Transferring Ownership of Air Preconstruction Permits
Air preconstruction permits issued in accordance to N.J.A.C. 7:27-8.1 et seq. are transferable from one owner to another at the same location.
To transfer this permit to a new owner at the same location within 120 days of ownership change, a Non Technical Amendment Application for Non-Major Facilities must be submitted to the Department.
N.J.A.C. 7:27-8.21 Amendments
(a) An amendment allows a permittee or a registrant to proceed with a change to a permitted source, or to its permit or certificate, or to a registration, provided that the permittee or registrant submits a notice of the change within 120 days after the start of the change. This subchapter refers to such a notice as a notice of amendment.
(b) A permittee shall notify the Department of the following changes as an amendment:
A transfer of ownership or operational control of the source or the facility;
If the Non Technical Amendment Application Form is not submitted within 120 days of the transfer of ownership or operational control of the source or the facility, then the current permits will no longer be valid and you will need to obtain new air pollution permits. Do Not Submit a Check
The Permittee should return the invoice along with the base fee to the address on the invoice.
After a Permittee submits a completed Non-Technical Amendment, the Department will assess and
invoice the Permittee for the base fee due to the Department. Invoices will be sent to the Fee/Billing Contact.
Please note that air pollution permits are not transferable from one location to another location, unless specifically allowed in the Compliance Plan.
