Underground Storage Tanks (UST) 1998 Tank Upgrade Requirements

Compliance Options

In order to be in compliance as of December 22, 1998, you must complete one of the following:

  • Upgrade your UST system(s) with spill, overfill and corrosion protection; or
  • Install new UST system(s) and close all substandard UST system(s) ; or
  • Close your substandard UST system(s). Your closure options are:
    • Permanently close the system in accordance with the provisions of N.J.A.C. 7:14B-9; or

    • Go into temporary closure. During temporary closure you must:

      • Notify the Department of the temporary closure by submitting a Facility Certification Questionnaire.

      • Remove all product from the UST, disconnect all piping except the vent, and go into temporary closure; or

      • Cease use of the UST (no product dispensing or delivery). As long as product remains in the UST, monthly leak detection must be performed. If there is existing corrosion protection, it must be maintained. After three months of closure in this manner, all product must be removed to maintain temporary closure status. In addition, you must cap and secure lines, pumps, and ancillary equipment but leave the vent lines open.

    After 12 months of temporary closure, the UST must be closed permanently. If an extension for temporary closure will be requested, before the end of the 11th month of temporary closure, a site investigation report or leak detection records for the op

    Note: If any underground storage tank systems are currently "out of service" you must adhere to the timeframes listed in N.J.A.C. 7:14B-9.

  • For heating oil UST systems, request a conditional 5-year extension.
