Updates to Petroleum Hydrocarbon (PHC) Guidance

The New Jersey Department of Environmental Protection (Department) has withdrawn the two documents found on the website (http://www.nj.gov/dep/srp/guidance/rs/#phc) entitled:
- Guidance on the Human Health Based and Ecologically Based Soil Remediation Criteria for Number 2 Fuel Oil and Diesel Fuel Oil which was posted September 16, 2008 and
- Summary of Guidance on the Human Health Based and Ecologically Based Soil Remediation Criteria for Number 2 Fuel Oil and Diesel Fuel Oil which was posted November 19, 2008.
They are currently under revision. Once the revisions are completed, the replacement documents will be posted on the Department website. This will happen shortly.
In the interim, the Department desires to notify the regulated community and other interested parties that the revised documents will include the following information:
- The originally proposed direct contact human health based criterion of 4,800 mg/kg for number 2 fuel oil and diesel fuel oil will be replaced by a criterion of 5,100 mg/kg.
- Until such time that the Extractable Petroleum Hydrocarbon analytical method is ready for use, the SW-846 Method 8015B - Diesel Range Organics and the Department’s OQA-QAM-025 are to be used to assess number 2 fuel oil or diesel fuel oil contamination. For other petroleum hydrocarbon compounds, when petroleum hydrocarbon compound analysis is necessary, OQA-QAM-025 is the required analytical method. These instructions can also be found at: http://www.nj.gov/dep/srp/guidance/tph/.
- Until such time that the Extractable Petroleum Hydrocarbon analytical method is ready for use, the 5,100 mg/kg criterion will apply to only number 2 fuel oil and diesel fuel oil contamination. For other petroleum hydrocarbon compounds, the 10,000 mg/kg criterion will remain in effect.
- For number 2 fuel oil and diesel fuel oil discharges being remediated using the 5,100 mg/kg criterion, the Department will replace the requirement to sample for volatile organic compounds plus 15 tentatively identified compounds with a requirement to analyze for naphthalene and 2-methylnaphthalene only. This requirement is triggered when the discharged petroleum hydrocarbon compound concentrations are greater then 1,000 mg/kg. The highest of the 25% of samples above 1,000 mg/kg are subject to this testing. For other petroleum hydrocarbon compounds, additional required testing will generally follow Table 2-1 in the Technical Requirements for Site Remediation (N.J.A.C. 7:26E–1 et seq.) except where noted by the Department.
- The ecological screening level will remain at 1, 700 mg/kg of petroleum hydrocarbon compound mixture. A significant ecological receptor as determined by the Baseline Environmental Evaluation must be present for an ecological risk assessment to be required.
