State of the Art (SOTA) Manuals

Background

The Air Pollution Control Act of New Jersey mandates that new or modified sources which emit air pollutants incorporate "advances in the art of air pollution control" , commonly referred to as "State-of-the-Art" or "SOTA."

SOTA accomplishes the following:

  • Minimizes degradation of air quality from new sources
  • Improves air quality when existing sources are replaced or reconstructed
  • Maximizes economic growth opportunity
  • Promotes pollution prevention.
SOTA Workgroup

Authorized by the New Jersey Air Pollution Control Act, the Department formed a SOTA workgroup, as an integral part of its Air Program reengineering efforts. The SOTA workgroup provided advise to the Department on the development of technical manuals to be used by permit applicants for demonstrating advances in the art of air pollution control.

The workgroup was open to the public throughout the process. Representatives of source operations covered by the technical manuals worked in partnership with the Department to develop these manuals. The manuals were finalized after a public workshop and two public comment periods noticed in the New Jersey Register.

Benefits of SOTA Manual

Use of these technical manuals should result in significant savings to permit applicants, both in time spent and costs incurred, for demonstrating advances in the art of air pollution control. For a source operation subject to a SOTA technical manual, case-by-case SOTA demonstration is not required if the applicant shows conformance with the SOTA specified in the manual.

The environment benefits from the SOTA technical manuals because they specify emission performance levels that reflect emission levels achieved by the best performing sources, with the best pollution prevention measures and air pollution control apparatus.

SOTA manuals are updated periodically to ensure the State of the Art performance limits are the best available.

The General State of the Art Manual includes information on SOTA Requirements, SOTA Workgroup, Applicability of SOTA, SOTA Documentation, Case-by-Case SOTA and Scope.
