This clarification is issued by the New Jersey Department of Environmental Protection, Division of Water Quality to establish its wastewater and stormwater aqueous sample analysis requirements for Total Petroleum Hydrocarbons (TPHC) as applied under New Jersey Pollutant Discharge Elimination System regulations at N.J.A.C. 7:14A.

The New Jersey Department of Environmental Protection is proposing to readopt with amendments the New Jersey Pollutant Discharge Elimination System (NJPDES) rules at N.J.A.C. 7:14A. The proposal was published in the March 17, 2008 New Jersey Register (40 NJR1478(a)).

blue arrow2/28/08 Sanitary Subsurface Disposal (T1) General Permit Renewal

The Bureau of Nonpoint Pollution Control has issued a draft renewal of the Sanitary Subsurface Disposal (T1) General Permit. This permit regulates sanitary wastewater discharges with a design volume in excess of 2,000 gallons per day, which were authorized and approved by local administrative authorities prior to January 1, 1990. blue arrow2/7/08 Status Report Summary 2004-2007

The New Jersey Department of Environmental Protection's Municipal Stormwater Regulation Program is designed to address the impacts of stormwater-borne pollution on our State's waterways. Each permittee is required to submit an Annual Report and Certification indicating the status of the implementation of each Statewide Basic Requirement as well as additional supporting data. The Department has compiled this data into the Status Report Summary and online database which can be found by following the link below.

blue arrow1/10/08 Impacts of USEPA Methods Update Rule (MUR) on NJPDES Permits

The USEPA has issued a final MUR that revised the list of approved analysis and sampling procedures in wastewater regulations. These rules make significant changes in test procedures for analysis and sampling for pollutants in wastewater and sludge. A large number of methods of analysis have been deleted for use in regulatory compliance testing and have been replaced by alternate more up-to-date methods. In addition, a number of new test methods have been added and procedures for the preservation of samples and holding times for several analytes have been changed. The analytical method changes made in these rules will impact your laboratory's certification, may require changes to your laboratory's procedures as well as the compliance monitoring performed under your NJPDES permit.

blue arrow1/7/08 NJPDES General Permit for Dental Facilities discharging to Onsite Wastewater Treatment Systems – Cat K2

The Bureau of Nonpoint Pollution Control has finalized the NJPDES General Permit to regulate those who discharge wastewater to the ground water from new or existing dental facilities using individual subsurface sewage disposal systems, i.e. “septic systems”, or Class V Underground Injection Control (UIC) wells.  Examples of these systems include septic tanks with seepage pits, disposal fields, leach or tile fields (or an equivalent distribution mechanism); cesspools; dry wells; injection wells and infiltration galleries.  This permit was developed to remove dental amalgam prior to entering the waste stream by requiring dental facilities that generate amalgam waste to implement Best Management Practices (BMPs) and install an amalgam separator.

blue arrow12/07/07 Dental Wastewater Survey

On October 1, 2007, the New Jersey Department of Environmental Protection adopted the Dental Amalgam rules, and also finalized a NJPDES Discharge to Ground Water General Permit for dental facilities that discharge to on-site septic systems. In an effort to provide compliance assistance to the regulated community, the Department mailed a Dental Wastewater Survey to all licensed dentists in the State. If you have not yet returned your completed survey, please do so as soon as possible, as this is a mandatory requirement.

blue arrow11/02/07 Proposed NJPDES Annual Fee Report and Assessment of Fees for Fiscal Year 2008

The proposed NJPDES Annual Fee Report and Assessment of Fees has been mailed to all NJPDES Permittees for Fiscal Year 2008. The total NJPDES fee assessments are projected to be $21.6 million dollars. A public hearing on the FY2008 Annual Fee Report will be held on Wednesday, December 5, 2007 beginning at 1:30 p.m. at the Department. The public comment period will be open until December 10, 2007. blue arrow10/10/07 Dental Mercury Regulations Now in Effect

The Department adopted revisions to the NJPDES regulations that became effective October 1, 2007 that set forth specific requirements for mercury and amalgam waste collection and management for all dental facilities that place or remove amalgam fillings. Dental amalgam contains approximately 50% mercury. These new requirements will affect approximately 3,400 dental facilities in New Jersey, and will result in removal and recycling of approximately 2,550 pounds of mercury per year.  The new regulations were published in the October 1, 2007 New Jersey Register at 39 N.J.R. 4117(a) and can be found under N.J.A.C. 7:14A-21.12.

