    A regular meeting of the Civil Service Commission was held on Wednesday, December 16, 2015, in Trenton, New Jersey.

 

            PRESENT: Robert M. Czech, Chairperson, Members Thomas J. Perna and Richard E. Williams; Pamela Ullman, Deputy Attorney General; Henry Maurer, Director, Division of Appeals and Regulatory Affairs.

 

            In accordance with L.1975, c.231, the Secretary to the Civil Service Commission opened the meeting with the following statement:

 

    Notice of this meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 11, 2014, and posted at the Civil Service Commission, 3 Station Plaza, Trenton, New Jersey.

 

    All actions were by unanimous vote unless otherwise specified.

 

DISMISSAL FOR FAILURE TO APPEAR

 

The Civil Service Commission dismissed the following case without prejudice for failure to appear at the scheduled hearing before the Office of Administrative Law:

 

Peter Zampella, Jr., Senior Maintenance Repairer, Hudson County, Department of Roads and Public Property, suspension.

 

ACTION:       The Civil Service Commission noted the dismissal of appeal without prejudice.

A-5      RANDY DIAKUNCZAK (CONSOLIDATED)

 

Randy Diakunczak, Campus Police Officer, Kean University, two removals, effective November 23, 2014, on charges of incompetency, inefficiency, or failure to perform duties; conduct unbecoming a public employee; neglect of duty; and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Uphold the removals.

 

ACTION:       The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.

 

A-6      DARRYL DUNCAN

 

Darryl Duncan, Bus Driver, Department of Children and Families, removal effective January 2, 2015, on charges of insubordination, inability to perform duties, neglect of duty, and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Grant the motion for summary decision and uphold the removal.

 

ACTION:       The Civil Service Commission modified the removal to a resignation in good standing.

 

A-7      VINCENT FISCELLA, JR.    (A written decision will be posted in this matter when the Civil Service Commission adopts the decision at a future meeting.)

 

Vincent Fiscella, Jr., Laborer, Township of Belleville, Department of Public Works, removal effective May 13, 2014, on charges of insubordination and other sufficient cause.

 

Recommendation of the Administrative Law Judge – Reverse the removal.

 

ACTION:       The Civil Service Commission modified the removal to an official written reprimand.

Douglas Foster, Police Officer, Pennsauken Township, Police Department, removal effective May 22, 2015, on charges of conduct unbecoming an officer.

A.G., represented by Michael L. Prigoff, Esq., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9988R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-2      D.O.I. – CSC DOCKET NO. 2015-2590

 

D.O.I, represented by Daniel J. Zirrith, Esq., appeals his rejection as a Correction Officer Recruit candidate by the Department of Corrections and its request to remove his name from the eligible list for Correction Officer Recruit (S9988R) on the basis of psychological unfitness to perform effectively the duties of the position.

 

ACTION:    The Civil Service Commission directed that this matter be referred for an independent evaluation.

 

 

B-3      SANDY DELAROSA – CSC DOCKET NO. 2015-2837

 

Sandy Delarosa, represented by Catherine Elston, Esq., appeals the decision of the Division of Agency Services which found that the appointing authority had presented a sufficient basis to remove his name from the eligible list for Fire Fighter (M2542M), Jersey City on the basis of an unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-4      DAVID P. HART, SR. – CSC DOCKET NO. 2015-3224

 

David P. Hart, Sr., represented by Stuart J. Alterman, Esq., appeals the removal of his name from the County Correction Sergeant (PC2075R), Camden County, eligible list.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-5      WENDY LANDUS - CSC DOCKET NO. 2015-2630

 

Wendy Landus appeals the determination of the Division of Agency Services upholding the removal of her name from the eligible list for Correction Officer Recruit (S9988R), Department of Corrections, on the basis of an unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-6      GABRIEL LOPEZ – CSC DOCKET NO. 2015-2903

 

Gabriel Lopez, represented by Nicholas J. Palma, Esq., appeals the decision of the Division of Classification and Personnel Management, which found that the appointing authority had presented a sufficient basis to remove the appellant’s name from the Correction Officer Recruit (S9988R), Department of Corrections eligible list on the basis of an unsatisfactory criminal record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-7      JANIE REID- CSC DOCKET NO. 2016-578

 

Janie Reid appeals the removal of her name from the eligible list for Police Lieutenant (PM1458R), East Orange, on the basis of an unsatisfactory employment record.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-8      DENISE RODRIGUEZ – CSC DOCKET NO. 2016-936

 

Denise Rodriguez appeals the Department of Corrections’ request to remove her name from the Correction Officer Recruit (S9988R), Department of Corrections eligible list on the basis of a positive drug test.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-9      CORRECTION OFFICER RECRUIT (S9988R), DEPARTMENT OF CORRECTIONS – CSC DOCKET NO. 2016-1489

 

            The Department of Corrections requests that it be allowed to immediately appoint Correction Officer Recruit candidates to facilities which have specific residency requirements, despite not meeting those requirements.

 

ACTION:       The Civil Service Commission directed that this request be denied.

