SITE REMEDIATION PROGRAM
Notice of Extension of Chapter Expiration Date
Technical Requirements for Site Remediation
N.J.A.C. 7:26E
Take Notice that Governor Jon S. Corzine has
been informed by the Department of Environmental Protection that
the Technical Requirements for Site Remediation, N.J.A.C. 7:26E,
are due to expire on December 17, 2007, in accordance with N.J.S.A.
52:14B-5.1.
The rules are promulgated under the authority of the Solid Waste
Management Act, N.J.S.A. 13:E-1 et seq.; the Industrial
Site Recovery Act, N.J.S.A. 13:1K-6 et seq.; the Spill
Compensation and Control Act, N.J.S.A. 58:10-23.11a et seq.;
the New Jersey Underground Storage of Hazardous Substances Act,
N.J.S.A. 58:10A-21 et seq.; the Water Pollution Control
Act, N.J.S.A. 58:10A-1 et seq.; and, the Brownfield and
Contaminated Site Remediation Act, N.J.S.A. 58:10B-1 et seq.
and set forth the Department's procedures for investigating and
remediating sites which are contaminated or at which contamination
is suspected.
The Department is currently working closely with a large stakeholder
group and members of the Legislature concerning amendments to the
statutes administered by the Department’s Site Remediation
Program, including the Spill Compensation and Control Act and the
Brownfield and Contaminated Site Remediation Act. The Department
anticipates that these amendments will have a substantial and significant
impact on the Site Remediation Program and will likely require significant
amendments to the Technical Rules. The Department anticipates that
legislative hearings on Site Remediation statutory reforms will
begin in January 2008; therefore, the Department is requesting a
two-year extension of the expiration date of the Technical Rules,
from December 17, 2007 to December 17, 2009.
By the authority vested in him, Governor Jon S. Corzine, on December
4, 2007 directed that the expiration date for N.J.A.C. 7:26E be
extended from December 17, 2007 to December 17, 2009.
