The Appellate
Section of the Office provides post-conviction legal services to all adults
and juveniles. A direct appeal from the conviction or adjudication is
a right in New Jersey. Most referrals to the Appellate section come from
trial regions, however direct applications are also received for services
at the appellate level from indigents no represented by the OPD at the
trial level.
The Appellate
Section files Notices of Appeal within a court-mandated
time period, orders transcripts and assigns an attorney
who then reviews the transcript, interviews defendants, files
trial motions and does the research necessary to identify the problems
raised in the transcript.
