MOST RECENT NOTICE OF APPLICATIONS RECEIVED (NAR)

The Commission recently received applications from the sponsors of the following projects for approval pursuant to Section 3.8, Article 11, and/or Article 10.3 of the Delaware River Basin Compact.  These projects currently are under review by the Commission staff in consultation with other public agencies. Individuals or organizations having a special interest in any projects or information relating to a project's impacts on water and related land resources of the Delaware River Basin are invited to submit written comments to the Commission's Executive Director, Carol R. Collier.  Please refer to the appropriate docket number, listed below, on all correspondence.  Such public hearings as may be required for these projects will be announced at a later date in accordance with the Commission's Rules of Practice and Procedure.  Please refer to the Commission's website (www.nj.gov/drbc/dockets/status.htm) to track the status of these projects.

    1. Borough of Paulsboro Water Department D-72-67 CP-2.  An application for the renewal of a ground water withdrawal project to continue withdrawal of 62 million gallons per thirty days (mg/30 days) to supply the applicant’s public water supply distribution system from existing Wells Nos. 4, 5 and 7 in the Potomac-Raritan-Magothy Aquifer. The project is located in the Mantua Creek Watershed in the Borough of Paulsboro, Gloucester County, New Jersey.

    2. Village of Margaretville D-74-157 CP-2.  An application to replace the withdrawal of water from the “Fair Street well” in the applicant’s public water supply distribution system. This well has become an unreliable source of supply. The applicant requests that the withdrawal from the “Fair Street replacement well” be limited to 18.529 mg/30 days of water, and that the total withdrawal from all wells remain limited to 18.529 mg/30 days. The project is located in the sand, glacial till aquifer in the East Branch Delaware Watershed in the Village of Margaretville, Delaware County, New York.  The site is located within the drainage area to the section of the non-tidal Delaware River known as the Upper Delaware, which is designated as Special Protection Waters.

    3. Northeast Land Company D-89-10 CP-3.  An application for the renewal of a ground water withdrawal project to continue withdrawal of 4.96 mg/30 days to supply the applicant’s public water supply distribution system from existing Well No. 1 and new Well No. 2. The project is located in the Catskill Formation in the Tunkhannock Creek Watershed in Kidder Township, Carbon County, Pennsylvania. The site is located within the drainage area to the section of the non-tidal Delaware River known as the Lower Delaware, which is designated as Special Protection Waters.

    4. Pennsylvania American Water Company D-91-14-2.  The purpose of this project is to replace the existing Rotating Biological Contactor (RBC) wastewater treatment process with a Sequential Batch Reactor (SBR) process at the applicant’s existing wastewater treatment plant (WWTP). The modified WWTP will continue to discharge 0.275 mgd. The project is located approximately 2000 feet east of Blue Mountain Lake and approximately 500 feet west of the Smithfield Township line in Water Quality Zone 1D at River Mile 213.0-5.3-2.9 on the Sambo Creek. Sambo Creek is a tributary to the section of the non-tidal Delaware River known as the Middle Delaware, which is designated as Special Protection Waters with the classification Outstanding Basin Waters.

    5. Matrix Realty, Inc. d/b/a Commonwealth National Country Club D-96-27-2.  An application for the renewal of a ground water withdrawal project to continue withdrawal of 5 mg/30 days to supply the applicant’s golf course irrigation system from existing Well No. CW-2 in the Stockton Formation.  The project is located in the Park Creek Watershed in Horsham Township, Montgomery County, Pennsylvania, within the Southeastern Pennsylvania Ground Water Protected Area.

    6. Pine Valley Golf Club D-96-34-2.  An application for the renewal of a ground and surface water withdrawal project to decrease withdrawal from 32 mg/30 days to 28 mg/30 days to supply the applicant’s golf course irrigation and club house from existing Wells Nos. 2 and 3 and Intakes Nos. 1 and 2 in the Mt. Laurel–Wenonah Formation. The project is located in the North Branch Big Timber Creek Watershed in Pine Valley Borough, Camden County, New Jersey.

