    A regular meeting of the Civil Service Commission was held on Thursday, November 23, 2016, in Trenton, New Jersey.

 

          PRESENT: Robert M. Czech, Chairperson, Members Dolores Gorczyca and Daniel W. O’Mullan; Pamela Ullman, Deputy Attorney General; Nicholas F. Angiulo, Assistant Director, Division of Appeals and Regulatory Affairs.

 

          In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 2, 2015, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

 

WITHDRAWAL OF APPEALS

 

The following appeals were withdrawn and removed from the hearing calendar:

 

Douglas Gotfredsen, Police Lieutenant, City of Long Branch, Department of Public Safety, suspension.

 

ACTION:    The Civil Service Commission noted the dismissal of the appeal without prejudice.

RECOMMENDATION OF THE ADMINISTRATIVE LAW JUDGE IN THE ABOVE CASES – SETTLEMENT

Zane Batten, Conservation Officer 2, Department of Environmental Protection, 70 working day suspension, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the 70 working day suspension.

 

ACTION: The Civil Service Commission directed that this matter be held.

 

A-3    ANTHONY CALDARISE

 

Anthony Caldarise, Senior Correction Officer, New Jersey State Prison, Department of Corrections, removal effective November 17, 2015, on charges of conduct unbecoming a public employee and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-4    TRACY GUARNERI

 

Tracy Guarneri, Keyboarding Clerk 1, City of Perth Amboy, removal effective June 19, 2015, on charges of insubordination, conduct unbecoming a public employee, neglect of duty and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-5    ANTHONY LARINO  (A written decision will be posted in this matter when the Civil Service Commission adopts the decision at a future meeting.)

 

Anthony Larino, Police Captain, City of Bayonne, 180 calendar day suspension, on charges of failure to perform duties and conduct unbecoming a public employee.

 

Recommendation of the Administrative Law Judge – Uphold the 180 calendar day suspension.

 

ACTION:    The Civil Service Commission modified the 180 calendar day suspension to a 120 calendar day suspension.

 

A-6    ROBERT RANDOLPH (Remand)

 

Robert Randolph, Assistant District Parole Supervisor, Juvenile Justice Commission, Administration, three demotions to Senior Parole Officer effective July 14, 2012 and a 60 working day suspension, on charges of misuse of public property, including motor vehicles, conduct unbecoming a public employee, and other sufficient cause.

 

This matter was originally before the Civil Service Commission on May 6, 2015. At that time, the Administrative Law Judge recommended reversing the 60 working day suspension and the demotions. However, while the Commission affirmed the reversal of the 60 working day suspension, it upheld two of the demotions. Additionally, it remanded the reversal of the third demotion to the Administrative Law Judge for further proceedings.

 

Recommendation of the Administrative Law Judge – Reverse the demotion.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-7    MIGDOEL RIVERA

 

Migdoel Rivera, County Correction Officer, Hudson County, Department of Corrections, removal effective April 13, 2016, on charges of insubordination, conduct unbecoming a public employee, neglect of duty, incompetency, inefficiency or failure to perform duties and excessive absenteeism.

 

Recommendation of the Administrative Law Judge – Reverse the removal.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-8    ZSUZSANNA ROGOSHEWSKI

 

Zsuzsanna Rogoshewski, Correction Lieutenant, New Jersey State Prison, Department of Corrections, 30 working day suspension on charges of violating administrative procedures or regulations.

 

Recommendation of the Administrative Law Judge – Reverse the 30 working day suspension.

 

ACTION:    The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

B-1    A.F. – CSC DOCKET NO. 2015-2469

 

A.F. appeals his rejection as a Police Officer candidate by the Woodbridge Township Police Department and its request to remove his name from the eligible list for Police Officer (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

 

B-2      D.F. – CSC DOCKT NO. 2015-2499

 

           D.F., represented by Lynsey A. Stehling, Esq., appeals his rejection as a County Correction Officer candidate by Essex County and its request to remove his name from the eligible list for County Correction Officer (S9999R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:    The Civil Service Commission directed that this appeal be referred for an independent psychological evaluation.