 

B-10   ADMINISTRATIVE ANALYST 1, (PS8077K), DEPARTMENT OF CHILDREN AND FAMILIES - CSC DOCKET NO. 2015-2110

 

The Department of Children and Families requests permission not to make an appointment from the certification for Administrative Analyst 1 (PS8077K).

 

ACTION: The Civil Service Commission granted the appointment waiver and assessed no selection costs at this time.

 

B-11    ASSISTANT DIRECTOR OF FINANCE (M0866R), SPARTA TOWNSHIP – CSC DOCKET NO. 2015-1643

 

            Sparta Township requests permission not to make an appointment from the April 1, 2014 certification for Assistant Director of Finance (M0866R).

 

ACTION:       The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-12    JUVENILE DETENTION OFFICER (C0658R), HUDSON COUNTY - CSC DOCKET NO. 2016-1261

 

            Hudson County requests permission not to make an appointment from the March 17, 2014 certification for Juvenile Detention Officer (C0658R).

 

ACTION:       The Civil Service Commission granted the appointment waiver and assessed selection costs in the amount of $2,048.

 

B-13    HUMAN SERVICES SPECIALIST 1 (C0771P), CAMDEN COUNTY BOARD OF SOCIAL SERVICES – CSC DOCKET NO. 2016-1914

 

            The Camden County Board of Social Services requests that the eligible list for Human Services Specialist 1 (C0771P) be extended for one year beyond its original expiration date.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-14    NETWORK ADMINISTRATOR 1, OFFICE OF INFORMATION TECHNOLOGY – CSC DOCKET NO. 2016-1545

 

            The Division of Agency Service (Agency Services), on behalf of the Office of Information Technology (OIT), requests that it be permitted to selectively certify eligibles from promotional lists for Network Administrator 1, OIT. Agency Services also requests that the current announcements for Network Administrator 1 (PS6089U) and (PS8708U) be cancelled and new announcements issued indicating the eligibles will be selectively certified.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-15    WALTER STINNER, ET AL., - CSC DOCKET NOS. 2016-1816, ET AL.

 

            Union Township requests that the appointments of Walter Stinner and Thomas Florio be recorded from the eligible list for Police Sergeant (PM5162N), effective February 24, 2015, and the appointments of Kevin Murphy and Robert Donnelly be recorded from that list effective June 23, 2015.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-16    ANTHONY BRADLEY – CSC DOCKET NO. 2015-3078

 

            Anthony Bradley appeals the decision of the Division of Agency Services that the proper classification of his position with the Department of the Treasury is Accountant 2. Bradley seeks an Accountant 1 job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-17    JASON HEARON – CSC DOCKET NO. 2016-1259

 

            Jason Hearon appeals the decision of the Division of Agency Services that the proper classification of his position with the Department of Environmental Protection is Principal Biologist, Fisheries. The appellant seeks a Supervising Biologist, Fisheries job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-18    CANDICE HENDRICKS – CSC DOCKET NO. 2015-1012

 

            Candice Hendricks appeals the determination of the Division of Classification and Personnel Management that her position with the Civil Service Commission is properly classified as Investigator 2. The appellant seeks an Investigator 1 or an Affirmative Action Officer 2 job classification.

            Luz Rodiguez-Ghaul appeals the decision of the Division of Agency Services which found that her position with the Department of Labor and Workforce Development is properly classified as Senior Clerk Typist. The appellant seeks a Principal Clerk Typist job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-21    LINDA TRICKEY – CSC DOCKET NO. 2016-862

 

            Linda Trickey appeals the decision of the Division of Agency Services that the proper classification of her position with Department of Labor and Workforce Development is Senior Technician, Management Information Systems. The appellant seeks a Principal Technician, Management Information Systems job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-22    CREW LEADER, HIGHWAY OPERATIONS – CSC DOCKET NO. 2016-1706

 

            The Division of Agency Services, on behalf of the Department of Transportation, requests that the provision of N.J.A.C. 4A:4-1.1(c) and N.J.A.C. 4A:4-2.5(d) be relaxed in order to permit incumbents with one year of continuous permanent service in the non-competitive title of Truck Driver, Single Axle to be eligible for a prospective promotional examination for Crew Leader, Highway Operations.

 

ACTION:       The Civil Service Commission directed that this request be granted.

 

B-23    PAULINE STOVES – CSC DOCKET NO. 2016-892

 

            Pauline Stoves appeals the decision of the Division of Agency Services that the proper classification of her position with the Township of Willingboro is Clerk 2. The appellant seeks a Recreation Program Coordinator job classification.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

            Christopher Johnson requests that he be permitted to amend his residency on his application after the closing date for Juvenile Detention Officer (C0606S), Middlesex County.

B-25    SHARON MUNICELLO-BAKER – CSC DOCKET NO. 2016-808

 

            Sharon Municello-Baker petitions the Civil Service Commission to accept her untimely application for the promotional examination for Contract Administrator 3 (PS2879K), Department of Human Services..

 

ACTION:       The Civil Service Commission directed that this petition be granted.

