          A regular meeting of the Civil Service Commission was held on Wednesday, November 15, 2017, in Trenton, New Jersey.

 

          PRESENT: Robert M. Czech, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Christopher Myers, Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on November 28, 2016, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

WITHDRAWAL OF APPEALS

 

The following appeal was withdrawn and removed from the hearing calendar:

 

Linda Miller, Human Service Specialist 3, Cape May County, Department of Social Services, 10 working day suspension.

 

ACTION:    The Civil Service Commission noted the withdrawal of appeal without prejudice.

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following cases without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

 

Beatrice Black, Family Service Specialist 2, Department of Children and Families, release at the end of the working test period.

 

William Burgess, County Correction Officer, Cumberland County, Department of Corrections, indefinite suspension.

 

Thomas Swain, Senior Medical Security Officer, Ann Klein Forensic Center, Department of Human Services, removal.

 

ACTION:    The Civil Service Commission noted the dismissal of appeals without prejudice.

SECTION B – MISCELLANEOUS MATTERS

 

B-1    D.A. – CSC DOCKET NO. 2016-3066

 

D.A., represented by Bette R. Grayson, Esq., appeals his rejection as a Police Officer candidate by the City of Newark and its request to remove his name from the eligible list for Police Officer (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2    R.A. – CSC DOCKET NO. 2016-1993

 

R.A., represented by Nicholas J. Palma, Esq., appeals his rejection as a County Correction Officer candidate by the Essex County and its request to remove his name from the eligible list for County Correction Officer (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-3    A.F. – CSC DOCKET NO. 2017-98

 

A.F., represented by Corey M. Sargeant, Esq., appeals his rejection as a County Correction Officer candidate by Camden County and its request to remove his name from the eligible list for County Correction Officer (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:    The Civil Service Commission directed that the appellant be referred for an independent psychological evaluation.

 

B-4    B.T. – CSC DOCKET NO. 2016-4163

 

B.T., represented by Ricardo P. Gonzalez, Esq., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for County Correction Officer Recruit (S9988T) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-5    ALPHONSO DAVIS – CSC DOCKET NO. 2017-3200

 

Alphonso Davis, represented by Anthony J. Fusco, Jr., Esq., appeals the removal of his name from the eligible list for Sheriff’s Officer (S9999R), Union County Sheriff on the basis that he falsified his pre-employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-6    SARAH DOZIER – CSC DOCKET NO. 2018-231

 

Sarah Dozier appeals her removal from the eligible list for Therapy Program Assistant (Special), Hunterdon Developmental Center, for failing to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-7    ERIC GROETHING AND KEITH O’BRIEN – CSC DOCKET NOS. 2017-2385 AND 2017-2563

 

Eric Groething, represented by Michael L. Prigoff, Esq., appeals the removal of his name from the eligible list for Fire Fighter (M1544T), Jersey City, on the basis of an unsatisfactory background report. Keith O’Brien, also represented by Mr. Prigoff, appeals the removal of his name from the eligible list for Fire Fighter (M1544T), Jersey City, on the basis of an unsatisfactory criminal record.

 

ACTION:     The Civil Service Commission granted the appeal of Eric Groething but indicated that his name be recorded on the certification as bypassed and denied the appeal of Keith O’Brien.

 

B-8    JOSEPH ZIMMER – CSC DOCKET NO. 2017-3897

 

Joseph Zimmer appeals Montclair State University’s decision to remove his name from the Senior Postal Clerk (S0648U), Montclair State University, eligibility list on the basis of his failure to complete pre-employment processing.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-9    ROBERT BINDOS AND ROCCO SIMEONE – CSC DOCKET NOS. 2018-681 AND 2018-563

 

Robert Bindos and Rocco Simeone appeal the determinations of the Division of Agency Services which found that they did not meet the experience requirements for the promotional examination for Road Repairer Supervisor (PC0315V), Woodbridge.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

 

B-10   MARY FOX, ET AL. – CSC DOCKET NOS. 2018-514, ET AL.

 

Mary Fox, Chanel Lorenzo and Rashid Odoms appeal the determinations of the Division of Agency Services which found that they did not meet the experience requirements for the promotional examination for Keyboarding Clerk 2 (PC0159V), Union County.

 

ACTION:     The Civil Service Commission directed that these appeals be held.

 

B-11   TIMOTHY GUSHUE – CSC DOCKET NO. 2018-158

 

Timothy Gushue appeals the determination of the Division of Agency Services which found that he was below the experience requirements for the promotional examination for Safety Inspector (PS2801K), Department of Human Services.

 

ACTION:     The Civil Service Commission directed that this appeal be held.