blue arrow8/24/07 Proposed Revisions to Technical Manual for Phosphorus Evaluations

The Department is proposing for public comment revisions to the 2003 Phosphorus Evaluation Manual. This technical manual is used to determine whether or not phosphorus criteria shall be applied to specific wastewater discharges, in accordance with the existing criteria at N.JA.C. 7:9B. The Department is soliciting public comment for a two week period beginning with the date of the notice in the DEP Bulletin. Comments should be submitted to Pilar Patterson at 401 East State Street, P.O. Box 029, Trenton, NJ 08625. blue arrow8/16/07 Clean Water New Jersey Awards  

The New Jersey Department of Environmental Protection is pleased to announce the first annual “Clean Water New Jersey Awards.”  These awards, which are part of the Clean Water NJ Initiative, are designed to recognize municipalities, Public Complexes and Highway Agencies for their efforts in improving New Jersey’s water quality.  Eligible municipalities, Public Complexes and Highway Agencies  are those that have implemented stormwater control measures under the New Jersey Pollutant Discharge Elimination System (NJPDES) Municipal Stormwater Regulation Program (Program).  The Department realizes that the requirements associated with the Program permits are comprehensive and, at times challenging. This award program is intended to recognize those programs that either go above and beyond the basic permit requirements; and/or have developed innovative approaches that have resulted in more efficient processes, significant cost savings, or mechanisms that promote cost-sharing or shared services.

Awards will be presented to municipalities in the following categories:

arrow Post-Construction in New Development and Redevelopment
arrow Local Public Education
arrow Illicit Connection and Outfall Pipe Mapping Program (Tier A Municipalities only)
arrow Maintenance Yard/Public Works Operations (Tier A Municipalities only)

Awards will be presented to Public Complexes and Highway Agencies in the following categories:

arrow Local Public Education (limited to Colleges, Universities and Military Bases)
arrow Illicit Connection and Outfall Pipe Mapping Program
arrow Illicit Connection and Outfall Pipe Mapping Program
arrow Maintenance Yard Operations (including Solids and Floatables Control)

The following nomination forms provide details on the Awards Program. All completed applications and supporting materials must be submitted to the Department no later than September 28, 2007.  Municipalities receiving awards will be honored at the League of Municipalities Conference on November 15, 2007.  Public Complexes and Highway Agencies receiving awards will be honored at a separate ceremony at the New Jersey Department of Environmental Protection.

blue arrow3/5/07 Basic Industrial Stormwater General Permit (NJ0088315) Renewal

The Bureau of Nonpoint Pollution Control has issued a draft renewal of the Basic Industrial Stormwater General Permit issued in accordance with N.J.A.C. 7:14A. The public comment period is scheduled to begin on March 7, 2007 and end on April 6, 2007. The procedures for submitting comments or requesting a public hearing on this draft permit are detailed in the public notice. As part of the permit renewal the Department will be making changes to the permit. A discussion of the changes and the basis for the permit renewal may be found in the Fact Sheet and the Summary of Changes document.

blue arrow11/15/06 MSRP 2005 - 2006 Summary Reports

As a result of much coordination among local governments in New Jersey, the Municipal Stormwater Regulation Program has completed its 2005 and 2006 survey of entities that discharge stormwater from municipal separate storm sewers (MS4s). For more information about the results of survey, the Municipal Stormwater Regulation Program has compiled two summary reports detailing results from 2005 and 2006 Annual Report submittal.

1/3/2006 TWA Minimum Fees Revised
The 90-day Construction Permit Regulations (N.J.A.C. 7:1C) were readopted with amendments on January 3, 2006 (see 38 NJR 134). The Department held a public hearing on August 15, 2005 on the proposed changes, followed by a public comment period. The following changes in the TWA fees are effective January 3, 2006:

  1. Minimum fee for TWAs has increased to $850.00;
  2. One-Year Extensions of time for all TWAs are now $200.00;
  3. Fees for TWA modifications are calculated by taking the "construction cost of the project change(s)" and plugging that figure into the existing fee schedule formula, with a $500.00 minimum fee for TWA modifications.
