Stakeholder Process for Rules To Fully Implement the LSRP Program
The Department has been developing a proposal to amend the Administrative Requirements for the Remediation of Contaminated Sites rule (ARRCS), Industrial Site Recovery Act rule (ISRA) and the Underground Storage Tank rule (UST) to bring them into conformity with the Site Remediation Reform Act (SRRA) deadline for full implementation of the License Site Remediation Professional (LSRP) remediation program. The statutory deadline for full implementation is May 2012. The Department anticipates publishing the proposal in the May 2, 2011 New Jersey Register for adoption in May, 2012.
The Department has posted a working draft of the rule text of the affected subchapters of ARRCS, ISRA and UST on its Site Remediation Program website at http://www.nj.gov/dep/srp/regs/drafts/. Please note that in the rule text, additions to existing text are noted in bold typeface. Deletions from existing text are shown within [brackets]. The Department welcomes your input on these amended subchapters. Please submit your comments to SRRA@dep.nj.gov by January 14, 2011. To be considered, the email subject line MUST read: Stakeholder Input.
This is not the final version of the proposal, but it is intended to give all stakeholders an opportunity to review the substance of the significant changes the Department is proposing. Please note that Subchapter 7 (Remedial action permits) and Subchapter 9 (Enforcement) of the ARRCS rule will be posted for comment in the near future. Subchapters in which there are no proposed changes are not included in the posting.
The comments submitted on the working draft will be considered by the Department in the development of the final rule proposal, but the Department will not provide written responses. There will be a formal comment and response period when the amendments are formally proposed in May, 2011.
