher S. Myers, Assistant Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2015, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

      

  

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

Joseph Fedo, a Public Works Repairer with Parsippany-Troy Hills Township, Department of Public Works, removal effective October 14, 2014, and fine in the amount of $4,840, on charges of conduct unbecoming a public employee, misuse of public property, violation of Township rules and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge and also upheld the $4,840 fine.

ACTION:    The Civil Service Commission did not affirm the recommendation of the Administrative Law Judge. Rather, the Commission acknowledged the settlement.

B-4    CHANGE IN THE CLASSIFICATION PLAN

 

              The Division of Agency Services requests the reactivation of the Senior Receptionist, Bilingual in Vietnamese/English title for use in local service.

 

ACTION:    The Civil Service Commission directed that this request be granted.

 

B-5    CHANGE IN THE CLASSIFICATION PLAN

 

The Division of Agency Services requests the reactivation of the Public Health Representative Trainee and Public Health Representative Trainee Bilingual in Spanish and English titles and inactivation of the Assistant Chief Vital Statistics and Registration title.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-6      CHANGE IN THE CLASSIFICATION PLAN

 

           The Division of Agency Services, pursuant to a request from the Department of Labor and Workforce Development, requests the establishment of the new title, Program Planning and Development Specialist, Vocational Rehabilitation Services and to designate the Program Planning and Development Specialist 1, Vocational Rehabilitation Services title as archaic.

 

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

 B-7      M.T. – CSC DOCKET NO. 2013-1724

 

           M.T. appeals her rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove her name from the eligible list for Correction Officer Recruit (S9987M) on the basis of medical unfitness to perform effectively the duties of the position.

 

ACTION:    The Civil Service Commission directed that this appeal be granted.

 

B-8    LISA CAMACHO – CSC DOCKET NO. 2016-1598

 

Lisa Camacho appeals the decision of the Division of Agency Services, which found that the appointing authority had presented a sufficient basis to remove the appellant’s name from the Police Officer (S9999R), Union City eligible list on the basis of an unsatisfactory background report.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-9    BRIAN PEREZ – CSC DOCKET NO. 2016-1441

 

Brian Perez, represented by Neal E. Brunson, Esq., appeals the determination of the Division of Agency Services upholding the removal of his name from the eligible list for Police Office (S9999R), City of Passaic on the basis of an unsatisfactory criminal record.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-10   JOHN WOLFF – CSC DOCKET NO. 2016-4474

 

John Wolff appeals the decision of the Division of Agency Services which found that his position in the Juvenile Justice Commission is properly classified as Legal Specialist. The appellant seeks a Regulatory Officer 3 job classification in this proceeding.

 

ACTION:     The Civil Service Commission directed that this appeal be granted in part.

 

B-11   WILLIAM DAVIS – CSC DOCKET NO. 2015-3199

 

William Davis appeals the bypass of name on the Administrative Analyst 1 (PS8882G), Department of Environmental Protection eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

 

B-12   ADMINISTRATIVE ANALYST (M0864T), WEST NEW YORK - CSC DOCKET NO. 2015-2731

 

West New York requests permission not to make an appointment from the November 5, 2014, certification for Administrative Analyst (M0864T), West New York.

 

ACTION:     The Civil Service Commission granted the request and assessed selection costs in the amount of $2,048.

ACTION:     The Civil Service Commission granted the request and assessed selection costs in the amount of $2,048.

          The City of East Orange request permission not to make an appointment from the November 18, 2014 certification for Community Relations Specialist (M0082M), East Orange.

 

ACTION:     The Civil Service Commission granted the request and assessed selection costs in the amount of $2,048.

 

B-17   MANAGEMENT SPECIALIST (M0823R), TRENTON - CSC DOCKET NO. 2016-1531

 

The City of Trenton requests permission not to make an appointment from the February 6, 2014 certification for Management Specialist (M0823R), Trenton.

 

ACTION:     The Civil Service Commission granted the request and assessed selection costs in the amount of $1,024.

