The NJ Department of Environmental Protection is proposing to amend its rules at N.J.A.C. 7:27-9, Sulfur in Fuels, specifically N.J.A.C. 7:27-9.2, to lower, and thus make more stringent, the maximum sulfur content standard and maximum sulfur dioxide (SO2) emissions standards for fuel oil sold for use in New Jersey.  Both the existing and the proposed amended standards are based on the grade of the fuel oil; that is numbers 1, 2, 4, 5 and 6 grade fuel oils.  The Department is proposing a first phase of more restrictive maximum sulfur content standards for all grades of fuel oil (except No. 5, No. 6 and heavier grades in Zones 3, 4 and 6), to take effect  July 1, 2014.  This includes reducing the sulfur content in No. 2 oil (home heating oil) and lighter grade fuel oil from over 2000 parts per million (ppm) to 500 ppm in the first phase.  The Department is also proposing a second phase of more stringent maximum sulfur content standards to 15 ppm for No. 2 and lighter grade fuel oil, to take effect July 1, 2016.  Analogous changes to the maximum SO2 emissions standards, would also be effective July 1, 2014 and July 1, 2016.  The proposed amendments affect those who store, offer for sale, sell, deliver or exchange fuel oils for use in New Jersey, as well as the users of these fuel oils.

New Jersey Vehicle Inspection and Maintenance (I/M) Program - Rule Changes, I/M Program Modeling and Revised Performance Standard Modeling

The Department of Environmental Protection (Department) is proposing a revision to the State Implementation Plan (SIP) to implement changes to its vehicle inspection and maintenance (I/M) program. Changes are being proposed to both Department and Motor Vehicle Commission (MVC) rules to implement these changes that include the following:

  • Emission tests will no longer require the use of a dynamometer.
  • Emission tests will include On-Board Diagnostics (OBD), gas cap, visible smoke and two-speed idle (TSI) tailpipe tests.
    Repair cost waiver provisions have been removed.
  • Gas cap testing is excluded for vehicles of model year 2001 and newer.
  • Certain classes of vehicles will require annual (more frequent) inspection.
  • Light duty diesel vehicles will now be subject to emission testing.

This SIP revision consists of the Department rule changes, the MVC rule changes, and an analysis showing the emissions impact of the proposed changes to the program. This analysis evaluates the emission impacts of the proposed enhanced I/M program changes by comparing emission factors for the existing and proposed programs. The results indicate that the proposed changes to the enhanced I/M program do not compromise the State’s efforts to meet and/or maintain National Ambient Air Quality Standards for ozone or carbon monoxide.

NOx Budget Program

The Department is proposing to repeal N.J.A.C. 7:27-31.23, the expiration of the NOx Budget Program. The Clean Air Interstate Rules (CAIR) at N.J.A.C. 7:27-30 is to replace the NOx Budget Program on January 1, 2009. The Federal CAIR program, as established in the Federal rules, was vacated by the U.S. Court of Appeals for the D.C. Circuit on July 11, 2008 (State of North Carolina v. Environmental Protection Agency, 531 F.3d 896 (D.C. Cir. 2008)), along with the Federal Implementation Plan (FIP). Accordingly, the Department proposes to repeal the December 31, 2008 expiration of the NOx Budget Program, in order that the NOx Budget Program remains applicable during the 2009 ozone season, which begins on May 1, 2009.

Regional Haze

A SIP revision to protect and enhance visibility levels in the Brigantine Wilderness Area of the Edwin B. Forsythe National Wildlife Refuge, a federally designated Class I area. The purpose of this SIP revision is to establish the first Reasonable Progress Goal within the Class I area to help achieve the Congressionally mandated goal of reaching natural background visibility levels by the year 2064. The SIP revision demonstrates that New Jersey will meet the 2018 Uniform Rate of Progress set for Brigantine Wilderness Area by the deadline established in the USEPA regulations. The SIP revision also addresses other mandatory SIP elements for regional haze.

The remainder of the SIP revision addresses the other mandatory SIP elements for 8-hour ozone (with the exception of a Reasonable Available Control Technology (RACT) analysis, which the Department proposed on February 2, 2007 and submitted as final to the USEPA separately) and other related issues.

The Federal Clean Air Interstate Rule (CAIR) program, as established in the Federal rules, starts in 2009 for the annual and ozone season NOx control periods, and 2010 for the annual SO2 control period, and prescribes the participation by New Jersey’s large stationary combustion units in the Federal CAIR cap and trade programs at 40 CFR Part 97, which are designed to reduce emissions of NOx and SO2 in the eastern half of the United States. The Department's rules allocate the NOx allowances differently than the Federal rules to satisfy the Federal requirements for an abbreviated SIP for CAIR (40 CFR Part 97 Subpart EE and Subpart EEEE).

Transport SIP Letter

This letter describes the State's plan for addressing the transported emission requirements prescribed in Section 110(a)(2)(D)(i) of the Clean Air Act. This letter was sent to the EPA Region 2 by Commissioner Jackson on December 22, 2006. The transported emissions related actions will be part of various SIP proposals, including but not limited to the RACT proposal (submitted to the EPA on February 7, 2007), the CAIR rule proposal (submitted to the EPA on February 7, 2007) and the Regional Haze proposal (due to the EPA by December 2007). All these SIP proposals have, or will, go through a public comment process prior to being finalized for submission to the EPA
