MOST RECENT NOTICE OF APPLICATIONS RECEIVED (NAR)

The Commission recently received applications from the sponsors of the following projects for approval pursuant to Section 3.8, Article 11, and/or Article 10.3 of the Delaware River Basin Compact. These projects currently are under review by the Commission staff in consultation with other public agencies. Individuals or organizations having a special interest in any projects or information relating to a project's impacts on water and related land resources of the Delaware River Basin are invited to submit written comments to the Commission's Executive Director, Carol R. Collier. Please refer to the appropriate docket number, listed below, on all correspondence. Such public hearings as may be required for these projects will be announced at a later date in accordance with the Commission's Rules of Practice and Procedure. Please refer to the Commission's website (www.nj.gov/drbc/dockets/status.htm) to track the status of these projects.

  1. Gulph Mills Country Club, D-1966-217-2.  An application for the renewal of a groundwater withdrawal project to continue withdrawal of 11.886 mg/30 days to supply the applicant’s golf course irrigation from existing Well No. 1 in the Conestoga Formation.  The project is located in the Matsunk Creek Watershed in Upper Merion Township, Montgomery County, Pennsylvania, within the Southeastern Pennsylvania Ground Water Protected Area. 

  2. Womelsdorf Sewer Authority, D-1967-084 CP-2.  An application for modification of the Womelsdorf Sewer Authority Wastewater Treatment Plant (WWTP).  The modification includes expansion of the WWTP from 0.30 mgd to 0.475 mgd. Although the expansion to 0.475 mgd was completed in 2000, it occurred without the Commission’s review.  The WWTP will continue to discharge to the Tulpehocken Creek, a tributary to the Schuylkill River.  The facility is located in Heidelberg Township, Berks County, Pennsylvania. 

  3. Reliant Energy Mid-Atlantic Power Holdings, LLC, D‑1987-26-3.  An application to renew the Commission’s approval of discharges associated with the Titus Generating Station, including the Beagle Club Ash Disposal (BCAD) site discharge (Outfall 004), the Titus Generating Station industrial waste treatment plant (IWTP) (Outfall 002), and the Titus Energy Station non-contact cooling water (NCCW) discharge (Outfall 001).   The applicant has requested that the intermittent discharge from Outfall 004 continue to have an effluent limit of 3,500 mg/l of TDS (monthly average).  The average annual flow of the existing IWTP (Outfall 002) and the NCCW discharge (Outfall 001) will remain at 2.149 mgd and 1.469 mgd, respectively.   The IWTP is hydraulically designed for 3.2 mgd.  The RRI Energy Titus Generating Station facilities will continue to discharge to the Schuylkill River. The project is located in Cumru Township, Berks County, Pennsylvania. 

  4. Delaware County Regional Water Quality Control Authority (DELCORA), D‑1992‑18 CP-2.  An application for approval to accept oil and gas wastewater from natural gas drilling operations and to increase the Total Dissolved Solids (TDS) effluent limit for the DELCORA Western Regional Treatment Plant (WRTP) from 1,000 mg/l to 5,000 mg/l. The applicant also requests approval to re-rate the plant hydraulically from 44 mgd to 50 mgd.  Effluent limits for the plant will continue to be based on a flow rate of 44 mgd.  The WWTP will continue to discharge to Water Quality Zone 4 in the Delaware Estuary.  The project is located in the City of Chester, Delaware County, Pennsylvania.  

  5. Aqua Pennsylvania – Chalfont System, D-1993-083 CP-2.  An application for approval of a groundwater withdrawal project for which the Commission’s approval has expired, to continue a withdrawal of 39 mg/30 days to supply the applicant’s public water supply system from five existing wells.  The project is located in the Stockton Formation in the Neshaminy, Pine Run and Cooks Run watersheds in Chalfont and New Britain boroughs, Montgomery County, Pennsylvania within the Southeastern Pennsylvania Ground Water Protected Area (GWPA).  The project wells are located in three sub-basins of the Neshaminy Creek Basin, as defined by the GWPA Regulations:  North Branch Neshaminy Creek, Pine Run Basin and Doylestown Sub-basin Neshaminy Creek. 

