The Freshwater Wetlands Protection Act (Act), N.J.S.A. 13:9B-1 et seq., mandates at N.J.S.A. 13:9B-23 that the Department issue two general permits allowing limited disturbances in certain types of freshwater wetlands. These general permits have been adopted as GP 6, Non-tributary wetlands and GP 7, Human-made ditches or swales in headwaters (see the Freshwater Wetlands Protection Act regulations at N.J.A.C. 7:7A-5.6 and 5.7, respectively). However, the Act also provides that these two general permits "shall not apply to any wetlands designated as priority wetlands by the United States Environmental Protection Agency." (N.J.S.A. 13:9B-23b.)

The EPA Priority Wetland list recognizes those areas identified by various Federal, state and private contributors which are considered to be the most important and vulnerable wetlands in the State. This is not a comprehensive inventory; rather it is a listing of areas currently known to EPA to be important and/or under particular threat. It must be noted that failure to include any particular area on the list in no way implies that it will get less protection under the State Freshwater Wetlands Protection Act program. The list will be updated periodically.
