A regular meeting of the Merit System Board was held on Tuesday, September 10, 1998 in Trenton, New Jersey. PRESENT: Chairwoman Janice Mitchell Mintz; Merit System Board Members, Margaret E.L. Howard, Judith L. Shaw, and Edward W. Verner, M.D., Andrea Grundfest, Deputy Attorney General; Henry Maurer, Director, Elizabeth A. Napolitano, Sybil Janowitch, and Charles Spano, Division of Merit System Practices and Labor Relations. In accordance with L.1975, c.231, Janice Mitchell Mintz, Chairwoman, Merit System Board, opened the meeting with the following statement: Notice of this Meeting was filed with the Secretary of State and sent to the Trentonian, Trenton Times, Courier-Post and Star Ledger on December 1, 1997 and posted at the Department of Personnel, 3 Station Plaza, Trenton, New Jersey. All actions were by unanimous vote unless otherwise specified.

The Merit System Board approved the recommended changes in the State Classification Plan, copies of which are attached hereto and made a part hereof.

Confidential Appointments

KEAN UNIVERSITY

Kean University is requesting a new title, Technical Assistant 2, Higher Education (10 months). Currently this title exists for 12 months. DEPARTMENT OF LAW AND PUBLIC SAFETY

The Department of Law and Public Safety has requested the following action in order to classify a position to staff the customer service desk in the executive office of the Attorney General during the hours of 8:00 a.m. and 5:00 p.m. The position would bear the responsibility for assisting the general public with telephone inquiries and providing visitors with necessary information concerning the interpretation of rules, regulations, policies and procedures of the Department. Performance of these duties requires in-depth knowledge of Departmental functions and the responsibilities of the various Deputy Attorney Generals in the Department. A knowledge of the functions of the other state departments is also required of this position. The title Customer Service Information Specialist series now exists in the 35 hour workweek, however, the Department wishes to utilize the A2" level in the series in a 40 hour workweek. Darrell Reed, Senior Therapy Program Assistant, New Lisbon Developmental Center, Department of Human Services, removal effective May 14, 1997, on charges of neglect of duty and willful failure to devote attention to tasks which would not result in causing a danger to persons and violation of policy and procedure. Recommendation of the Administrative Law Judge - Uphold the removal. ACTION: The Merit System Board directed that this matter be held over.

A-9 MICHAEL HAYES

Michael Hayes, Senior Correction Officer, New Jersey Training School, Department of Law and Public Safety, 60-day suspension, and removal, effective February 28, 1997, on charges of neglect of duty, loafing, idleness or willful failure to devote attention to tasks which could result in danger to persons or property. The Board considered this matter at its meeting of July 7, 1998 and directed that this matter be held over for a summary of the testimony. Recommendation of the Administrative Law Judge - Uphold the suspension and removal. ACTION: The Merit System Board upheld the suspension but modified the removal to a 6 month suspension. Perrine, Institutional Trade Instructor II (Cooking), New Jersey State Prison, Department of Corrections, suspension for 10 days, on charges of unsatisfactory attendance and refusal or failure to work overtime without a reasonable excuse, and removal effective January 10, 1997, on charges of unsatisfactory attendance and refusal or failure to work overtime without a reasonable excuse. Ralph Sotomayer, Police Officer, Police Department, City of Plainfield, six-month suspension and removal effective May 6, 1995, on charges of incompetency, inefficiency or failure to perform duties, insubordination and inability to perform duties. Recommendation of the Administrative Law Judge - Uphold the suspension and removal. ACTION: The Merit System Board remanded this matter to the Office of Administrative Law.

ACTION: The Merit System Board directed that this appeal be denied.

B-11 PAUL ASH

Paul Ash, a Teacher 1, 12 Months with the Juvenile Justice Commission, formerly with the Department of Human Services (DHS), represented by Raymond A. Ash, III, Esq., appeals the determination of the Director, Division of Equal Employment Opportunity and Affirmative Action, stating that the appellant failed to present sufficient evidence to support a finding of probable cause that he had been sexually harassed. ACTION: The Merit System Board directed that this appeal be denied.

B-12 THOMAS J. CRYAN

Thomas J. Cryan requests reconsideration of the decision of the Merit System Board, rendered on June 24, 1997, wherein the Board found that Mr. Cryan's name was properly removed from the subject Police Officer list, since he had failed to support his claim of Newark residency as of the examination closing date (February 28, 1990). ACTION: The Merit System Board directed that this appeal be denied.

B-13 CHRISTOPHER IMBRIACCO

Christopher Imbriacco, represented by Anthony N. Palumbo, Esq., appeals the decision of the Certification Unit which found that the removal of his name from the eligible list for Police Officer (M3373X), Elizabeth, based on his failure to meet announced residency requirements, was proper. ACTION: The Merit System Board directed that this appeal be denied.

B-14 REGINALD L. WRIGHT

Reginald L. Wright appeals the decision of the Certification/Placement Services Unit which found that the removal of his name from the employment lists for Correction Officer Recruit (S9676P) and (S9678P) was proper. ACTION: The Merit System Board directed that this appeal be denied.

B-15 NATHAN B. LEARY

Nathan B. Leary appeals the decision of the Certification/Placement Services Unit which found that the appointing authority had presented a sufficient basis to remove his name from the Correction Officer Recruit (S9673P), Department of Corrections eligible list. ACTION: The Merit System Board directed that this appeal be denied.

B-16 JOHN THORNTON

John Thornton appeals the decision of Human Resource Information Systems which found that the appointing authority had presented a sufficient basis to remove his name from the County Police Officer (C2086H), Bergen County priority hiring list. This matter was held over from the August 4, 1998 Merit System Board meeting for consideration by the full Board. ACTION: The Merit System Board directed that this appeal be denied.

B-17 MARY POLITE

Mary Polite, a Senior Practical Nurse with Buttonwood Hospital, Burlington County, represented by Steve Jarema, Staff Representative, CWA Local 1044, petitions the Merit System Board for reconsideration of the final administrative decision, rendered March 20, 1998, which denied Ms. Polite's request for a hearing in regard to her 15-day suspension. ACTION: The Merit System Board granted the request for reconsideration and directed that the matter be transmitted to the Office of Administrative Law for a hearing.

B-18 SANDRA BROWN

Sandra Brown, represented by Steven P. Weissman, Esq., requests reconsideration of the final administrative decision of the Merit System Board, rendered March 11, 1997, which upheld the action of the appointing authority in releasing her at the end of her working test period for the title of Planning Associate 2, School Finance, Department of Education. ACTION: The Merit System Board denied the request for reconsideration.

B-19 CHRIS MAZAUSKAS

Chris Mazauskas, who was formerly employed as an Assistant Director of Neighborhood Preservation Program, Irvington, appeals the decision of the Division of Human Resource Management which found that the reduction in his salary was in accordance with Department of Personnel rules. ACTION: The Merit System Board directed that this appeal be denied.

B-20 KELLY BARBALACCI

Kelly Barbalacci appeals the decision of the Division of Selection Services which found that the appellant did not meet the education and experience requirements for the promotional examination for Administrative Analyst 3 (PS4070I), Department of Corrections. ACTION: The Merit System Board directed that this appeal be denied.

Terry Hirschhorn, Sheryl Klein Harkins, and Carol Palumbo appeal the determinations of the Division of Selection Services which found that appellants did not meet the requirements for the promotional examination for Management Improvement Specialist 2, (PS5639K), Medical Assistance and Health Services. ACTION: The Merit System Board directed that these appeals be denied.
