Interlocal Services Agreements Introduction First came the idea of working together as a method which might result in a cost saving, or at least a higher level of service than currently existed. The conclusions of the feasibility study were positive. The proposed cooperative effort should work to benefit of all of the parties. The public hearings went well. The moments of heated discussion were cooled with calming explanations and some compromise. The task is now to prepare an Interlocal Services Agreement which places on paper, in clear and concise terms, the duties, responsibilities, and obligations of all parties to the agreement. First the required disclaimer. This booklet is not a legal document. Each interlocal service agreement should be tailored to meet the specific and unique needs of your particular situation. There is no single model agreement awaiting the names of the participating parties to be entered. This booklet includes a generalized outline of the content of interlocal services agreements. In addition, it provides sample language describing the services for selected interlocal activities. The language for the examples is based upon clauses found in existing agreements filed with the Division. The clauses have been annotated and the wording edited for clarity. "Provider" and "Recipient" replace the names of the actual local governmental units. We hope that the information presented on the following pages proves to be of assistance when drafting your interlocal service agreement.