  6. Valley Forge Sewer Authority, D-1995-6 CP-2.  An application for approval of the modification of the Valley Forge Sewer Authority Wastewater Treatment Plant (WWTP).  The docket holder proposes to replace the current disinfection system (chlorine contact tank) with an ultraviolet light (UV) disinfection system.  The modification also includes the re-rate of the WWTP from 8.99 mgd to 9.2 mgd.  Although the plant re-rate was completed in 1999, it occurred without the Commission’s review.  The WWTP will continue to discharge to the Schuylkill River.  The facility is located in Schuylkill Township, Chester County, Pennsylvania. 

  7. Central Bucks School District, D-1995-020 PA-2.  An application for the renewal of an existing groundwater withdrawal project to continue withdrawal of up to 1.14 mg/30 days of water to supply the Central Bucks High School East from existing Well No. PW-1, completed in the Stockton and Beekmantown formations.  The project is located in the Lahaska Creek Watershed in Buckingham Township, Bucks County, Pennsylvania within the Southeastern Pennsylvania Ground Water Protected Area.

  8. Elverson Water Company, Inc., D-1996-048 PA-2.  An application for approval of a groundwater withdrawal project for which the Commission’s docket approval has expired, to continue a withdrawal of up to 2.16 mg/30 days to supply the applicant's public water supply system from existing Wells Nos. 1, 2, 3 and 4.  Wells Nos. 1, 2 and 4 are completed in the Chickies Formation and Well No. 3 is finished in the Stockton Formation.  The project is located in the French Creek Watershed in Elverson Borough, Chester County, Pennsylvania, within the Southeastern Pennsylvania Ground Water Protected Area (GWPA).  The project wells are located in the South Branch French Creek Sub-basin as defined by the GWPA Regulations.

  9. Teva Pharmaceuticals USA, Inc., D-1996-049-3.  An application for approval of a groundwater withdrawal project to supply up to 3.0 mg/30 days of water to the applicant’s proposed manufacturing facility from new Wells Nos. TW-3 and TW-4 and to retain the existing total withdrawal of 2.5 mg/30 days from existing Wells Nos. 1, 2, and 3, which are used at the applicant’s existing facility.  The project is located in the Brunswick Group in the East Branch Perkiomen Creek Watershed in West Rockhill Township, Bucks County, Pennsylvania in the Southeastern Pennsylvania Ground Water Protected Area. 

  10. Coventry Terrace MHC, LLC, D-1997-002 PA-2.  An application for the renewal of a groundwater withdrawal project to continue to withdraw up to 0.6 mg/30 days to supply an existing mobile home community from existing Wells Nos. 1 and 3 in the Brunswick Formation.  The project is located in the Pigeon Creek Watershed in East Coventry Township, Chester County, Pennsylvania in the Southeastern Pennsylvania Ground Water Protected Area.

  11. Richland Meadows Mobile Home Park, D-1997-042 PA-2.  An application for the renewal of an existing groundwater withdrawal project to continue the withdrawal of up to 2.9 mg/30 days of water to supply the applicant’s mobile home park from existing Wells No. 1, 2, 3, and 4 in the Brunswick Formation.  The project is located in the Morgan Creek Watershed in Richland Township, Bucks County, Pennsylvania within the Southeastern Pennsylvania Ground Water Protected Area.  The site is located within the drainage area of the section of the non-tidal Delaware River known as the Lower Delaware, which is designated as Special Protection Waters.

  12. Lower Providence Township Municipal Authority, D-1999-021 CP-2.  An application for the renewal of a groundwater withdrawal project to continue to supply up to 2.27 mg/30 days of water to the applicant’s golf course from existing Wells Nos. 1 and 2 in the Stockton Formation. The project is located in the Mine Run and Schuylkill River Watersheds in Lower Providence Township, Montgomery County, Pennsylvania in the Southeastern Pennsylvania Ground Water Protected Area.

  13. The Upper Hanover Authority and The Red Hill Water Authority, D-2002-10 CP-3.  An application for a groundwater withdrawal project to increase the withdrawal from 43.113 mg/30 days to 56.88 mg/30 days from six existing wells and one existing spring water withdrawal (Kemmerer Spring) to supply the applicant’s public water supply.  The 13.767 mg/30 days increase would be obtained from existing Wells Nos. TUHA-1 and TUHA-2.  The project is located in the Brunswick, Leithsville and Hardyston Formations.  The increased allocation is requested in order to meet 10-year projected increases in service area demand.  The project is located in the Perkiomen Creek and Macoby Creek watersheds in Upper Hanover, Hereford and Upper Milford Townships, Montgomery, Berks and Lehigh Counties, Pennsylvania and is located in the Southeastern Pennsylvania Ground Water Protected Area (GWPA).   The project wells are in the Upper Reach Perkiomen Creek and Perkiomen-Macoby Run sub-basins as defined by the GWPA Regulations. 

