Administrative Review of TWA Applications
The TWA Administrative Review Unit maintains and updates the Department's NJEMS database program for Treatment Works applications, and provides internal processing and tracking reports.
The Unit performs the administrative reviews on all treatment works approval (TWA) applications, including requests for TWA modifications and one-year time extension requests. The Unit also processes and issues the General Industrial TWAs and administers the Expedited TWA program. In addition, the Unit also processes the certification of water pollution abatement facilities for Claim for Tax Exemption from the local taxing district. |

This Unit also processes the Determination of Environmental Benefit of the reuse of further treated effluent in industrial facilities, which can be submitted to the New Jersey State Department of Treasury, Division of Taxation for a corporate business tax credit and/or sales tax refund for the eligible treatment or conveyance equipment purchased for the exclusive purpose of reusing further treated effluent in industrial processes.
- A Determination of Environmental Benefit on the reuse of further treated effluent in industrial facilities is performed in accordance with
the administrative requirements of N.J.A.C.7:14D et seq. This determination is needed for the submission of a request to the New Jersey State Department of
Treasury, Division of Taxation for a corporate business tax credit and/or sales tax refund for the eligible treatment or conveyance equipment purchased for
the exclusive purpose of reusing further treated effluent in industrial processes. For a copy of the Determination of Environmental Benefit application form DEB-1, please click here.
- Administrative review of TWAs is performed in accordance with the administrative requirements of TWA regulations (N.J.A.C. 7:14A-22 et seq.) The
submission of an administratively complete application is essential for the proper
and timely processing of TWA applications (please see Common TWA Application Deficiencies for more
information).
- Administrative processing of General Industrial TWAs are performed in accordance with N.J.A.C. 7:14A-22.6 and are issued within 30 days of a
complete submittal. There are instances where a general industrial TWA is not required (see N.J.A.C. 7:14A-22.4(b)) and times when, due to the potential for health
risk, environmental impact or past performance of a facility, a full TWA technical processing will be required. However, a majority of industrial TWA applications
are processed as General Industrial TWAs.
- The Expedited TWA Program, developed in consultation with the New Jersey Society of
Professional Engineers, the New Jersey Society of Municipal Engineers, and the Consulting Engineers Council of New Jersey, is available
for "minor" TWA applications. At this time, the "minor" types of TWA submittals to be processed under this program include sewer extensions
less than 400 L.F. in length, or any lateral connections that require a TWA (regardless of maximum flow). The TWA applications submitted under this program will
be processed within 30 days of a complete submittal, of which includes a separate P.E. certification for the pilot expedited program. Please note that the submittal
of such applications is by appointment only.