 

B-18   MAINTENANCE WORKER 3 GROUNDS (C0432S) AND (C0052T) SALEM COUNTY – CSC DOCKET NO. 2016-1639

 

The Division of Agency Services requests that the Civil Service Commission order Salem County to return the May 19, 2015 certification of the eligible lists for Maintenance Worker 3 Grounds (C0432S) and (C0052T), Salem County for proper disposition. Salem County requests permission not to make an appointment from the May 19, 2015 certification for Maintenance Worker 3 Grounds.

 

ACTION:    The Civil Service Commission granted the request and assessed selection costs in the amount of $2,048 and compliance costs in the amount of $1,000.

 

B-19   POLICE AIDE (M0314P), RUTHERFORD - CSC DOCKET NO. 2016-1858

 

In In the Matter of Police Aide (M0314P), Borough of Rutherford (CSC, decided June 26, 2013), the Civil Service Commission (Commission) granted the request of the Borough of Rutherford for an appointment waiver for the November 26, 2012 certification and ordered that no selection costs would be assessed at that time since there was a possibility that the list could be utilized prior to its expiration. However, the appointing authority did not utilize the subject eligible list and the matter of the assessment of costs is now before the Commission.

 

ACTION:     The Civil Service Commission assessed selection costs in the amount of $2,048.

 

B-20   SECRETARIAL ASSISTANT (M0599S), EAST ORANGE CSC DOCKET NO. 2016-2207

 

The City of East Orange requests permission not to make an appointment from the January 12, 2015 certification for Secretarial Assistant (M0599S), East Orange.

 

ACTION:     The Civil Service Commission granted the request and assessed selection costs in the amount of $2,048.

 

B-21   SECRETARIAL ASSISTANT (M2225N), NEWARK CSC DOCKET NO. 2015-2661

 

The City of Newark requests permission not to make an appointment from the August 27, 2014 certification for Secretarial Assistant (M2225N), Newark.

 

ACTION:     The Civil Service Commission granted the request and assessed selection costs in the amount of $2,048.

 

B-22   SENIOR MANAGEMENT ASSISTANT (S0562P), STATEWIDE - CSC DOCKET NO. 2016-3790

 

In In the Matter of Senior Management Assistant (S0562P), Statewide (CSC, decided November 7, 2013), the Civil Service Commission (Commission) granted the request of the State Parole Board for an appointment waiver for the April 22, 2013 certification and ordered that no selection costs would be assessed at that time since there was a possibility that the eligibility list could be utilized prior to its expiration. However, the State Parole Board did not utilize the eligible list and the matter of the assessment of costs is now before the Commission.

 

ACTION:     The Civil Service Commission assessed selection costs in the amount of $8,285.

 

B-23   SUPERVISOR OF ACCOUNTS (M0480P), WILDWOOD - CSC DOCKET NO. 2016-3322

 

The City of Wildwood requests permission not to make an appointment from the November 13, 2012 certification for Supervisor of Accounts (M0480P), Wildwood.

 

ACTION:     The Civil Service Commission granted the request and assessed selection costs in the amount of $2,048.

 

B-24   JEFFREY ADAMS – CSC DOCKET NO. 2016-3246

 

Jeffrey Adams appeals the determination of the Division of Agency Services which found that he was below the minimum requirements in experience for the promotional examination for Construction Management Specialist 4 (PS1552G), Department of Environmental Protection.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-25   ANDREA ALVARE – CSC DOCKET NO. 2016-2481

 

Andrea Alvare appeals the determination of the Division of Agency Services that she was below the minimum requirements in experience for the open-competitive examination for Public Health Planner (C0705T), Union County.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-26   JOE ALVAREZ – CSC DOCKET NO. 2016-1647

 

Joe Alvarez appeals the determination of the Division of Agency Services, which found that he did not meet the experience requirements for the promotional examination for Supervisor of Mails (PS6080K), Department of Children and Families.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

Kelly Astin appeals the determination of the Division of Agency Services that she was below the minimum requirements in experience for the promotional examination for Specification Writer Purchasing (PM2216T), Atlantic City.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-28   DEBORAH BLACKWELL AND GINA CONTI - CSC DOCKET NOS. 2016-3358 AND 2016-3410

 

Deborah Blackwell and Gina Conti appeal the determinations of the Division of Agency Services that they were below the minimum requirements in experience for the promotional examination for Training Coordinator (PC2236T), Ocean County Library.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

 

B-29   ROSEMARY BOGACZ – CSC DOCKET NO. 2016-1334

 

Rosemary Bogacz appeals the determination of the Division of Agency Services which found that, per the substitution clause for education, she did not meet the experience requirements for the promotional examination for Personnel Assistant 3 (PS0828G), Department of Environmental Protection.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

Bolanowski, Esq., requests reconsideration of the decision rendered on November 18, 2015, which granted in part the petitioner’s request for interim relief regarding his immediate suspension. Egberto Colon, represented by James M. Mets, Esq., requests reconsideration of the determination not to immediately reinstate him.

