Underground Storage Tanks (UST) UST LSRP Transition


 

Opportunity to Transition Regulated Underground Storage Tank (UST) Cases to the Licensed Site Remediation Professional (LSRP) Program

Following the May 7, 2009 signing of the Site Remediation Reform Act (SRRA) by Governor Corzine, the Bureau of Underground Storage Tanks is planning to transition most lower priority ground water and soil-only cases towards the LSRP Program by providing the following 2 options:

  1. Opt in to the LSRP Program by following Department guidance and temporary rules implementing the LSRP Program. The Department expects that these rules and guidance will be in-place by November 3, 2009; OR
  2. Complete the Remedial Investigation or Remedial Action (for cases with a Remedial Action Workplan Approval) independently on an extended 3-year, accountable schedule without submitting interim reports; unless otherwise required by the Department.

The Department is in the process of notifying, by letter, all responsible parties with “lower priority” cases of these two options. To determine if your regulated UST case is a “lower priority” ground water case, please refer to the Site Evaluation Criteria (SEC).

This Department initiated transition will not diminish the opportunity for cases of higher priority to opt in to the LSRP Program following applicable Department guidance and temporary rules that should be in-place by November 3, 2009. All existing cases three years after the effective date of SRRA and all new cases 180 days after the effective date of SRRA must be under the oversight of a LSRP.

Please note that pursuant to the SRRA, all existing cases, 10 years and older, are subject to a statutory timeframe (not subject to modification) that requires a remedial investigation to be completed within 5 years of the effective date of SRRA. In addition, all existing cases, regardless of age, must comply with any mandatory timeframes adopted by the Department in temporary rules.