  14. Borough of Strausstown, D-2005-6 CP-2.  A renewal application for approval to continue discharging 0.065 mgd of treated effluent from the Borough of Strausstown Wastewater Treatment Plant (WWTP).  The WWTP is located at River Mile 92.47 – 76.8 – 15.4 – 0.8 – 6.5 – 0.4 (Delaware River – Schuylkill River – Tulpehocken Creek – Northkill Creek – Little Northkill Creek –  Jackson Creek) in Pocono Township, Monroe County, Pennsylvania. 

  15. Tidewater Utilities, Inc., D-2005-027 CP-2.  An application for the renewal of an existing ground water withdrawal project and to increase the current withdrawal from 3.51 mg/30 days to 4.967 mg/30 days to supply the applicant’s public water supply system from existing Wells Nos. VWQ-1, VWQ-2, WQ-2, and WQ-4, completed in the Piney Point and Frederica aquifers.  Wells Nos. VWQ-1 and VWQ-2 are not included in the current groundwater withdrawal docket.  The increased allocation is requested in order to meet projected increases in service area demand.  The project is located in the Isaac Branch Watershed of the Saint Jones River in the City of Dover, West Township, Kent County, Delaware.

  16. Markel Corporation, D-2009-029 PA-1.  An application for approval of a new groundwater withdrawal project to supply up to 2.08 mg/30 days of water to the applicant's industrial process from existing Wells Nos. 2 and 3.  The project is located in the Stockton Formation in the Diamond Run Watershed in Plymouth Township, Montgomery County, Pennsylvania within the Southeastern Pennsylvania Ground Water Protected Area.

  17. Green Top Management Mobile Home Park, D-2009-030 PA-1.  An application for approval of a new groundwater withdrawal project to supply up to 0.54 mg/30 days of water to the applicant's water supply from existing Wells Nos. 1 and 3 and new Well No. 4.  The project is located in the Triassic Diabase in the Tohickon Creek Watershed in West Rockhill Township, Bucks County, Pennsylvania and is located in the Southeastern Pennsylvania Ground Water Protected Area.  The site is located within the drainage area of the section of the non-tidal Delaware River known as the Lower Delaware, which is designated as Special Protected Waters.

  18. Geerling’s Florist, Inc., D-2009-031-1.  An application for approval of a groundwater withdrawal project to continue to supply up to 3.08 mg/30 days of irrigation water to the applicant’s greenhouse and nursery operations from existing Wells Nos. 55585, 55586, 55587, 55588, 55589, and 55590.  The project is located in the Brunswick Formation in the Mill Creek and Pidcock Creek watersheds in Buckingham Township, Bucks County, Pennsylvania within the Southeastern Pennsylvania Ground Water Protected Area. 

  19. Bucks County Community College, D-2009-032 PA-1.  An application for approval of a ground water withdrawal project to continue to supply up to 0.81 mg/30 days of water to the Bucks County Community College from existing Wells Nos. 1 and 2.  The project is located in the Lockatong Formation in the Neshaminy Creek Watershed in Newtown Township, Bucks County, Pennsylvania, within the Southeastern Pennsylvania Ground Water Protected Area.

  20. Doylestown Hospital t/a Pine Run Community, D-2009-033 PA-1.  An application for approval of a groundwater withdrawal project to supply up to 2.0 mg/30 days of water to the Doylestown Hospital-Pine Run Community from existing Wells Nos. PRC-Well 1 and PRC-Well 2.  The project is located in the Stockton Formation in the Pine Run Watershed in Doylestown Township, Bucks County, Pennsylvania within the Southeastern Pennsylvania Ground Water Protected Area. 

  21. State of Delaware Parks and Recreation – Garrison Lake Golf Course, D-2009-034 CP-1.  An application for approval of a groundwater and surface water withdrawal project to supply a maximum of 7.0 mg/30 days of water to irrigate approximately 100 acres of fairways, tees, greens, and rough.  Existing Well No. 1 supplies water to an existing pond, and a surface water intake on the pond supplies water for irrigation of the golf course.  The project well is located in the Lynch Heights Formation, and the surface water withdrawal is from a pond located on an unnamed tributary to the Leipsic River.  The project is located in Kent County, Delaware. 

