NOTICE – STATE BOARD APPEALS ELIMINATED
P.L. 2008, c. 36 eliminated the role of the State Board of Education in determining appeals from Commissioner of Education decisions. All decisions of the Commissioner now constitute final agency action under the Administrative Procedure Act, N.J.S.A. 52:14B-1 et seq. Therefore, appeals of Commissioner's decisions should be filed directly with the Appellate Division of the Superior Court. The State Board no longer has authority to consider any appeal of a Commissioner's decision.