    7. Merck and Company, Inc. D-98-14-2.  An application for the renewal of a ground water withdrawal project to continue the withdrawal of 45 mg/30 days to supply the applicant’s ground water remediation and facility operations from twelve existing wells in the Brunswick and Lockatong Formations.  The project is located in the Skippack and Wissahickon Creek watersheds in Upper Gwynedd Township, Montgomery County, Pennsylvania, within the Southeastern Pennsylvania Ground Water Protected Area. 

    8. Honey Brook Golf Club D-98-28-2.  An application for the renewal of a ground water withdrawal project to continue withdrawal of 10.3 mg/30 days to supply the applicant’s golf course irrigation system from existing Well No. PW#1 in the Honey Brook Gneiss Formation. The project is located in the Brandywine-Christiana Watershed in Honey Brook Township, Chester County, Pennsylvania.

    9. Mercer County Improvement Authority d/b/a Mercer Oaks Golf Course D-99-28 CP-2.  An application for renewal of an existing surface water intake and approval of two new ground water wells for golf course irrigation and to retain the existing withdrawal from all sources of 15 mg/30 days. The project is located in the Potomac-Raritan-Magothy Aquifer in the Assunpink Creek Watershed in West Windsor Township, Mercer County, New Jersey.

    10. Washington Township Municipal Utilities Authority D-99-43 CP-2.  An application for the renewal of a ground water withdrawal project to change existing Well No. 20 from an Aquifer Storage and Recovery well to a production well, to continue the total combined withdrawal of 273.01 mg/30 days from all fifteen wells, and to increase the allocation for Wells Nos. 2, 3, 4, 5, 8, 9, 15 and 20 from 109 mg/30 days to 133.81 mg/30 days to supply the applicant’s public supply distribution system from existing Wells Nos. 2, 3, 4, 5, 8, 9, 10, 11, 14, 15, 16, 17, 18, 19, and 20 in the Mt. Laurel-Wenonah and Kirkwood-Cohansey Formations. The project is located in the Big Timber Creek and Mantua Creek watersheds in Washington Township, Gloucester County, New Jersey.

    11. Tidewater Utilities, Inc. D-2002-4 CP-2An application for the renewal of a ground water withdrawal project to increase withdrawal from 7.95 mg/30 days to 52.06 mg/30 days to supply the applicant’s public water supply distribution system from existing Well No. 74787 and new Wells Nos. 193788, 193789 and 184338. The increased allocation is requested in order to meet projected increases in service area demand. The project is located in the Columbia-Pocomoke and Beverdam formations in the Broadkill River Watershed in the City of Lewes and the City of Rehoboth Beach, Sussex County, Delaware.

    12. Tidewater Utilities, Inc. D-2005-26 CP-2 .  An application for the renewal of a ground water withdrawal project to increase withdrawal from 3.85 mg/30 days to 29.458 mg/30 days to supply the applicant’s North Dover and Garrisons Lake public supply distribution systems from existing Wells Nos. SF-01, SF-02 and KWE-02 in the Federalsburg and Cheswold Formations and new Wells Nos. 154547, 71057, 71058, 192844 and 109193 in the Cheswold and Piney Point Formations. The increased allocation is requested in order to interconnect formerly independent service districts and to meet projected increases in service area demand. The project is located in the Leipsic River Watershed in Kent County, Delaware.

    13. Hudson Valley Foie Gras, LLC D-2006-37-2.  An application for approval of the modification of an existing WWTP by the addition of effluent sand filters. The discharge from the 20,000 gallons per day (gpd) WWTP will continue to be discharged to the Middle Mongaup River, a tributary of the section of the non-tidal Delaware known as the Upper Delaware, which is designated as Special Protection Waters. The facility is located in Ferndale, Sullivan County, New York.

    14. Unimin Corporation D-2007-14-2.  An application for renewal of approval to discharge up to 2.275 million gallons per day to Dividing Creek from a hydraulic dredging operation. After neutralization and sedimentation, wash water from sorted dredge material (slurry sand) along with scalping screen separator water, storm water and infiltration groundwater is discharged to Outfall 001A. The applicant also discharges to Cub Swamp, a tributary of Dividing Creek, through Outfall 002A during heavy storm events. The facility is located in the tidal Delaware Bay Watershed in Commercial and Downe townships, Cumberland County, New Jersey.