 

ACTION:     The Civil Service Commission directed that the appointing authority’s request be granted, but the petitioner’s request be denied.

Submitted for the Civil Service Commission’s review is a Notice of Adoption regarding N.J.A.C. 4A:6 (Leaves, Hours of Work and Employee Development). The Commission proposed the rule chapter for readoption with amendments at its November 24, 2015 meeting. The proposal was published in the January 4, 2016 issue of the New Jersey Register. A public hearing was held on February 3, 2016. Two comments were received regarding this proposal during the public comment period. It is noted that, pursuant to N.J.S.A. 52:14B-5.1(d), Governor Christie extended the expiration date from May 31, 2016 to May 31, 2017. It is recommended that N.J.A.C. 4A:6 be adopted without change.

 

ACTION:     The Civil Service Commission approved the proposed readoption without change.

Submitted for the Civil Service Commission’s review is a Notice of Adoption regarding N.J.A.C. 4A:8 (Layoffs). The Commission proposed the rule chapter for readoption with amendments at its November 24, 2015 meeting. The proposal was published in the January 4, 2016 issue of the New Jersey Register. A public hearing was held on February 3, 2016. Seven comments were received regarding this proposal during the public comment period. It is noted that, pursuant to N.J.S.A. 52:14B-5.1(d), Governor Christie extended the expiration date from June 20, 2016 to June 20, 2017. It is recommended that N.J.A.C. 4A:6 be adopted without change.

 

ACTION:    The Civil Service Commission approved the proposed readoption without change.

B-149 MALIK MASSEY – CSC DOCKET NO. 2015-2329

 

The appeal of Malik Massey, a Keyboarding Clerk 1 with the City of Atlantic City, Department of Planning and Development, of his removal effective January 26, 2015, on charges, was heard by Administrative Law Judge Bruce M. Gorman, (ALJ), who rendered his initial decision on April 27, 2016. At its meeting on October 19, 2016, the Civil Service Commission (Commission) did not adopt the ALJ’s recommendation to modify the removal to a six-month suspension. Rather, the Commission ordered that the matter be remanded to the Office of Administrative Law. The proposed decision is now submitted for the Commission’s review.

 

            ACTION:    The Civil Service Commission adopted the decision.

 

B-150 ORLENA SIMPSON, ET AL. – CSC DOCKET NO. 2014-676, ET AL.

 

The appeals of Orlena Simpson, et al., former employees with the Newark Public School District, of their layoffs, effective July 1, 2013, were heard by Administrative Law Judge Kimberly A. Moss, who rendered her initial decision on February 10, 2016. At its meeting on October 19, 2016, the Civil Service Commission (Commission) adopted the recommendation to uphold the layoffs of all appellants in non-Attendance Counselor title. However, the Commission did not adopt the recommendation to reverse the layoff of the Attendance Counselors. Rather, the Commission upheld the layoff of the Attendance Counselors. The proposed final decision is now submitted for the Commission’s review.

 

            ACTION:    The Civil Service Commission adopted the final decision.

Submitted for the Civil Service Commission’s review is a Notice of Proposal to readopt with technical amendments N.J.A.C. 4A:3, Classification, Services and Compensation. This rule chapter is set to expire on November 18, 2016. In accordance with N.J.A.C. 1:30-6.4(g), the expiration date will be extended by 180 days so long as the proposed readoption is filed with the Office of Administrative Law prior to November 18, 2016. It is recommended that the proposed readoption with amendments be approved for public notice and comment.

 

ACTION:    The Civil Service Commission approved the proposed readoption with amendment for public notice and comment.
