In order for Tax Credit Staff to complete Part I of the IRS Form 8609, the following items should be submitted to the Agency within 90 days after the last building in the development is placed in service. Failure to submit these items in a timely fashion will delay the processing of your IRS Form 8609.

  1. Sponsor Certification (26k pdf)
  2. Cost Certification Form (17k pdf)
    1. Cost Certification Schedules (68k xls)
  3. 15-Year Operating Proforma as approved by your first mortgage lender
  4. Investor Certification (5k pdf) and all syndication documents
  5. Contractor Disclosure Certification (9k pdf) 
  6. Certification of Completion of Affirmative Fair Housing Marketing (8k pdf)
  7. Developer Certification of MBE/WBE Utilization and CPA Opinion Letter (16k pdf)
  8. If applicable, Special Needs or Social Services Certification (15k pdf) and all social service contracts
  9. Evidence that the project property manager has successfully completed an NJHMFA approved tax credit certification course
  10. Balance of Allocation/Issuance Fee as more fully described in your tax credit reservation letter
  11. Copy of mortgage notes for all permanent debt
  12. Evidence that the Deed of Easement and Restrictive Covenant for Extended Low-Income Occupancy has been recorded.
  13. If applicable, evidence (in the form of project brochures, pictures or an architect’s certification) of the provision of up to 3 units amenities, 2 project amenities and 1 community policing and/or public safety enhancement
  14. If applicable, Energy Star Homes Certificates for each building, evidencing the project’s successful participation in the Environmental Protection Agency's ENERGY STAR Homes Program (or equivalent), along with documentation of any rebates received
  15. Evidence of the placed in service date for all buildings (e.g. certificates of occupancy
  16. The low-income and total residential square footage and number of units per each building.
  17. If applicable, opinion from tax credit counsel that the development qualifies for acquisition credits under 26 U.S.C. 42(d)(2)
  18. Digital picture, in JPEG format, which showcases the front of the building, as well as a preconstruction picture (if available), either copied onto compact disc, or emailed to DDenti@njhmfa.state.nj.us.
  19. Executed User Agreement (26k pdf) for access to the Mitas/NJHMFA Low Income Housing Tax Credit Internet System. For more information on the system, see the Tax Credit Compliance Internet Administration Procedures Guide.
