| Are
universal waste batteries managed in a way
that prevents releases of any universal waste

waste or component of a universal waste to

leaking and/or damaged universal waste batteries
placed in containers that are closed, structurally
sound, compatible with the contents and in

A
small quantity handler of universal waste
shall contain any universal waste battery
that shows evidence of leakage, spillage,
or damage that could cause leakage under reasonably
foreseeable conditions in a container. The
container shall be closed, structurally sound,
compatible with the contents of the battery,
and shall lack evidence of leakage, spillage,
or damage that could cause leakage under reasonably

determine if removed electrolyte or other
solid waste is hazardous? If so,
is it managed in accordance with 7:26G?.[N.J.A.C.

A
small quantity handler of universal waste
who removes electrolyte from batteries, or
who generates other solid waste (for example,
battery pack materials, discarded consumer
products) as a result of the activities listed
above, shall determine whether the electrolyte
and/or other solid waste exhibit a characteristic
of hazardous waste identified in 40 C.F.R. Part
261, subpart C as incorporated by reference
at N.J.A.C. 7:26G-5 as follows: (1) If the
electrolyte and/or other solid waste exhibit
a characteristic of hazardous waste, it is
subject to all applicable requirements of
N.J.A.C. 7:26G. The handler is considered
the generator of the hazardous electrolyte
and/or other waste and is subject to the hazardous
waste requirements of N.J.A.C. 7:26G-6; or
(2) If the electrolyte or other solid waste
is not hazardous, the handler may manage the
waste in any way that is in compliance with
N.J.A.C. 7:26[N.J.A.C. 7:26A-7.2(d)1iii] |

universal waste batteries, or containers in
which the batteries are contained, properly
labeled or marked clearly with the words "Universal
Waste-Battery(ies)" or "Waste Battery(ies)"

Universal
waste batteries (that is, each battery), or
a container in which the batteries are contained,
shall be labeled or marked clearly with any
one of the following phrases: "Universal Waste-Battery(ies),"
or "Waste Battery(ies)," or "Used Battery(ies)";[N.J.A.C.

| New Jersey’s hazardous
waste regulations are found at N.J.A.C.
7:26G-1 et seq., adopted October 21, 1996
and announced at 28 NJR 4606. By this adoption,
the Department “incorporated by reference”
(with limited exception) the July 1, 1993
version of the Federal hazardous waste regulations
at 40 CFR Parts 124, 260-266, 268 and 270,
mandated by the Resource and Recovery Act
of 1976 (RCRA) and amended by the 1984 Hazardous
and Solid Waste Amendments (HSWA). Effective
January 19, 1999 the Department amended
the regulations to allow for prospective
incorporation by reference, which means
that all provisions of 40 CFR Parts 124,
260-266, 268 and 270 incorporated by reference
are continually automatically updated in
order to maintain consistency with the most
current Federal rules.
The requirements for hazardous waste
generators are specifically found at N.J.A.C.
7:26G-6 et seq., which references 40 CFR
Part 262 of the Federal regulations (with
some exceptions and/or changes).