 

B-12   SANDRA KELLY – CSC DOCKET NO. 2017-3860

 

Sandra Kelly appeals the determination of the Division of Agency Services which found that she was below the minimum requirements in experience for the promotional examination for Travel Coordinator, Department of Law and Public Safety (PS4448P).

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-13   DANIEL KRUSHINSKI, III AND JOSEPH WHALEN, III – CSC DOCKET NOS. 2018-916 AND 2018-969

 

Daniel Krushinski, III and Joseph Whalen, III appeal the determinations of the Division of Agency Services which found that they did not meet the experience requirements for the promotional examination for Assistant Supervisor, Sanitation (PM0508V), North Brunswick.

 

ACTION:     The Civil Service Commission directed that these appeals be granted.

 

B-14   KAREN LEE – CSC DOCKET NO. 2018-95

 

Karen Lee appeals her removal from the eligible list for Assistant Social Work Supervisor, Psychiatric (PS2900K) for failing to respond to the certification notice.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-15   ELIZABETH MCCARTHY – CSC DOCKET NO. 2018-37

 

Elizabeth McCarthy appeals the determination of the Division of Agency Services which found that she was not eligible for the promotional examination for Records Technician 2, Motor Vehicles (PS4699T), Motor Vehicle Commission because she was not employed in the announced unit scope.

 

ACTION       The Civil Service Commission directed that this appeal be denied.

 

B-16   WILLIAM R. THOMPSON – CSC DOCKET NO. 2017-3530

 

William R. Thompson appeals the bypass of his name on the County Correction Captain (PC2535T), Ocean County eligible list.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-17   ANTHONY ARGENTO AND FRANK FURFARO – CSC DOCKET NOS. 2017-4069 AND 2018-125

 

Anthony Argento and Frank Furfaro appeal their disqualifications from the promotional examination for Police Captain (PM1315U), Bloomfield.

 

ACTION:     The Civil Service Commission directed that these appeals be denied.

 

B-18   SUDESH MEHTA – CSC DOCKET NO. 2018-914

 

Sudesh Mehta appeals the test administration of the promotional examination for Human Service Specialist 4 (PC0414V), Morris County.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-19   BUSINESS MANAGER (M0653T), LAKEWOOD FIRE DISTRICT

 

The Lakewood Fire District requests permission not to make an appointment from the April 6, 2016 certification for Business Manager (M0653T).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-20   MAINTENANCE SUPERINTENDENT (M0841U), CITY OF ASBURY PARK – CSC DOCKET NO. 2017-3878

 

The City of Asbury Park requests permission not to make an appointment from the March 20, 2017 certification for Maintenance Superintendent (M0841U).

 

ACTION:     The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

B-22   GEORGE WILLIAMS – CSC DOCKET NO. 2017-3445

 

George Williams appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9988T), Department of Corrections on the basis of a positive drug test.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-23   MICHAEL MARTINI – CSC DOCKET NO. 2018-535

 

Michael Martini appeals the decision of the Division of Agency Services which found that he did not meet the experience requirements for the promotional examination for Heavy Equipment Operator (PM0411V), Hamilton Township.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-24   BRIAN BEKE – CSC DOCKET NO. 2018-962

 

Brian Beke petitions the Civil Service Commission for reconsideration of the decision rendered on September 6, 2017 which denied his appeal regarding his ineligibility for the promotional examination for Coordinator MVC (PS4377T), Motor Vehicle Commission.

 

ACTION:     The Civil Service Commission directed that this petition be denied.

 

B-25   CIVIL SERVICE COMMISSION MEETING DATES FOR 2018

 

The proposed 2018 Civil Service Commission meeting dates are submitted for approval.

 

            ACTION:    The Civil Service Commission adopted the 2018 meeting dates.

 

B-26   THOMAS RANALLI – CSC DOCKET NO. 2018-532

 

Thomas Ranalli appeals the determination of the Division of Agency Services which found that he did not meet the experience requirements for the open-competitive examination for General Supervisor, Streets (S0347V), Jersey City.

 

          ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-27   DUANE WALLACE – CSC DOCKET NO. 2018-297

 

Duane Wallace appeals his removal from an unclassified appointment as a Confidential Assistant from the Township of Willingboro.

 

            ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-28   EDSON PEREIRA – CSC DOCKET NO. 2017-2259

 

Edson Pereira, represented by Michael L. Prigoff, Esq., appeals the appointing authority’s request to remove his name from the Fire Fighter (M1545T), Kearny eligible list on the basis of an unsatisfactory background report.

 

            ACTION:     The Civil Service Commission directed that this appeal be denied.
