DEP Rules Proposal Concerning Subchapter 16 of the UST Rule
DEP is proposing a readoption with amendments of Subchapter 16 of the Underground Storage Rules, NJAC 7:14B (aka "UHOT proposal"). See the rule proposal notice for more information.

NOTE: The notice of proposal published in the May 5, 2008 New Jersey Register at 40 N.J.R. 2166(a) said that the hearing would be held on Thursday, July 3, 2008 at 10:00 A.M. The correct date and time for the hearing is Friday, June 13, 2008 from 1:00 P.M. to 3:00 P.M. The DEP online version of the proposal notice (link above) has the correct date and time.
SRP Fee Rules
The Site Remediation Program has amended various program rules
to adjust the fees for services provided by SRP, including those
covered by the UST Rules. The rules below reflect these changes.

Certification to perform services on unregulated heating oil tanks.
On October 2, 2006, the Department of Environmental Protection
adopted special amendments and new rules to the Underground Storage
Tank Rules, N.J.A.C. 7:14B and amendments to the Department Oversight
of the Remediation of Contaminated Sites Rules, N.J.A.C. 7:26C.
These amendments and new rule were effective upon filing (October
3, 2006).
The law also mandates that a grant or loan from the fund established
under the Underground Storage Tank Finance Act to close or replace
an unregulated heating oil tank may only be made to reimburse the
applicant for work performed by a person certified by the Department.
