In 2005, New Jersey adopted rules at N.J.A.C. 7:27-28.3 which require that all diesel engines sold for use in New Jersey be certified as meeting the California new engine standards (Title 13, California Code of Regulations, Section 1956.8). California subsequently amended their regulations to require that all model year 2008 and newer diesel engines be equipped with an automatic engine shutdown feature that shuts down the engine after five minutes of idling. As a result, New Jersey regulations also require that heavy-duty diesel engines sold in New Jersey with model year 2008 engines or newer be sold with the automatic engine shutdown feature and with the documentation required by California (engine must be labeled “Conforms to …California Regulations”). The vehicle invoice and/or Manufacturers Statement of Origin may also be used to determine whether the vehicle complies with the emission requirements of California and New Jersey. |
