On March 26, 2013, the Hon. Sebastian P. Lombardi authorized the DEP to make publicly available a proposed Consent
Judgment which contains the terms of a proposed settlement between the DEP and a number of public and private third
parties in the litigation. The full Administrative Record is expected to be made available to the public on or
about May 6, 2013, at which time a notice of the proposed settlement will be published in the New Jersey Register
and a 60-day public comment period will commence.
