WHAT TO DO IF OUR INSPECTORS FIND A VIOLATION AT YOUR FACILITY


DON'T PANIC - 99.9% of violations are resolved easily.

1. While some violations may be correctable by the facility, you will most likely have to call your service company to correct the items cited. You should call your service company as soon as possible after the inspection in order to ensure a timely correction of any non-compliance. REMEMBER:

A. If you were issued a Notice of Violation (NOV) at the close of the inspection, you have 30 calendar days to correct all violations cited.

B. If you were issued an Administrative Order, all corrections must be completed by the due date given.

C. If you were issued a Notice of Prosecution, all violations must be corrected within 30 calendar days of the issue date of the NOP.

2. You must reply in writing to the address in (3) below to tell us what actions you took to correct the non-compliance. Your letter needs to reach us within the time periods in (1) above.

3. Your response should be on your letterhead. Please include the NJ registration number of the unit(s) cited. If possible include a copy of the service invoice with your response. Send to:

4. If the item of non-compliance was the failure to perform a radiation safety survey, you must hire a qualified individual (this should be linked to the phys. list) to perform the survey and send a copy to the address in (3) above. Please keep the original on file at your facility.

5. If the necessary corrections cannot be completed by the due date, please notify the BRH in writing. State the reason why the corrections will not be completed (e.g., parts must be ordered) and request an extension. Each case will be considered individually and you will be notified if an extension is granted.

6. In most instances, the BRH will schedule a violation inspection with you to determine if the cited unit is in compliance with New Jersey Administrative Code 7:28.

7. The registrant is responsible for ensuring that their equipment is in compliance with NJAC 7:28 at all times. Compliance is determined solely through BRH inspection. Repeated violations of the same section of NJAC 7:28 may cause the Department to issue monetary penalties.