 

B-3      E.J.F. – CSC DOCKET NO. 2015-2544

 

           E.J.F., represented by Robert A. Ebberup, Esq., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9988R) on the basis of psychological unfitness to perform effectively the duties of the position.

B-17   RICHARD ACEVEDO – CSC DOCKET NO. 2015-3175

 

Richard Acevedo, represented by Michael L. Prigoff, Esq., appeals the decision of the Division of Agency Services, which found that the appointing authority had presented a sufficient basis to remove the appellant’s name from the Sheriff’s Officer (S9999M), Passaic County Sheriff eligible list on the basis of falsification of his pre-employment application.

 

ACTION:     The Civil Service Commission directed that this appeal be denied.

Seth Anfield, represented by Richard J. ACTION:     The Civil Service Commission directed that this appeal be denied.

B-126 KIM LACHENMAYER – CSC DOCKET NO. 2017-818

 

The Division of Agency Service requests that the provisions of N.J.A.C. 4A:4-1.1(c) be relaxed in order to allow Kim Lachenmayer to be provisionally appointed, pending promotional examination procedures, to the competitive title of Legal Secretary 2, Department of Law and Public Safety.

 

ACTION:     The Civil Service Commission directed that this request be granted.

 

B-127 CLERK 3 (M0752P), CITY OF PATERSON - CSC DOCKET NO. 2016-3770

 

In In the Mater of Clerk 3 (M0752P), City of Paterson (CSC, decided February 26, 2014), the Civil Service Commission (Commission) granted the request of the City of Paterson for an appointment waiver for the April 15, 2013 certification and ordered that no selection costs were to be assessed at that time since there was a possibility that the list could be utilized prior to its expiration. However, the appointing authority did not utilize the subject eligible list and the matter of the assessment of costs is now before the Commission.

 

ACTION:     The Civil Service Commission assessed selection costs in the amount of $1,024.

 

B-128 REGINA APPLEBY, PAROLE COUNSELOR APPRENTICE, STATE PAROLE BOARD (S0129R), STATE PAROLE BOARD – CSC DOCKET NO. 2017-556

 

          Regina Appleby requests that her name be restored to the Parole Counselor Apprentice, State Parole Board (S0129R), State Parole Board eligible list. The State Parole Board requests that the eligible list for Parole Counselor Apprentice State Parole Board (S0129R), be revived and extended for one year beyond its original expiration date, and Regina Appleby’s name be restored to the list.

 

ACTION:     The Civil Service Commission directed that this request be granted.

ACTION:     The Civil Service Commission directed that this request be granted.

Doreen Conteh, a Practical Nurse with the Department of Human Services, requests that the Civil Service Commission reinstate her good faith appeal of a layoff, which was dismissed based on her failure to appear at a scheduled settlement conference.

J.D., represented by John Feeley, Esq., appeals his rejection as a Police Officer candidate by the Borough of Rutherford and its request to remove his name from the eligible list for Police Officer (S9999M) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:     The Civil Service Commission directed that this appeal be granted.

 

B-151 ODALYS RASTATTER – CSC DOCKET NO. 2016-3319

 

The City of Passaic, represented by Philip G. George, Esq., requests reconsideration of the initial decision of the Administrative Law Judge decision, which was deemed adopted by the Civil Service Commission as its final decision on March 11, 2016, reversing the removal of Odalys Rastatter, a Police Lieutenant with the City of Passaic, effective December 7, 2012. At its meeting of October 19, 2016, the Commission granted reconsideration but ordered the appointing authority to submit the transcripts of the hearing at the Office of Administrative Law for the Commission’s further review.

 

ACTION:    The Civil Service Commission granted the request and upheld the removal.

 

B-152 CIVIL SERVICE COMMISSION MEETING DATES FOR 2017

 

The proposed 2017 Civil Service Commission meeting dates are submitted for approval.

 

ACTION:    The Civil Service Commission approved the meeting dates for 2017.
