2005 Biennial HazardousWaste Report

Q: What will happen if I do not submit a Biennial Hazardous Waste Report?

A: The Department of Environmental Protection (Department) relies on the New Jersey Hazardous Waste Manifest System to determined the likelihood of a site being a RCRA LQG. However, the New Jersey Hazardous Waste Manifest System depicts hazardous waste transported, not generated, so further inquiry is sometimes required by the Department if a site does not submit a Biennial Hazardous Waste Report. If the Department deems that a site is a potential RCRA LQG and this site does not submit a Biennial Hazardous Waste Report by March1st for the reporting year in question, then these cases are commonly referred by this office to the Department’s enforcement branch for clarification regarding that site’s reporting status for that reporting year.

Q: How do I obtain forms and instructions to complete the Biennial Hazardous Waste Report?

A: The Department mails a Biennial Hazardous Waste Report Booklet, which includes all the necessary forms and instructions, to all generators that are deemed to be potential RCRA LQG’s usually around the January 1st prior to the March 1st submittal deadline for the Biennial Hazardous Waste Report. If your site does not receive a copy of this booklet before the aforementioned deadline and you have determine that your site is a RCRA LQG for the reporting year, then you may downloaded these forms and instructions from the Environmental Protection Agency’s (EPA) webpage located at www.epa.gov/epaoswer/hazwaste/data/br05/forms.htm). Sites that receive a Biennial Hazardous Waste Report Booklet that are not an RCRA LQG should complete the site identification form in the rear of the booklet and return it to this office. Please contact this office should you require any further assistance.

                    Q: Why does the Department collect this information?

A: The gathering of this information is required by law in accordance with the Resource Conservation and Recovery Act of 1976 and aids the Department in the "cradle-to-grave" tracking of hazardous waste in New Jersey. The Department also uses this information for a multitude of research projects and it assists in determining hazardous waste facility (TSDF) capacity assurance issues for New Jersey.

Q: What if I purchased or sold a property that generated hazardous waste and the site is required to submit a Biennial Hazardous Waste Report?

A: Environmental issues are usually dealt with at settlement of the property. However, if a Biennial Hazardous Waste Report is required to be submitted for the site in question, the current owner of the site will be contacted by the Department and be requested to resolve any outstanding Biennial Hazardous Waste Reporting issues for that site.

Q: What is acute hazardous waste and what are the reporting differences between acute and non-acute hazardous waste

A: Acute hazardous waste is normally designated by a "P" number as its waste code. Acute hazardous waste is a category of hazardous waste that can exerts its toxicity with exposure to smaller quantities and in a shorter period of time than non-acute hazardous waste. This category of hazardous waste for the reasons mentioned has different reporting requirements. Sites that generate in any single calendar month, or accumulated at any time, 1 kg (2.2 lbs.) of acute hazardous waste are a RCRA LQG and must submit a Biennial Hazardous Waste Report to the Department for that reporting year.

                    Q: Where should I mail my report when I have completed filling it out?

A: All reports and fees should be mailed to the following address unless otherwise instructed by the Hazardous Waste Report Unit:

                    Q: What report Forms (GM, OI, WR, Site Identification) do I need to complete?

A: All RCRA LQG’s must properly complete Site Identification Form and Form GM (Waste Generation and Management) for a Biennial Hazardous Waste Report to be considered administratively and technically complete. Furthermore, one Form GM must be completed for each waste (code) type generated at the site. Form WR (Waste Received From Off Site) should only be completed by sites that are permitted to receive hazardous waste as a RCRA Transport, Storage, Disposal Facility (TSDF). The completion of Form OI (Off-Site Identification) is not required.

                    Q: Should I report waste types that have an "X" or "ID" designation?

A: "X" (i.e., X900, X910, etc.) and "ID" (i.e., ID27, ID72, etc.) waste codes have in the past been used as designations on hazardous waste manifests for shipping New Jersey solid wastes to disposal facilities. However, All "X" waste codes are invalid and should not be used. Wastes that are generated during a report year that display an "X" or "ID" should not be reported or counted towards a site’s hazardous waste generation totals.

Q: Should I report all of the hazardous waste I shipped by manifest during the applicable reporting year?

A: It is probably necessary to report all the hazardous waste you manifested during the applicable reporting year. The Biennial Hazardous Waste Report requires a LQG of hazardous waste to not only report the quantity of hazardous waste that they generated during the applicable reporting year, but also the amount shipped (manifested). RCRA LQG’s should properly fill out the Form GM to reflect the amount of hazardous waste manifested, even if no waste was generated for that waste type during that reporting year.

Q: Who needs to sign off on the completed Biennial Hazardous Waste Report forms?

A: The completed Biennial Hazardous Waste Report has to be signed by a representative from the company who has a familiarity with the hazardous waste generated and has been given authority to sign-off on such matters by the company. A Biennial Hazardous Waste Report will be considered administratively incomplete without a signature.
