At its April 26, 2004 public meeting, the Government Records Council (Council) considered the April 19, 2004 Findings and Recommendations of the Executive Director and all related documentation submitted by the parties. The Council voted unanimously to adopt the entirety of said finding and recommendations. Therefore, the Council dismisses the complaint on the basis the complainant received a copy of the requested documents and withdrew his complaint.

This is the final administrative determination in this matter. Any further review should be pursued in the Appellate Division of the Superior Court of New jersey within forty-five (45) days. Information about the appeals process can be obtained from the Appellate Division Clerk’s Office, Hughes Justice Complex, 25 W. Market St., PO Box 006, Trenton, NJ 08625-0006.

Recommendations of Executive Director

Mr. Venezia received a copy of the documents that he requested on April 2, 2004.  In a letter to the Government Records Staff on April 14, 2004, he withdrew his Denial of Access Complaint.

The Executive Director respectfully recommends that the Council dismiss the complaint because Mr. Venezia received a copy of the requested documents and on April 14, 2004 he withdrew his complaint.

Legal Analysis

Since the complainant has withdrawn his case, a legal analysis is not needed.
