PROGRAM DESCRIPTION:
The Mandatory Retrofit Program implements the requirements of the Diesel Retrofit Program Rules at N.J.A.C. 7:27-32. These rules require owners of certain diesel vehicles and equipment to install control devices to reduce the emissions of fine particulate matter. The vehicles/equipment regulated by this program are: all privately and publicly owned school buses; publicly-owned solid waste collection vehicles; privately-owned solid waste collection vehicles that are used in a public contract; publicly and privately-owned commercial buses; and all publicly-owned on-road vehicles and off-road equipment.
All school buses are required to install closed crankcase ventilation systems. All other vehicle and equipment types are required to install tailpipe control devices, often referred to as retrofit devices. The vehicle owners will be required to submit information regarding their fleet to the department, along with a description of the particular device that will be installed to meet the requirements of the rules.
The vehicle owner must have the retrofit device installed by an authorized installer, who will incur the purchase and installation costs of the devices. The department, in turn, will reimburse the authorized installer for these costs once the installation is complete. All eligible control devices and authorized installers will be listed on a State Contract to be awarded in the Fall of 2007.
The vehicle owner is required to have the installation verified during its next regularly scheduled inspection. Annual updates of the fleet inventory are also required.
Compliance deadlines are contingent on the date the rule becomes operative. For example, a public entity that owns solid waste collection vehicles must submit a fleet inventory and a description of the control device to the department within six months of the effective date of the rule. However, a public entity that has on-road vehicles or off-road equipment that are not solid waste collection vehicles, must submit their information four years from the effective date of the rule. Installation of the control devices would be required once the department approves the submittal and certifies available funding.
MONETARY ASSISTANCE PROVIDED:
The purchase and installation costs associated with the required technology are reimbursed to the authorized installers of the device. If a local government chooses to become an “authorized installer” per the definition and requirements established within the rules, then the agency may apply to the department to recoup the applicable costs. However, the public agency must have an established grant agreement with the department in order to be eligible for a reimbursement.
PERMITTING RESPONSIBILITIES:
There are no permits associated with this program, however, the department must approve the submittals outlined above before the vehicle owner can proceed with installation.
