INTRODUCTION
Naturally occurring
and accelerator produced radioactive material (NARM) is regulated
by the New Jersey Department of Environmental Protection (DEP).
The DEP derives its authority from the Radiation
Protection Act (New Jersey Statutes Annotated Title 26:2
D), and its regulations are contained in the Radiation Protection
Code (New Jersey Administrative Code Title 7 Chapter 28). Depending
on the radionuclide, quantity, and the form, a license is required
in order to manufacture, produce, transfer, receive, acquire,
own, possess, store, or use NARM. New Jersey is not an
Agreement State (any state with which the Atomic Energy Commission
or the Nuclear Regulatory Commission has entered into an effective
agreement under subsection 274b of the Act. Non-agreement State
means any other State), therefore source, special nuclear or
byproduct radioactive materials (SSNBRM) are regulated by the
NRC.
However, all SSNBRM for which a specific NRC
license is issued must be registered with the DEP within 30
days after taking possession of the radioactive materials.
