The New Jersey Department
of Environmental Protection (Department)
has decided not to pursue the adoption
of an amendment proposed October 17, 2005
to the Atlantic, Lower Delaware, Lower
Raritan/Middlesex, Mercer, Monmouth, Northeast,
Ocean, Tri-County, Upper Delaware and Upper
Raritan Water Quality Management (WQM)
Plans (see 37 NJR 4071(a); October 17,
2005). Through this plan amendment the
Department proposed to withdraw and re-designate
certain wastewater service area designations
in wastewater management planning areas
where wastewater management plans (WMPs)
are out of compliance with the Water Quality
Management Planning rules (N.J.A.C. 7:15).

The
New Jersey Department of Environmental
Protection (Department) has decided not
to pursue the adoption of an amendment
proposed October 17, 2005 to the Atlantic,
Lower Delaware, Lower Raritan/Middlesex,
Mercer, Monmouth, Northeast, Ocean, Tri-County,
Upper Delaware and Upper Raritan Water Quality
Management (WQM) Plans (see 37 NJR 4069(b);
October 17, 2005). Through this plan amendment,
the Department proposed to revoke all wastewater
service area designations where the wastewater
service is to be provided by individual subsurface
disposal systems (ISSDS), commonly referred
to as septic systems. The Department proposed
to redesignate these areas as “Service
Area for Wastewater Facilities with Planning
Flows of Less Than 2,000 Gallons Per Day
Which Discharge to Ground Water.” The
Department is proposed that wastewater capacity
for a project in these areas be determined
on a cumulative, project-wide basis, so that
any project having a total wastewater design
capacity of 2,000 gallons per day or more,
whether proposing single or multiple wastewater
discharges, would be inconsistent with the
less than 2,000 gallons per day wastewater
service area designation and would require
the adoption of an amendment or revision
to the areawide WQM Plan before permits for
that project can be issued by the Department.