  22. Chester Valley Golf Club, D-2009-035-1.  An application for approval of a groundwater and surface water withdrawal project to supply up to 1.2 mg/30 days of groundwater and up to 3.0 mg/30 days of surface water from existing Well No. 11904 and two existing surface water intakes – the “Pond” and “Creek” Intakes – to irrigate the applicant’s golf course.  The project is located in East Whiteland Township, Chester County, Pennsylvania in the Southeastern Pennsylvania Ground Water Protected Area.  The surface water will be withdrawn from an unnamed tributary of Valley Creek.  The well is located in the Elbrook Formation within the Valley Creek Sub-basin.  

  23. Deb-El Food Products, D-2009-036-1.  An application for approval to construct a 0.05 mgd industrial waste treatment plant (IWTP) that will discharge to the Neversink River at River Mile 253.64 – 28.7 (Delaware River – Neversink River) in the drainage area of the section of the Non-Tidal Delaware River known as the Middle Delaware, which is designated as Special Protection Waters.  The IWTP is located in the Town of Thompson, Sullivan County, New York. 

  24. East Vincent Township Municipal Authority, D-1993-032 CP-2.  An application for approval to renew a discharge of up to 2.0 mgd from the existing Veterans Center Wastewater Treatment Plant (WWTP).  The WWTP will continue to discharge an average of 0.5 mgd of treated domestic waste to the Schuylkill River via Outfall No. 001 at River Mile 92.47 – 43.5 (Delaware River – Schuylkill River).  In addition, modifications to the existing WWTP are proposed, to include a new screen facility, a new filter building, repairs to existing treatment tanks, and other miscellaneous improvements.  The Veterans Center is located in East Vincent Township, Chester County, Pennsylvania. 

  25. Lower Perkiomen Valley Regional Sewer Authority, D-2001-042 CP-3.  An application for approval to renew a discharge of up to 14.25 mgd from the existing Oaks Wastewater Treatment Plant (WWTP).  The Oaks WWTP discharges to the Schuylkill River at River Mile 92.47 – 32.35 (Delaware River – Schuylkill River), in Upper Providence Township, Montgomery County, Pennsylvania.

  26. NuStar Asphalt Refining, LLC, D-2009-037-1.  An application for approval of an existing 5.48 mgd discharge of untreated industrial wastewater and stormwater through discharge Outfalls Nos. DSN002A, DSN003A, DSN004A, DSN005A, DSN006A, and DSN007A.  Stormwater is commingled with condensate from steam heating, sand filter backflush water, and/or tank drain discharges.  The asphalt refinery is located in Paulsboro Borough, Gloucester County, New Jersey and the six outfalls are located in Water Quality Zone 4 at or near River Mile 89.66 (Delaware River).

  27. Beaver Lake Estates, D-2009-038 CP-1.  An application for approval of the expansion of the Beaver Lake Estates Wastewater Treatment Plant (WWTP) from 0.035 mgd to 0.14 mgd.  Outfall No. 001 will continue to discharge to an unnamed tributary of Barnum Brook, a tributary of the Neversink River at River Mile 253.64 –25.15 – 2.0 – 1.12 (Delaware River – Neversink River – Barnum Brook – Unnamed Tributary) in the drainage area of the section of the non-tidal Delaware River known as the Middle Delaware, which is designated as Special Protection Waters.  The Beaver Lake Estates WWTP is located in the Town of Thompson, Sullivan County, New York.

  28. ArcelorMittal Plate, LLC – Conshohocken, D-2009-039-1.  An application for approval of a groundwater and surface water withdrawal project to supply up to 13 mg/30 days of groundwater and 108 mg/30 days of surface water to the applicant’s industrial process from the existing Q&T Well and existing surface water intake.  Surface water will be withdrawn from the Schuylkill River in the Schuylkill-Crow Creek Watershed.  The well is located in the Elbrook Formation in the Schuylkill-Crow Creek Watershed in Plymouth Township, Montgomery County, Pennsylvania in the Southeastern Pennsylvania Ground Water Protected Area.
