FUND
The New Jersey Department of Environmental Protection (NJDEP) is pleased
to provide you with a REVISED application for requesting financial assistance
from the Petroleum Underground Storage Tank Remediation, Upgrade and Closure
Fund (UST Fund). This application has been updated to include the amendments
and supplements to the original 1997 Act that was signed into law on August
15, 2003. On this Web site you will find copies of the following:
- UST Fund Fact Sheet (including Guidance
on what is and is not eligible under the UST Fund)
- Instructions and Application for NJDEP UST Fund (to be completed
by all applicants)
- Grant Certification (to be completed only
by applicants applying for a grant)
- General UST Fund Certification (to be completed
by all applicants)

ADDENDA TO APPLICATION
October 2006
IMPORTANT NOTICES
- As of October 3, 2006, due to the enactment of P.L. 2006, c.58, all
contractors performing work on non-regulated underground storage tanks,
including homeowner heating oil tanks, where the work is being funded
by the Petroleum Underground Storage Tank Remediation, Upgrade &
Closure Fund, must be certified in accordance with N.J.A.C. 7:14B-13.

Certified UST Firms" under the DEP Data Miner Reports in the
middle of the page.
- Please be advised that the enactment of P.L. 2006, c.58, requires
that in the case of a closure and replacement of any petroleum underground
storage tank used to store heating oil for onsite consumption in a residential
building, to the maximum extent feasible, the owner or operator shall
replace the petroleum underground storage tank with an above ground
tank.
- Please be advised that the enactment of P.L.2006, c.58, allows for
grants and loans for the closure and/or replacement of non-leaking petroleum
underground storage tanks used to store heating oil for onsite consumption
in residential buildings. This non-leaking tank program is being administered
by the New Jersey Economic Development Authority (NJEDA). Information
regarding this program can be found on the NJEDA web-site at http://www.njeda.com,
or by calling their Customer Care Representative at (609) 292-1800.
- Please be advised that applications to the Petroleum Underground
Storage Tank Remediation, Upgrade and Closure Fund must be submitted
prior to the performance of any work. The only exceptions to this requirement
are homeowners who have completed remediation on their primary residences,
and independent colleges & universities who have costs incurred
on or after December 31, 1996. This is specified in the application
in the section entitled "Reimbursement of Costs".
- The Petroleum Underground Storage Tank Remediation, Closure &
Upgrade Fund Application is currently undergoing revisions to incorporate
changes brought about by P.L.2006, c.58, which went into effect on August
2, 2006. Until such time as these revisions are completed, use of the
current application is acceptable.
