Site Remediation Program
Stakeholder Process
Commissioner Martin and Deputy Commissioner Kropp believe that
working with a broad range of stakeholders is essential to making
the transition from the old SRP paradigm to a new
successful LSRP program. To this end, the Department has set up
an extensive stakeholder process for general program issues, rules
and guidance. Names of the stakeholder committees, DEP chairpersons,
and goals of each of these stakeholder committees are provided
below.

LSRP Program Steering Committee:
Tom Cozzi/Karen Hershey (co-chairs)
Deadline: No deadline, ongoing role
Committee goal: To work with the Department
on the implementation of the existing LSRP program and set the
stage for full implementation in May, 2012. The Committee is comprised
of SRP managers and staff, environmental consultants, industry
representatives, lawyers and members of the environmental community.
The Steering Committee meets monthly to discuss general program
issues and propose solutions to identified problems. The Steering
Committee established four subcommittees described below.

Technical Rules: Bill Hose (DEP chair)

Deadline: May 2011 Committee Goal: To transform the Technical Requirements
for Site Remediation, N.J.A.C. 7:26E (Technical Rules) from their
current detailed and prescriptive form to rules that will establish
straight forward, goal-oriented remediation requirements. These
goal oriented rules are an integral part of the new LSRP program
and will allow for more flexibility to address contamination and
potential exposure pathways, thereby allowing persons responsible
for conducting remediation the opportunity to use alternative
methods/materials to achieve compliance.

Technical Guidance: George Nicholas (DEP chair)
Kathy Kunze, Suzanne Shannon, Tessie Fields, Joe Nowak
Deadline: Deadlines vary for each team between
January 2011 and May 2011.
Committee Goal: To develop topic specific technical
guidance that will work in concert with the Technical Rules by
providing all actions, tactics and technical issues to be considered
in the remediation of a contaminated site. These guidance documents
will help the LSRP or remediating party apply professional judgment
during the remedial process. The LSRP licensing board may also
use these documents to help evaluate whether professional judgment
was applied appropriately at a site.

Guidance document review process:
When a draft final guidance document is completed
by a Committee, all Committee members should support releasing
the document for review, both within DEP, and by outside Stakeholders.
The document will be sent to outside Stakeholders that are on
all of the Technical Guidance Committees. Those Stakeholders will
assume responsibility for coordinating reviews within their respective
constituencies and funnel comments back to the Committee Chairperson.
Stakeholders on the SRRA Steering Committee will also have an
opportunity to review the document for major flaws.
Their review will be coordinated by the DEP Steering Committee
Chairperson. The review period for draft final documents is generally
six weeks. Following the close of the comment period, the Guidance
Committee issuing the document will review all comments and revise
the document if necessary. The document will then be released
as a final Guidance Document and be posted on the DEP’s
webpage. Significant technical comments debated within the Committee
will be addressed in writing and posted on the DEP’s Web page.

Committee Goal: To develop realistic, meaningful
measures to help evaluate the strengths and weaknesses of the
LSRP program. These measures will be used for continual program
improvement and will form the basis of the Department’s
reporting to the Legislature. The measures of success will focus
on timeliness, program performance, LSRP and Remediating Party
Oversight/Transparency and the Protectiveness of remediations.

Near-Term Priorities: Tessie Fields/Karen Kloo (DEP
co-chairs)

Deadline: No deadline, ongoing role
Committee goal: To identify and address problems
or areas for improvement related to the implementation of the
LSRP program. The committee is working on ways to encourage more
remediating parties to opt into the LSRP program and ways to improve
communication to others who may not be aware of SRRA and its impacts.

Linear Construction Best Management Practices: Kirstin

Committee goal: To develop best management practices for projects
such as construction and development activities within areas such
as public roadways, railroads, or utility lines that across properties
that are known or suspected to be contaminated.

6. |
Remedial Priority System: George Klein (DEP chair)
Committee goal: To develop a Remedial Priority
Scoring (RPS) system to measure each contaminated site's relative
risk to human and ecological health. The system will be based
on the Department’s existing electronic data and will be
enhanced as new data, improved logic and additional capabilities
become available.
