On July 7, 2008, through enactment of P.L. 2008, c. 36, State Board of Examiner and School Ethics Commission decisions which had previously been appealable to the State Board of Education became appealable to the Commissioner of Education, while Commissioner decisions became final agency actions appealable to the Appellate Division of the Superior Court. The final legal decision of the State Board of Education was rendered on June 30, 2008.
This site offers all State Board decisions from January 1997 through June 30, 2008. Included are the State Board's determinations of all appeals from decisions of the Commissioner, State Board of Examiners, and the School Ethics Commission. Decisions of the State Board of Education prior to 1992 are included in New Jersey School Law Decisions. Some, but not all, decisions from 1992 through July 1997 are included in the New Jersey Administrative Reports (N.J.A.R. 2d).
During the period of their issuance, decisions of the State Board of Education constituted final agency decisions, and, accordingly, were appealable to the Appellate Division of Superior Court.
