Permit Extension Act of 2008: "Environmentally Sensitive Area"

The Permit Extension Act of 2008 does not extend approvals within “environmentally sensitive areas.”  Using the provisions of the Permit Extension Act, the Department developed a map and a GIS data layer showing the extent of these areas.

This map and the data layer represent the “environmentally sensitive area” as defined by the Permit Extension Act of 2008 (P.L. 2008, c.78).  The information provided on the map and the data layer can be used to interpret the provisions of the Permit Extension Act as it relates to approvals issued within an environmentally sensitive area.

The mapped environmentally sensitive areas are:

The following Pinelands Management Areas within the State Pinelands Boundary:

  • Agricultural Production Area
  • Federal or Military Facility
  • Forest Area
  • Pinelands Town
  • Pinelands Village
  • Preservation Area
  • Rural Development Area
  • Special AG Production Area

The following areas in the Highlands region:

  • Highlands Planning Area
  • Highlands Preservation Area

The following State Planning Areas:

  • Environmentally Sensitive (Planning Area 5)
  • Rural/ Environmentally Sensitive (Planning Area 4B)

The following Critical Environmental and Historic Sites:

  • Environmental/Historic Site
  • Environmental Site

The Department has not verified the accuracy of the digital layers depicted with the data stewards including the Office of Smart Growth, the Highlands Council and the Pinelands Commission.   Refer to the source layer metadata for detail descriptions of the data attribute and spatial extent limitation. 

Alternatively, the Department’s environmental mapping tool i-MapNJ DEP can be used to determine whether or not a site or portion of a site is located in an environmentally sensitive area as defined by the Permit Extension Act.