 

B-26    RACHEL AMODIO AND LASHONDA BURLEY – CSC DOCKET NOS. 2016-976 AND 2016-867

 

            Rachel Amodio and LaShonda Burley appeal the determinations of the Division of Agency Services that they were below the minimum requirements in experience for the promotional examination for Clinical Psychologist 1 (PS2840K), Department of Human Services.

 

ACTION:       The Civil Service Commission directed that these appeals be granted.

 

B-27    CYNTHIA ATKINS AND RONDA JONES - CSC DOCKET NOS. 2016-1102 AND 2016-1202

 

            Cynthia Atkins and Ronda Jones appeal the determinations of the Division of Agency Services which found that they did not meet the experience requirements for the open competitive examination for Investigator 1 (S0396T), Statewide.

 

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-28    KEITH BABCOCK, ET AL. – CSC DOCKET NOS. 2016-1344, ET AL.

 

Keith Babcock, Andrew Bouilette and Stephen Butyn appeal the determinations of the Division of Selection Services that they did not meet the experience requirements for the promotional examination for Road Repair Supervisor (PC0622T), Sussex County.

 

ACTION:       The Civil Service Commission directed that these appeals be granted.

 

B-29    LATEEFAH CHANDLER – CSC DOCKET NO. 2015-1791

 

            Lateefah Chandler appeals the determination of the Division of Agency Services which found that she was below the minimum requirements in experience for the promotional examination for Assistant Purchasing Agent (PM1002S), City of Camden.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-30    CHRISTOPHER CONNELLY AND JAMES CRACKOVICH - CSC DOCKET NOS. 2016-1249 AND 2016-1250

 

Christopher Connelly and James Crackovich appeal the determinations of the Division of Agency Services that they were below the minimum requirements in experience for the promotional examination for Assistant Supervisor, Reginal Food Service Operation (PS0470I), Department of Corrections.

 

ACTION:       The Civil Service Commission directed that these appeals be granted.

 

B-31    SAMANTHA CRUZ – CSC DOCKET NO. 2016-1220

 

            Samantha Cruz appeals the determination of the Division of Agency Services that she did not meet the experience requirement for the promotional examination for Recreation Supervisor (PM0618T), Millville.

 

ACTION:       The Civil Service Commission directed that this appeal be granted.

 

B-32    DONNA DEVENEY AND CYNTHIA DEY - CSC DOCKET NOS. 2016-986 AND 2016-947

 

Donna Deveney and Cynthia Dey appeal the determinations of the Division of Agency Services that they were below the minimum requirements in experience for the promotional examination for Manager 1 Information Processing (PS0775T), Department of the Transportation.

 

ACTION:       The Civil Service Commission directed that these appeals be granted.

 

B-33    TIFFANY BROWN AND CHRISTINE GRANALDI - CSC DOCKET NOS. 2016-959 AND 2016-956

 

            Tiffany Brown and Christine Granaldi appeal the determinations of the Division of Agency Services which found that the did not meet the minimum experience requirements for the promotional examination for Family Service Specialist 1, Family Development (PS2925K), Department of Human Services.

 

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-34    ANNE COLE – CSC DOCKET NO. 2016-1034

 

            Anne Cole appeals the determination of the Division of Agency Services which found that she did not meet the experience requirements for the open-competitive examination for Field Representative, Housing (Housing Assistance Program) (S0517T), Statewide.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

 

B-35    ROBERT GIQUINTO AND DANUTA SZEWCZYK - CSC DOCKET NOS. 2016-1372 AND 2016-1478

 

            Robert Giquinto and Danuta Szewczyk appeal the determinations of the Division of Agency Services which found that Danuta Szewczyk did not meet the experience requirements, and Robert Giquinto did not meet the experience requirements, per the substitution clause for education, for the open-competitive examination for Procurement Specialist 1 (S0397T), Statewide.

 

ACTION:       The Civil Service Commission directed that these appeals be denied.

 

B-36    DEBORAH LEWIS – CSC DOCKET NO. 2016-724

 

            Deborah Lewis appeals the determination of the Division of Agency Services that she did not meet the experience requirement for the promotional examination for Secretarial Assistant 1 (Non-Stenographic) (PS2079K), Department of Human Services, Division of Medical Assistance.

 

ACTION:       The Civil Service Commission directed that this appeal be denied.

Moss (ALJ), who rendered her initial decision on October 16, 2015. At its meeting on November 18, 2015, the Civil Service Commission (Commission) did not adopt the ALJ’s recommendation to reverse the suspension. Rather, the Commission modified the penalty to a three working day suspension. The proposed final decision is now submitted for the Commission’s review.

 

ACTION:       The Civil Service Commission adopted the final decision.

 

B-70    MICHAEL HOYER – CSC DOCKET NO. 2015-2333

 

The appeal of Michael Hoyer, a Sign Technician 3 with the Department of Transportation, of his removal, effective October 16, 2014, on charges, was heard by Administrative Law Judge Sarah Crowley, who rendered her initial decision on October 19, 2015. At its meeting on November 18, 2015 the Civil Service Commission (Commission) did not accept the recommendation to modify the removal to a 60 working day suspension. Rather, the Commission modified the removal to a 120 working day suspension. The proposed decision is now submitted for the Commission’s review.
