PROGRAM DESCRIPTION:
The Environmental Claims Administration (ECA) administers two financial assistance programs that are available to businesses, individuals and government entities of the state. The Spill Compensation Fund (Spill Fund) N.J.A.C. 7:1J, pays for environmental damages to innocent victims resulting from the discharge of petroleum products and other hazardous substances. The Sanitary Landfill Facility Contingency and Closure Fund (Sanitary Landfill Fund) N.J.A.C. 7:1I, pays compensation for damages resulting from the improper operation or improper closure of any governmentally approved landfill facility. Typical damages for both funds include the cost to restore, repair or replace real estate or personal property, including the fair market value of such property and natural resources; mainly contaminated drinking water supply sources. Both funds evaluate damages through a claim application and review process. A mandatory one-year filing requirement applies to both Funds and responsible parties are not eligible for payment from either Fund. Local government entities, such as Haz Mat or fire departments, may also be eligible for priority review of its Spill Fund claims pursuant to the Emergency Response provisions of the Spill Act, N.J.S.A. 58:10-23.11kl and N.J.A.C. 7:1J-5. MONETARY ASSISTANCE PROVIDED:
Monetary assistance is provided to eligible claimants in the form of compensation (grants) based on the evidence provided to support the damages. Speculative or contingent damages are not eligible for compensation. Typically, if a claim is determined to be valid, the amount eligible for payment is based on a comparison of three proposals to remedy the damages or a technical review of the scope of work for approved remediation. All cleanup work claimed as damages must comply with Technical Requirements for Site Remediation, N.J.A.C. 7:26E, to be considered for compensation from the funds. In all cases, other sources of compensation must be exhausted before the funds can pay for damages.
