Roles and Responsibilities

The creation and implementation of municipal public access plans and the subsequent permitting, where necessary, for enhancements and new locations involves local municipal governments, counties, State agencies, and stakeholders -- both the general public and concerned non-profits. Each involved entity has interconnected responsibilities in assuring the effectiveness of the plans.

Upon receipt by the Department of the resolution incorporating the approved Municipal Public Access Plan into the municipality’s Master Plan, public access required to satisfy the conditions of a coastal permit for development in the municipality for permit applications filed with the Department subsequent to the Department’s receipt of the resolution shall be provided in accordance with the Municipal Public Access Plan. The Department shall include on the posted Department-approved Municipal Public Access Plan, the date of receipt of the resolution.

Public Access in New Jersey: the Public Trust Doctrine and Practical Steps to Enhance Public Access provides an indepth review of the roles and responsibilities in developing and implementing public access in New Jersey.  It was prepared in 2006 by the Coastal Management Office of the New Jersey Department of Environmental Protection, and Principal Investigator: Robert Freudenberg – NOAA Coastal Management Fellow 2004-2006.