    15. Mays Landing Sand and Gravel D-2007-32-1.  An application for approval of a surface water withdrawal project to supply up to 112.3 mg/30 days of water for sand and gravel processing. The surface water is used to process sand and gravel in a loop system which returns approximately 90% of the water to the pond. The project is located in the Maurice River Watershed in Maurice River Township, Cumberland County, New Jersey.

    16. Ruscombmanor Township D-2007-34 CP-1.  An application for approval to expand the Golden Oaks WWTP from 0.025 mgd to 0.0645 mgd. The WWTP discharges to an unnamed tributary of Furnace Creek in Ruscombmanor Township, Berks County, Pennsylvania. A Notice of Application Received (NAR) for this project was previously published on November 20, 2007. The 2007 application was for a discharge of 0.075 mgd, whereas the modified application requests a 0.0645 mgd discharge.

    17. Borough of Bryn Athyn D-2008-13 CP-1.  An application for approval of the existing 0.065 mgd Academy of the New Church WWTP. The WWTP discharges to an unnamed tributary of Huntingdon Valley Creek, which is a tributary of the Pennypack Creek in Bryn Athyn Borough, Montgomery County, Pennsylvania.

    18. Rake Pond Farm LLC D-2008-14 CP-1.  A combined surface water and ground water withdrawal project to supply a maximum of 11 mg/30 days of water to the applicant’s irrigation of approximately 20 acres of cranberries. The water withdrawal is utilized for crop irrigation, frost protection and harvest of cranberries. The applicant’s man-made ponds are recharged by ground water withdrawn from the Kirkwood Cohansey Aquifer in the Rancocas Creek Watershed in Southampton Borough, Burlington County, New Jersey.

    19. Fralinger Farms D-2008-16-1.  An application for the approval of a ground water withdrawal project to supply a maximum of 78.6 mg/30 days of water to the applicant’s irrigation system for approximately 283 acres of fruit trees. The applicant’s 15 wells are located in the Kirkwood-Cohansey Formation in the Cohansey River Watershed in Hopewell Township, Cumberland County, New Jersey. 

    20. F&S Produce Co., Inc. D-2008-17-1.  An application for approval of a ground water withdrawal project to supply up to 7.75 mg/30 days of water to the applicant’s vegetable and fruit processing plant from new Wells Nos. FS1 Well 1, FS1 Well 2, FS2 Well 1 and FS2 Well 2. The project is located in the Kirkwood-Cohansey Formation in the Maurice River Watershed in Deerfield Township, Cumberland County, New Jersey.

    21. Gemstar Development Corp. D-2008-18-1.  An application for approval to construct the new 21,000 gpd Heiden Road WWTP. The WWTP will discharge to Sheldrake Stream, a Class B tributary that flows into the Neversink River, a tributary to the section of the non-tidal Delaware River know as the Upper Delaware, which is designated as Special Protection Waters. The project is located in the Town of Thompson, Sullivan County, New York.

    22. Penn Terminal, Inc. D-2008-19-1.  An application for approval of the construction of a 450-foot extension of the existing wharf. The proposed construction would consist of a line of filled cellular cofferdam bulkheads that would be driven to sit atop bedrock at 40 feet mean low water (MLW) via dead weight cellular construction. Each cofferdam cell would be 48 feet wide. Approximately 10,400 cubic yards of dry fill material would be placed inside the cofferdam cells, 4,800 cubic yards of which would be below MLW. The project is located in the Borough of Eddystone, Delaware County, Pennsylvania.

    23. Omega Homes D-2008-20-1.  An application for approval to construct the new 90,000 gpd Villas Crossing WWTP. The WWTP will discharge to Mahoning Creek, a cold water fishery that flows into the Lehigh River, a tributary of the section of the non-tidal Delaware River known as the Lower Delaware, which is designated as Special Protection Waters. The project is located in West Penn Township, Schuylkill County, Pennsylvania.
