there a discharge of a hazardous substance?.[N.J.A.C.

No person shall cause,
suffer, allow or permit a discharge of a hazardous substance.[N.J.A.C.

| Was
the base underlying a hazardous substance storage tank
made of or surfaced with a material impermeable to passage
or chemical attack by the stored hazardous substance?.[N.J.A.C.
7:1E- 2.2(a)2] |
The base
underlying the storage tank shall be made of or surfaced
with a material impermeable to passage or chemical attack
by the stored substance under the conditions of storage
prevailing within the tank. Existing storage tanks shall
be exempt from this requirement until such time as they
may require substantial reconstruction or replacement,
unless the Department orders a storage tank removed from
service because of the likelihood of a discharge. Before
such a tank is returned to service, it must meet this

| Did
the major facility promptly begin clean-up of hazardous
substance discharge?.[N.J.A.C. 7:1E- 2.11(c)] |
Cleanup
of all leaks or discharges of hazardous substances shall
begin promptly upon detection. Loose quantities of hazardous
substances shall not be allowed to persist on grounds,
floors, walls or equipment, or any other places within

Except
as delineated in (e) below, immediately after a discharge
commences, any person or persons responsible for a discharge
who knows or reasonably should know of the discharge,
shall immediately notify the Department at (609) 292-7172.
In the event that this number is inoperable, any person
or persons responsible for a discharge shall immediately
notify the State Police at (609) 882-2000.[N.J.A.C. 7:1E-

| New Jersey’s hazardous
waste regulations are found at N.J.A.C. 7:26G-1 et seq., adopted October
21, 1996 and announced at 28 NJR 4606. By this adoption, the Department
“incorporated by reference” (with limited exception) the
July 1, 1993 version of the Federal hazardous waste regulations at 40
CFR Parts 124, 260-266, 268 and 270, mandated by the Resource and Recovery
Act of 1976 (RCRA) and amended by the 1984 Hazardous and Solid Waste
Amendments (HSWA). Effective January 19, 1999 the Department amended
the regulations to allow for prospective incorporation by reference,
which means that all provisions of 40 CFR Parts 124, 260-266, 268 and
270 incorporated by reference are continually automatically updated
in order to maintain consistency with the most current Federal rules.
The requirements for hazardous waste generators are specifically
found at N.J.A.C. 7:26G-6 et seq., which references 40 CFR Part 262
of the Federal regulations (with some exceptions and/or changes).
