Shellfish Harvesting Permit Applications

The Bureau of Marine Water Monitoring issues a variety of permits dealing with shellfish harvesting. Below is a list of permit applications available for download:

Permit
Description
Special permit to harvest and sell for bait purposes only, sea or surf clams (Spisula solidissima) from Prohibited waters.
Special permit to harvest soft clams (Mya arenaria) from specified Special Restricted waters within the state of New Jersey, for further processing at a state permitted and certified soft clam depuration / controlled purification facility.
Special permit to harvest hard clams (Mercenaria mercenaria) from specified Special Restricted waters within the state of New Jersey, for further processing at a state permitted and certified hard clam depuration / controlled purification facility.
Application for a special permit to collect shellfish for scientific research and non-human consumption from specified Special Restricted or Prohibited waters within the state of New Jersey.

Description
Permit 5a/5b Application: 5a: Special permit to harvest, buy, sell, and relay hard clams (Mercenaria mercenaria) from specified Special Restricted waters in conjunction with a state approved shellfish relay program.
5b: Special permit to harvest hard clams (Mercenaria mercenaria) from specified Special Restricted waters for sale purposes only in conjunction with a state approved shellfish relay program.
Permit 6 Application:
Special permit for the transfer of shellfish from leased lots in Prohibited waters to leased lots in Approved or Seasonally Approved waters.
Permit 7 Application:
Special permit to harvest seed oysters (Crassostrea virginica) from Prohibited waters for transplanting to leased lots in Approved water for purging of pollutants, growth, and ultimate marketing after written release by the Bureau of Marine Water Monitoring.
Permit 8 Application:
8b: Special permit for a certified depuration / controlled purification facility to possess soft clams (Mya arenaria) from specified Special Restricted and seasonal Special Restricted waters for further processing.
8c: Application for special permit for the possession of seed oysters (Crassostrea virginica) harvested from Prohibited waters.
Permit 10 Application:
Application from a special permit for a certified depuration / controlled purification facility to possess hard clams (Mercenaria mercenaria) from Special Restricted for further processing.

Penalty for Illegal Shellfishing
Harvesting shellfish illegally is punishable in the following manner;

1st Offense – Petty Disorderly Persons
Fines up to $500 and/or up to 30 days imprisonment

2nd Offense – Disorderly Persons
Fines up to $1000 and/or up to 6 months imprisonment

Possible seizure and forfeiture of boat and equipment for any offense.
