Consumer Products,
Portable Fuel Containers & Architectural Coatings Registration and Date Code Reporting
The Department has adopted amendments to its rules at N.J.A.C. 7:27-24 Prevention
of Air Pollution from Consumer Products which became effective on May 3,
2004. The Department has also adopted amendments to its rules at N.J.A.C.
7:27-23 Prevention of Air Pollution from Architectural Coatings which will
become effective on June 21, 2004.
Pursuant to N.J.A.C. 27-24.5(a), any manufacturer of a chemically formulated
consumer product that is subject to N.J.A.C. 7:27-24.2(b)1, that is sold
in New Jersey for use in New Jersey, shall submit an electronic registration
and explanation of the date code for the date of manufacture to the Department
after the operative date of the rule, June 6, 2004. Pursuant to N.J.A.C.
27-24.10(c), any manufacturer of a portable fuel container who uses a date
code on the container or its packaging, in lieu of using the date of manufacture,
shall submit an electronic registration and explanation of the date code
for the date of manufacture to the Department after the operative date of
the rule, June 6, 2004. Pursuant to N.J.A.C. 27-23.6(c), any manufacturer
of an architectural coating who uses a date code on the coating container,
in lieu of using the date of manufacture on the container, shall submit an
electronic registration and explanation of the date code for the date of
manufacture to the Department after the operative date of the rule, July
20, 2004. The registration information shall be submitted electronically,
unless electronic submission would impose hardship on the manufacturer, and
the Department approves a request from the manufacturer to submit the information
on paper. The registrations shall be submitted as follows:
- For products sold in New Jersey prior to January 1, 2005, the registration
shall be submitted prior to January 1, 2005;
- For products sold in New Jersey on or after January 1, 2005, that were not
sold in New Jersey prior to January 1, 2005, the registration shall be submitted
prior to selling the product in New Jersey;
- A manufacturer who, after the submission of its registration, begins to
manufacture a product for sale in New Jersey which changes the original
registration information, or if any of the information provided in the
registration changes, shall submit a revised registration including the new
information within 90 days of the change;
- Any information submitted as part of the registration shall not be claimed
to be confidential, pursuant to N.J.A.C. 27-23.6(c) and N.J.A.C. 27-24.5(b);
Also, please note, although manufacturers' date codes may include information
other than the date of manufacture, the Department is only requiring the
explanation of the date of manufacture.
- The appropriate form, shown below, must be filled out electronically and
submitted electronically in accordance with N.J.A.C. 7:27-23.6(c), 24.5(a)
and 24.10(c). Preferably, the Department would like the forms submitted by
